Co::::' (Series of 1997) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO, GRANTING A WAIVER OF PARK DEDICATION FEES AND LAND USE APPLICATION FEES FOR THE DEVELOPMENT OF AFFORDABLE HOUSING AT THE ASPEN CENTER FOR ENVIRONMENTAL STUDIES, 100 PUPPY SMITH STREET, CITY OF ASPEN, PITKIN COUNTY, COLORADO WHEREAS, pursuant to all applicable Sections of the Municipal Code, the Aspen Center for Environmental Studies, ACES, received approval, pursuant to Ordinance No.6, Series of 1997, for the construction of affordable housing units in which Park Dedication Fees in the amount of $6,359 are due prior to issuance of a Certificate of Occupancy. WHEREAS, ACES has requested a waiver of said fees in addition to the Land Use fees associated with processing the waiver request; and, WHEREAS, City Council may subsidize the construction of affordable housing projects by waiving Park Dedication Fees and may take such other actions not delegated to the Commission, the Historic Preservation Committee, the Board of Adjustment, or the Planning Director, as the City Council may deem desirable and necessary to implement the provisions of the Land Use Code; and, WHEREAS, the Planning Department and the Parks Department reviewed the waiver request and believe it to be an appropriate action for City Council to take; and, WHEREAS, the City Council found, in this instance, a waiver of the $6,359 Park Dedication Fee and land use application fees associated with the waiver request is appropriate considering deed restrictions on the housing units, the non-profit nature of ACES, the organization's purpose of demonstrating environmentally sensitive building techniques for affordable housing projects, and the extent of open lands on the campus available to the public. ------. Resolution No. _, Series of 1997 Page 2 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF ASPEN, COLORADO, THAT: Section 1: In accordance with Sections 26.08.010 and 26.44.060 of the Aspen Municipal Code, the City Council of the City of Aspen, Colorado, does hereby grant a waiver of the $6,359 Park Dedication Fee and associated land use application fees for a 100% affordable housing project located on the campus of the Aspen Center for Environmental Studies, 100 Puppy Smith Street, without conditions. As a part of this process we would like to request that the Park Dedication Fee be waived. We also request that any fees not waived by City Council be due at the time of Certificate of Occupancy issuance rather than at the time of Building Permit issuance. ,------ In addition, we request that City Council waive Land Use Fees.
