HomeMy WebLinkAboutresolution.council.037-93 ." ~,'" \YI ~ te' ~l, ''',\" ,. ., RESOLUTION NO. 37 (Series of 1993) A RESOLUTION APPROVING THE RENEWAL OF MALL LEASE AGREEMENTS BETWEEN THE CITY OF ASPEN, COLORADO, AND THE GRILL ON THE PARK, ASPEN MINE CO., THE RED ONION, CARNAVALE, PARAGON, FLYING DOG BREW PUB, AND AUTHORIZING THE MAYOR TO EXECUTE SAID AGREEMENTS ON BEHALF OF THE CITY OF ASPEN WHEREAS, there have been submitted to the City Council renewals for the lease agreements between the City of Aspen and The Grill on the Park, Aspen Mine Co., The Red Onion, Carnavale, Paragon, and Flying Dog Brew Pub, which leases set forth the terms and conditions for occupancy by said lessees of a portion of the mall area adjacent to their premises, a copy of which leases are annexed hereto and made a part hereof. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1 That the city Council of the City of Aspen hereby establishes a lease rate at $2.84 per square foot per year and approves the mall lease renewals between the City of Aspen and The Grill on the Park, Aspen Mine Co., The Red onion, carnavale, Paragon, and Flying Dog Brew Pub, copies of which are annexed hereto and incorporated herein, and does hereby authorize the Mayor to execute said leases on behalf of the City of Aspen. '~ ~, ., ..;, ~, i1t I MEMORANDUM TO: Mayor and city Council _.\ / Amy Margerum, City Manager~ Kathryn Koch, City Clerk THROUGH: FROM: DATE: May 19, 1993 RE: Resolution #37, Series of 1993 - Mall Leases SUMMARY: six mall businesses are requesting approval of their mall outdoor seating lease for 1993. These are Paragon, Aspen Mine company, The Grill, Carnevale, Flying Dog Brew Pub, and Red Onion. Staff and CCLC reviewed the leases at their regular meeting May 19, 1993 and recommended approval. BACKGROUND: The city first approved mall leases in 1977 at $1.00 per square foot per month or $12.00 per square foot per year. These leases are good from mid May through September. The original lease stipulated a 6 percent increase per year in the event of renewal. Renewal is required on an annual basis. The Red Onion, Mine Company, Grill and Paragon locations have had outdoor seating leases since 1977. Carnevalle and Flying Dog have had leases for about three years. The original leases were negotiated by the Mall Commission cmd Council. CCLC had a public hearing on these leases and heard adjacent property owners who had various concerns. CURRENT ISSUES: The adjacent property owners of Paragon and Aspen Mine Company requested the outdoor space be decreased. CCLC approved the lease for the Mine Company, same as last year. Paragon and neighbor will work out the issue if an an angled corner on west side. FINANCIAL IMPLICATIONS: Approval of all 6 mall leases at $2.84 a square foot/month will generate about $17,500 in the mall fund. RECOMMENDATION: Staff recommends approval of the mall leases as revised by the CCLC. PROPOSED MOTION: I move to approve Resolution #37, Series of 1993.
