HomeMy WebLinkAboutminutes.council.20170117Special Meeting Aspen City Council January 17, 2017 1 At 4:10 Mayor Skadron called to order the Special meeting with Councilmembers Frisch, Mullins and Myrin present. Jim True, city attorney, stated staff prepared Ordinance 2 to extend the moratorium. At the last regular Council meeting the community development Staff presented alternatives to adopt the ordinances during the moratorium. They discussed whether it might be necessary to extend the moratorium to pass the ordinance issues not relying on the emergency ordinance process. After looking at the procedures that Council needs to follow, I concluded it may be necessary for a special meeting for first reading then have a second meeting next week. This ordinance proposes an extension for 17 days. Currently as adopted 11 months ago it would terminate on February 28. This would be through March 17th. This is consistent with what Council was directing staff to do at the last meeting. Certain items may be passed next week and may not require the extension. Councilwoman Mullins said she is in support of ordinance 2. Councilman Myrin said his preference would be to do this through emergency but this accomplished the same in maybe a more orderly way, so it is fine. Councilman Frisch said there is more to accomplish next week in the number crunching area, parking, affordable housing and commercial space that may not have been there before. This extension gives us a few more meetings. Mr. True said this gives us two more meetings to get things done. This extends it so you could use all the way through the February 13th meeting. Councilman Frisch said he is fully supportive of it. Most people can understand the FAR and height. He is less sure of some of the mitigation levels. One of the ways we try to judge ourselves is how long some of the laws stay on the books for. Councilwoman Mullins said in defense of the extension, when we started we knew it would be complex but not how much so. Over the last nine months it’s been really great discussion and outreach and feedback from the community. The issues really need to be addressed. The extension will really help to solidify and address some of the issues that have come up. Thanks for your patience. Mayor Skadron said he will support it as well. Councilwoman Mullins moved to read Ordinance #2, Series of 2017; seconded by Councilman Myrin. All in favor, motion carried. ORDINANCE NO. 2 (SERIES OF 2017) AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO, EXTENDING THE TEMPORARY MORATORIUM ON THE ACCEPTANCE OF ANY NEW LAND USE APPLICATION SEEKING A DEVELOPMENT ORDER AND N THE ACCEPTANCE OF CERTAIN BUILDING PERMIT APPLICATIONS FOR PROPERTY LOCATED WITHIN THE COMERCIAL CORE (CC), COMMERCIAL (C01), SERVICE/COMMERCIAL/INDISTRIAL (S/C/I), NEIGHBORHOOD COMMERCIAL (NC), MIXED USE(MU) ZONE DISTRICTS OF THE CITY OF ASPEN. Councilman Frisch moved to adopt Ordinance #2, Series of 2017 on first reading; seconded by Councilwoman Mullins. Roll call vote. Councilmembers Frisch, yes; Myrin, yes; Mullins, yes; Mayor Skadron, yes. All in favor, motion carried.
