I~' \ '< RESOLUTION NO. ~ Series of 1995 A RESOLUTION OF THE TITLE BOARD OF THE CITY OF ASPEN, COLORADO, FIXING A PROPER AND FAIR TITLE FOR AN INITIATIVE PETITION AND BALLOT MEASURE RELATIVE TO THE CLOSING OF PORTIONS OF GALENA STREET AND COOPER AVENUE. WHEREAS, on February 12, 1995, an Affidavit of Petitioners' Committee was filed with the City Clerk indicating the persons constituting the committee responsible for circulating an initiative petition; and WHEREAS, the City Council established February 27, 1995, as the date that the Title Board was to consider the title for said initiative measure; and WHEREAS, the City Council established February 22, 1995, as the date for the receipt of draft language from the public for the Title Board to consider at its February 27, 1995, meeting; and WHEREAS, the Title Board, consisting of the Aspen City Council and the City Clerk, did meet on February 27, 1995, at a public hearing and upon due and proper consideration of all public comments received and due deliberation of the matter before it. NOW, THEREFORE, BE IT RESOLVED BY THE TITLE BOARD OF THE CITY OF ASPEN, COLORADO: Section 1. That the title and submission clause for the initiative measure filed with the City Clerk on February 13, 1995, shall read as follows: e e fa \. Initiated Measure Shall the City of Aspen close Galena Street between Hyman Avenue and Cooper Avenue and close Cooper Avenue between Galena Street and Hunter Street, to all motor vehicle traffic with the exception of mass transit vehicles to provide for a better pedestrian environment adjacent to the existing mall in downtown Aspen? YES NO Section 2. That the summary for the initiated measure fIled with the City Clerk on February 13, 1995, shall read as follows: The proposed ordinance would require the City of Aspen to close Galena Street between Hyman Avenue and Cooper Avenue and Cooper Avenue between Galena Street and Hunter Street, to all motor vehicle traffic with the exception of mass transit vehicles. The intent of the proposed ordinance is to provide a better pedestrian environment adjacent to the existing mall in downtown Aspen. The exception to allow mass transit vehicles would allow the Galena Street shuttle, or any other form of mass transit vehicles such as a trolley line, to traverse the closed streets. The fiscal impacts of the proposed ordinance are estimated to be as follows: The proposed ordinance does not require the closed streets to be improved as the current mall. The fiscal impacts were estimated on the assumption that the streets would be closed by the placement of aesthetically pleasing barriers and signage such as flower planter boxes which would allow mass transit vehicles to proceed through. Planter boxes placed on Galena Street and Cooper Street are estimated to cost approximately $5,000.00. Signage to advise motorists of the street closures are estimated to cost approximately $300.00. Annual maintenance for snow removal and flower p1antings for the closed streets is estimated to cost approximately $10,000.00 per year above the current cost of street maintenance. The major component of this additional cost is attributable to the loss in efficiency in snow removal. (Smaller snow removal equipment may be required to clean the closed streets than the normal Streets Department equipment.) Closing the streets would eliminate up to seventy four parking spaces plus four taxi waiting areas, one handicap parking spot, one "parking for official cars only" space, and a delivery truck loading area. These parking spaces currently generate approximately $85,000.00 per year in parking meter revenues and $38,000.00 in parking ticket fines. Upon the elimination of these spaces it is anticipated that vehicle owners will occupy other parking spaces in the immediate vicinity, thus reducing the fiscal impact to some _1.. ~i ~ ~.. ., ~_. ~L .... ~. - ... unknown degree. the INTRODUCED, READ AND ADOPTED by the Title Board of the City of Aspen on eR=r dayof ~.-, 1995. ~ 7. ~~ ohn S.
