SERIES OF 1997
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO,
APPROVlNG EXPENDITURES TO BE FUNDED FROM THE PITKIN COUNTY 1/2 CENT
TRANSIT SALES TAX
WHEREAS, the Aspen City Council, the Pitkin County Board of County Commissioners
and the Town Council of Snowmass Village (the "Parties") have previously identified general
elements of their Comprehensive Valley Transportation Plan (the "Plan") which are eligible for
funding from the Pitkin County one-half cent transit sales and use tax; and
WHEREAS, by intergovernmental agreement dated September 14, 1993, the Parties
agreed:
a. to conduct regular public meetings to continue to refine and agree upon
proposed projects and transportation elements consistent with or complimentary to
the Plan; and
b. that all expenditures and projects to be funded from the County-wide one-
half cent transit sales and use tax shall be agreed upon by the Parties and
evidenced by a resolution adopted by the governing body of each party; and
WHEREAS, in November of 1993 Pitkin County voters authorized the issuance of up to
$13,650,000 of revenue bonds for the purpose of improving the public mass transportation
system in the Roaring Fork Valley (the "Revenue Bond Authorization") if such improvements
are authorized by agreement between the Parties; and
WHEREAS, at a public meeting held on July 18, 1996, the Parties considered and
approved several projects to be funded in 1996 from the Pitkin County one-half cent transit sales
tax; and
WHEREAS, on December 31, 1994, the Parties entered into an Intergovernmental
Agreement to create the Roaring Fork Railroad Holding Authority to purchase the Denver & F..io
Grande Western Railroad (Aspen Branch) right-of way; and
WHEREAS, following the creation of the Roaring Fork Railroad Holding Authority, the
Parties agreed to help fund the purchase of the right-of-way from the Pitkin County one-half cent
sales tax; and

WHEREAS, in the event that Garfield County does not approve the adoption of an
amendment to the Intergovernmental Agreement which would permit the Parties to purchase the

right-of-way and a new intergovernmental agreement is executed by the parties to create the
Roaring Fork Railway Holding Authority, the City Council desires to approve the expenditure
referenced herein to be used by the Roaring Fork Railway Holding Authority to purchase the
right-of-way.
WHEREAS, additional funds over and above those previously agreed to are necessary to
consummate the purchase of the right-of-way and by the adoption of this resolution Pitkin
County wishes to approve the expenditure of the requisite funds.
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Aspen,
Colorado, that the following expenditures are hereby approved from the Pitkin County one-half
cent transit sales tax for 1997:
