RESOLUTION OF THE ASPEN CITY COUNCIL GRANTING A SIX MONTH EXTENSION OF A TEMPORARY USE PERMIT FOR A TATTOO PARLOR TO BE LOCATED IN THE LOWER LEVEL OF 465 N. MILL STREET Resolution No. 97-~\ WHEREAS, pursuant to Section 26.96.030 of the Aspen Land Use Regulations temporary use permits may be approved by the Aspen City Council if the use if found to comply with the requirements of this Section; and WHEREAS, pursuant to Section 26.96.050 of the Aspen Land Use Regulations the City Council may authorize one six-month extension of an approved temporary use; and WHEREAS, the Community Development Department received an application from Dennis Green who is representing the applicants Ben Wallenbom and Paul Lambdin requesting such extension; and WHEREAS, a public hearing was conducted on November 10, 1997 ata regular meeting of the Aspen City Council at which the Council considered the applicant's request for a six month extension of the previously approved temporary use, retroactive to July 14, 1997, and approved it by a _- _ vote with conditions. ~ NOW, THEREFORE BE IT RESOLVED by the City Council: That the six month extension of the Temporary Use Permit for a Tattoo Parlor be approved, subject to the following conditions: 1. The hours of operation shall be limited to 7:00 am - 10:00 pm. 2. The temporary use extension is valid from July 14, 1997 to January 14, 1998. 3. The waste disposal plan previously approved by the Environmental Health Department shall remain in effect. 4. All material representations made by the applicant in the application and during public . meetings with City Council shall be adhered to and considered conditions of approval, unless otherwise amended by other conditions. 5. The applicant shall comply with the State of Colorado Rules and Regulations pertaining to Epidemic and Communicable Disease Control, specifically Regulation 10 Cleaning and Sterilization of Needles, Instruments, Probes, and devises used by Acupuncturists, Tattoo Artists, and Persons Performing Ear or Percutaneous Piercing.
