SUMMARY: The applicant is proposing the replacement of an existing 8" waterline that serves snowmaking equipment in the area proximate to the Tiehack chairlift. The existing pipeline has corroded to the point of failure. The project seeks to excavate the existing pipeline and replace with similar material. The length of the proposed excavation is approximately 1750 feet in length and 5 feet deep. The estimated area of the disturbance is .8 acres. All excavation material will remain on site and the disturbed area will be regraded and revegetated. In July of 2012, a notice of approval and development order were granted for the replacement ofthis same pipeline downhill ofthe pumping station. That pipeline crossed Tiehack Road and two separate parcels. That project's location also had stream margin implications. This current project (uphill of the pump station) does not have the same engineering complexities, nor does it require stream margin review. This project begins and ends on Lot 49. Referral comments were received from the Parks and Engineering Departments. Both departments support the project. Engineering stated that any concerns that they do have will be addressed through the landscaping and grading permit. STAFF EVALUATION: Because Planned Developments are based on detailed, site specific approvals, change to the plan requires an amendment. In this case, the nature of the project makes it appropriate for review as an Insubstantial Amendment. Staff finds that while the project is extensive, it meets the five criteria specified in Section 26.445.110[A]. Additionally, staff finds that the project is exempt from 8040 Greenline review. Exhibit A details these criteria and staff findings. An insubstantial amendment to an approved Project Review or an approved Detailed Review may be authorized by the Community Development Director. An insubstantial amendment shall meet the following criteria: 1. The request does not change the use or character of the development. Staff comment: Waterlines to serve snow making are consistent with the original PD. Any changes resulting from the replacement of the waterline will make minimal and superficial alterations to already memorialized and established uses within the development. Staff finds the criterion to be met. 2. The request is consistent with the conditions and representations in the project's original approval, or otherwise represents an insubstantial change. Staff comment: This project is both consistent with the project's original approval and represents only an insubstantial change. Staff finds the criterion to be met. 3. The request does not require granting a variation from the project's allowed use(s) and does not request an increase in the allowed height or floor area. Staff comment: Staff finds this criterion to be not applicable. 4. Any proposed changes to the approved dimensional requirements are limited to a technical nature, respond to a design parameter that could not have been foreseen during the Project Review approval. are within dimensional tolerances stated in the Project Review, or otherwise represents an insubstantial change. Staff Comment: Staff finds this criterion to be not applicable. Staff Review Criteria - 8040 Greenline Exemption 26.435.030. 8040 Greenline review. A. Applicability. The provisions of 8040 Greenline review shall apply to all development located at or above 8040 feet above mean sea level (the 8040 Greenline) in the City and all development within one hundred fifty (150) feet below, as measured horizontally, the 8040 Greenline, unless exempted pursuant to Subsection 26.435.030.B.. Development on land located in the R-15B Zone District is not subject to the 8040 Greenline review. B. Exemption. The Community Development Director may exempt the expansion, remodeling or reconstruction of an existing 8040 Greenline development ifthe following standards are met: 1. The development does not add more than ten percent (10%) to the floor area ofthe existing structure or increase the total amount of square footage of areas o f the structure which are exempt from floor area calculations by more than twenty-five percent (25%); and Staff Comment: Staff finds this criterion is not applicable. The project proposes a like for like replacement of an existing waterline. 2. The development does not require the removal of any tree for which a permit would be required pursuant to Section 15.04.450 or the applicant receives a permit pursuant to said Section; and Staff Comment: The waterline runs up an existing ski run. No trees are proposed for removal. Staff finds this criterion to be met. 3. The development is located such that it is not affected by any geologic hazard and will not result in increased erosion and sedimentation. Staff Comment: While the pipeline is being replaced on steep slopes, best practice mitigation efforts are being utilized to minimize soil disturbance, minimize run-off and erosion, and revegetate excavated areas. Staff finds this criterion to be met. 4. All exemptions are cumulative. Once a development reaches the totals specified in Subsection 26.435.030.B.1, an 8040 Greenline review must be obtained pursuant to Subsection 26.435.030.C. That approval memorialized all the previous County approvals, and included language allowing the ski lift use and other skiing and Nordic activities to continue in the PD. PROPOSAL: This proposal is for a, "replacement pipe which includes excavating a 5' deep trench, to install approximately 1,750' of new pipe from the Tiehack pump house adjacent to the eastern Tiehack parking lot, up Eagle Hill. The total scope of excavation includes approximately 650 cubic yards of material proposed to remain on site, and grading to the previously existing contours and revegetated within the guidelines of the ASC Revegetation Plan. The total area of disturbance will not be greater than 70.000 square feet, or approximately 1.6 acres." The scope of work requires an Insubstantial PD Amendment, which is an administrative review. The application appears not to require Stream Margin review. However, it is the responsibility of the applicant to demonstrate that the proposed development is or is not situated with in the Stream Margin area. The applicant has provided a basic map; the proposed work appears to be entirely on Lot 49. Again, it is the responsibility of the applicant to demonstrate the proposed development does or does not affect lot 14, a parking lot owned by Maroon Creek Club Master Association. The 'Background" segment of the Pre-App Summary states that 6'the original PUD for the Maroon Creek Club permitted ski lifts.
