Ie; (Series of 1997) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO, SUBMITTING TO THE ELECTORATE OF THE CITY OF ASPEN AN ADVISORY QUESTION AT THE MAY 6, 1997, MUNICIPAL ELECTION, AND SETTING SUCH BALLOT TITLE AND QUESTION. WHEREAS, Section 2.2 of the Aspen City Charter calls for general municipal elections to be held on the first Tuesday after the first Monday in May of odd numbered years; and WHEREAS, the Aspen City Council is further authorized pursuant to Section 5.7 of the Aspen Home Rule Charter to, on its own motion, submit questions to a vote of the electorate; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO, THAT: Section 1. The following question, seeking an advisory opinion from the electorate, shall be placed on the ballot at the City's biennial election to be held on May 6, 1997: AN ADVISORY QUESTION REGARDING THE CITY OF ASPEN'S SMOKING ORDINANCE: Please vote for ONLY ONE choice from the following four statements~ A. I believe that the City's current smoking regulations are about right and do not need to be amended. YES B. I believe that the City's current smoking regulations are not strict enough and that City Council should consider additional restrictions, such as prohibiting smoking in public areas (for example, worksites and restaurant bar areas) where non-smokers are exposed to second hand smoke. For restaurants, smolting would be allowed in their bar areas only if those areas were completely separate & independently ventilated. Smoking would still be allowed in bars, nightclubs, private clubs and cigar bars. YES 1 - - e C. I not only agree with the statement above (Paragraph B), but I believe that the smoking prohibition should apply to bars & nightclubs, as well. YES D.
