HomeMy WebLinkAboutresolution.council.088-94 RESOLUTION NO. ~ (series of 1994) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ASPENv COLORADOt GI~a_NTING COMMERCIAL/OFFICE DEVELOPMENT ALLOTMENTS IN THE CC COMMERCIAL CORE AND C-1 COMMERCIAL ZONE DISTRICTS FOR 1994 UNDER THE GROWTH MANAGEMENT QUOTA SYSTEM WHEREAS, Article 8 of Chapter 24 of the Aspen Municipal Code sets forth a growth management quota system governing new development within the City of Aspen; and WHEREAS, pursuant to section 24-8-103(A) (3) (a) of the Aspen Municipal Code, eight thousand (8,000) square feet of new leasable space is available for development allotment within the CC Commercial Core and C-1 Commercial zone districts of the City on an annual basis; and WHEREAS, MHZ Partners, Ltd. and Richard Corriere submitted an application requesting 2,700 square feet of net leasable area from the 1994 commercial quota for the C-1 zone district; and WHEREAS, the application was reviewed by the Planning Director and forwarded to the Planning and Zoning Commission; and WHEREAS, the Planning and Zoning Commission, at a duly noticed public hearing on November 1, 1994, did evaluate the proposals and accepted staff's score finding that the development proposal exceeded the minimum score thresholds for combined and individual score categories as required by Section 24-8-106(F) of the Aspen Municipal Code; and WHEREAS, the 624 E. Hopkins project scored a total ofi 27 points; and WHEREAS, the Planning and Zoning Commission has recommended 1 that the 624 E. Hopkins project be allocated a development allotment of 2,700 square feet of net leasable area; and WHEREAS, no challenges to the Planning and Zoning Commission's scoring have been submitted to the City Council as allowed Under Section 24-8-106(I) of the Aspen Municipal Code. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO TRAT: Section 1: In accordance with Section 24-8-106(J) of the Aspen Municipal Code, the Aspen City Council does hereby grant to the 624 E. Hopkins project a development allotment of 2,700 square feet of net leasable space from the 1994 commercial growth management quota. Section 2: In accordance with Section 24-8-108 of the Aspen Municipal Code, the development allotments as awarded herein shall expire on the day after the third anniversary of the date of approval of a site specific development plan for the project unless a building permit is obtained and the project is developed, or unless an exemption from or an extension to the approval is obtained.
