HomeMy WebLinkAboutresolution.council.039-97 e . e RESOLUTION NO,.3...:L (Series of 1997) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO, GRANTING A WAIVER OF LAND USE APPLICATION FEES FOR A 100% AFFORDABLE HOUSING PROJECT LOCATED AT 1230 E, COOPER AVENUE, CITY OF ASPEN, PITKIN COUNTY, COLORADO WHEREAS, pursuant to Section 26.52 of the Municipal Code, Doug Michalowski (applicant) submitted an application (development proposal) to the Planning Department on October 16, 1997; and, WHEREAS, the development proposal consisted entirely of affordable housing units; and, WHEREAS, the Planning Department and the Housing Board reviewed the development proposal; and, WHEREAS, the development proposal was withdrawn without any approvals; and, WHEREAS, the applicant signed a fee agreement with the City and is responsible for reimbursing the City for time City Staff spent reviewing the development proposal in the amount of $1 ,002.50; and, WHEREAS, Pursuant to Section 26.08.010 ofthe Municipal Code, the City Council may take such other actions not delegated to the Commission, the Historic Preservation Committee, the Board of Adjustment, or the Planning Director, as the City Council may deem desirable and necessary to implement the provisions of the Land Use Code; and, WHEREAS, because the development proposal was never reviewed by the City Council, the applicant did not get the opportunity to request a waiver of the land use application fees during the land use process and is now making such a request; and, WHEREAS, the City Council found, in this instance, a waiver of the land use application fees to encourage the private sector to develop 100% affordable housing projects is desirable. e . . Resolution No.~, Series of 1997 Page 2 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF ASPEN, COLORADO, THAT: Section I: In accordance with Section 26.08.010 of the Aspen Municipal Code, the City Council of the City of Aspen, Colorado, does hereby grant a waiver of the $1,002.50 land use application fee to Doug Michalowski for a 100% affordable housing project at 1230 E, Copper Avenue that did not receive approvals, without conditions.
