A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO,
GRANTING A TEMPORARY USE PERMIT FOR A TENT AT THE ASPEN CLUB,
1450 CRYSTAL LAKE ROAD, CITY OF ASPEN, COLORADO
WHEREAS, pursuant to Section 26.96 of the Aspen Municipal Code, the Applicant, the
Aspen Club, has submitted an application for a Temporary Use Permit to erect a tent for exercise
equipment and activities displaced by current renovations; and,
WHEREAS, the Applicant requests to use this tent from May 28, 1997, to November 15,
1997; and
WHEREAS, the staff has reviewed the temporary use application, finds it to be
consistent with the current land use and the intent of the Zone District, and recommends that the
City COlmcil approve the temporary use permit with conditions; and
WHEREAS, City Council finds that the proposed temporary use is not inconsistent with
the character and existing land uses of the surrolmding parcels and neighborhood and that
granting the temporary use permit will not adversely impact the neighborhood or the public
health, safety, and general welfare.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF ASPEN,
COLORADO, THAT:
Section I: In accordance with Section 26.96 of the Aspen Municipal Code, the City Council of
the City of Aspen, Colorado, does hereby grant a temporary use permit for a tent to house
exercise equipment and activities displaced by current renovations at the Aspen Club, 1450
Crystal Lalce Road, with the following conditions:
1) The temporary use permit shall be for one tent as described in the application located on
the wooden deck on the northeast side of the main building. The duration of this pennit
shall be from May 28,1997, to November 15, 1997.
2)
The owner may use the tent only for activities being displaced by the renovations and
shall not expand services or commercial activities.

3)
The applicant must obtain a building permit before erecting the tent. Before issuance of
a building permit, the Building Department and the Fire Marshall shall review and
approve the final plans for the tent, including the interior arrangement of exercise
equipment. Failure to comply with all applicable Fire and Building Code requirements
shall be cause for the suspension of the temporary use permit.
4) The applicant shall not enclose existing vegetation, including planter boxes.
5) The applicant shall manage and conduct activities on site in such a manner as not to
create a nuisance, as defined in Section 15.04.520 of the Municipal Code.
6) The applicant shall not create or allow noise levels in excess of those permitted as set
forth in Section 18.04.040 of the Municipal Code.
7) The applicant shall adhere to all representations made in the application and in public
hearings. Failure to comply with the conditions of approval or representations made
shall be cause for the suspension of the temporary use permit.

A. Written description of the proposed temporary tent
Location:
On the deck located adjacent to the north-east of the Aspen Club building
40' x 40'
Size:
Height:
The tent is 7' high around its edges and slopes up towards the center,
whose peak is 17'. The peak is lower than the pool roof to the south of
the proposed tent and the tennis court roof 10 the west of the proposed
lent (see attached sketch).
Design:
The tent will have a white top and walls, with French windows; there will
be two doors acting as the entrance and the exit (see attached sketch).
Operating Characteristics: The tenl will have an eleclric internal lighting system and a
temperature control system powered by natural gas. It will be used to
house the club's cardiovascular equipment for member use.

Visual Impact:
The tent will be visible from club property as you enter the club, from the
east parcels of land (which are not developed) and from the south
parcels of land which are at a higher elevation than the club.
B. Compatibility of proposed temporary use
The proposed temporary use is in line with the current activities of the Club. which are health and
fitness related. The tent structure will appear to blend in with the existing building and is most likely,
nicer to look at than the existing building.

26,96.030 Criteria Applicable to all Temporary Uses
When considering a development application for a temporary use, City Council shall
consider, among other pertinent factors, the following criteria as they, or any of them,
relate thereto.
A. The location, size, design, operating characteristics, and visual impacts of the
proposed use.
Staff Finding:
The Aspen Club is proposing to erect the tent on the wooden deck on the
northeast side of the main building. The tent will be white in color,
approximately 1600 square feet with 7 foot high walls and a 17 foot pyramid
peale It will be visible from the east parcels (undeveloped), from south parcels at
a higher elevation, and from the entry to the club. The tent will not be visible
from Ute Avenue or from Highway 82. The tent will have small windows,
electric lighting, and a heating system and will be used for the Club's
cardiovascular equipment.

The Council should, as a condition of approval, limit the use of the tent to
exercise equipment, classes, and activities displaced by the renovations, not for an
expansion of commercial activities, a restaurant, or other additional services not
being displaced by the construction.
B. The compatibility of the proposed temporary use with tile character, density
and use of structures and uses in the immediate vicinity.
Staff Finding:
The proposed use is compatible with the character, density, and use of the
structure in the immediate vicinity.
C. The impacts of the proposed use on pedestrian and vehicular traffic and traffic
patterns, municipal services, noise levels, and neighborhood character.
Staff Finding:
The temporary use will have very little impact on the traffic patterns in the area
and virtually no impacts onmunicipal services. The music will be available
through headphones only and general noise is expected to be minimal and
diminished by the surrounding vegetation.

D. The duration of the proposed temporary use and whether a temporary use has
previously been approved for the structure, parcel, property or location as
proposed in the application.
Staff Finding:
The proposed temporary use will be from May 28, 1997, to November 15, 1997.
This is the first time the Aspen Club has requested such a permit.
E. The purposes and intent of the zone district in which the temporary use is
proposed.
Staff Finding:
The purpose of the Rural Residential (RR) Zone District is to allow low density,
long term residential purposes with the recreational, institutional, public and other
compatible uses customarily found in proximity to those uses allowed as
permitted use or conditional uses. A recreation club is a conditional use in this
zone district.
The applicant's proposed use is compatible with the existing uses on site and with
the intent of this District. The applicant is not proposing an expansion.

F. The relation of the temporary use to conditions and character changes which
may have occurred in the area and zone district in which the use is proposed.
Staff Finding:
Because any impacts of the proposed temporary use will be most noticed by
members of the club, Staff feels that any expressed discontent with the tent would
be best addressed by the Club's administration. Impacts off-site should be very
minimal.
G. How the proposed temporary use will enhance or diminish the general public
health, safety, or welfare.

After reviewing the above referenced application and making a site visit, I am reporting the
combined comments made by the members of the DRC:
1.
Prior Approvals and Use: This is an unique temporary use, creating a covered patio,
which will be used only for the duration of the other construction on.the property. There is
no history of this type of use nor. apparent problems anticipated with this proposed
temporary use.
2. Utilities and Public Services: There is negligible impact to utility services for
additional heating although all utilities will be provided from the existing facility service
lines. The depicted wood patio (to be constructed) will protect a new rubber membrane-
type roof (over the gymnasium). Since this is already an impervious surface, erecting a tent
over the same surface will not add a significant impact to the site drainage, especially for
the six (6) month period of requested use during the summer and fall.
3. Vehicle Parking: There is no anticipated increase in vehicle trips generated to the site
due to .the erection of the tent. The existing on-site parking should be sufficient to
accommodate the typical parking requirements of the Club's visitors.
4.
Fire Access and Emergency Egress: The Fire Marshall requires these conditions
be met for public safety and emergency response:
I) The temporary use will be limited to not more than 180 consecutive calendar days;
2) The applicant must provide an emergency exiting plan (diagram) for written
approval of the Fire Marshall prior to erecting the tent; and
3) The access to the site and through the building will not be blocked nor impeded by
the tent and associated interior remodeling.
