B Series of 1994 A RESOLUTION APPROVING A PROFESSIONAL SERVICES AGREEMENT BETWEEN EARTHWORKS CONSTRUCTION INCORPORATED, AND THE CITY OF ASPEN, COLORADO, FOR PROFESSIONAL SERVICES RELATING TO RAW WATER LINE REPLACEMENT AND PRESSURE REDUCING VALVE REPLACEMENT, AND AUTHORIZING THE CITY MANAGER TO EXECUTE SAID AGREEMENT ON BEHALF OF THE CITY OF ASPEN, COLORADO. WHEREAS, there has been submitted to the City Council a professional services agreement between Earthworks Construction Incorporated, and the City of Aspen, a true and accurate copy of which is attached hereto as Exhibit "A"; NOW, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ASPEN, COLORADO: That the City Council of the City of Aspen hereby approves that professional services _ agreement between Earthworks Construction Incorporated and the City of Aspen, a copy of which is annexed hereto and incorporated herein, and does hereby authorize the City Manager of the City of Aspen to execute said agreement on behalf of the City of Aspen. SUMMARY: Staff believes that because of the timing requirements for the two projects--Raw '., Water Line Replacement and the Pressure Reducing Valve (PRV) Rep1acement--that there are no acceptable alternatives to awarding the contract to the lowest qualified bidder. '~.,_. @ \\ "\" PREVIOUS COUNCIL ACTION: City Council approved 1995 Asset Management Plan that contained funding for both of these Capital Water Projects. BACKGROUND: The Aspen Water Department requested bids on its 1995 water system repair and replacement program and opened bids on March 15, 1995. The proposed system improvements consisted of six projects: repair and replacement of the raw water line from Thomas Reservoir to the water treatment plants; replacement of three poorly functioning and unsafe PRV's located in Highway 82 with a single new PRV; replacement of water distribution and service lines in the Ardmore Subdivision; replacement of the approximately 100-yearo1d water main in Lake Avenue; replacement of approximately 100 aging and unserviceable fire hydrants; construction of utilities in Doolittle Drive to provide service to the water treatment plant; and, construction of an interconnect line from the Meadowood system to Castle Creek Road near the Aspen Valley Hospital. CURRENT ISSUES: The majority of these projects are intended to address high-priority repair and replacement of the water distribution system in order to reduce system water loss. !~ef,. \''1 ~. t~ '. @It. Ii \~ ,< Construction scheduling for two of these projects is critical because of the narrow window during the off-season when water demand is low and traffic volumes on Highway 82 is reduced. The two projects recommended for bid award at this time fall in this category. FINANCIAL IMPLICATIONS: Sufficient funds have been appropriated through the 1995 Capital Program to cover the contract costs and engineering fees for both projects. Earthworks was the low bidder on both projects and is considered to be qualified to perform the construction work. Construction will be supervised by the City's consulting water engineer. Bids on the balance of the projects listed were significantly higher than the engineer's estimate or the AMP budget. Staff does not recommend award until a thorough cost analysis and consideration of means to reduce the cost of the remaining projects is conducted. (See also discussion of alternatives.) RECOMMENDATION: Staff recommends that Council award the contract for the above projects to Earthworks in the amount of $241,975.00. ALTERNATIVES TO PROPOSED ACTION: Staff wishes to point out that the raw water line repair and replacement schedule includes work that is scheduled for construction in 1997-98 in the AMP. The cost of this work is $55,000.00 and includes an alternative raw water connection from the Castle Creek Intake directly to the treatment plan. Funds are available for this element from the 1995 Capital Program. This additional connection will improve the reliability of raw water supply in the event that Thomas Reservoir goes off line for maintenance, repair, or expansion. An alternative would be to defer this work until later, but to do so would require excavation of the plant yard twice, thereby disrupting planned construction of roadway improvements and the new storage buildings proposed for the plant site. ALTERNATIVES TO AWARD OF REMAINING BIDS: Bids for the remaining projects in the 1995 water system improvements range from 187% to 522% of the engineer's estimated construction costs. Staff will return with recommendations regarding the award of this remaining work but wishes to apprise Council of the options currently under consideration to address these higher-than-expected costs and their implications for meeting the objectives of the current year's work program. . Utilizing part or all of unobligated fund balances for "mainline repair and replacement available in the 1995 capital program. These appropriated funds were intended to perform point repair for high priority leaks identified in the leak survey. Approximately $250,000 remains unobligated for this purpose. . Reducing scope of work to include only the highest priority items. Consider the use of a public works construction team to perform portions of the work program utilizing seasonal labor and existing equipment. PROPOSED MOTION: I move to award the Bid for the Raw Water Line Repair and Replacement and the PRV Replacement to Earthworks Construction, Inc., in the amount of $241,975.00.
