REQUEST: Subdivision — Condominium Plat
DESCRIPTION: 332 W. Main is .a designated local landmark in the Main Street Historic District that contains an
office space in the historic structure and free market residential in the new rear addition. In 2007, HPC approved
demolition of the existing non -historic rear addition that contained a free market multi -family housing unit and a
carport and replacement with one larger two bedroom free market unit and one three bedroom free market unit
(Resolution #23, Series of 2007). Construction of the addition is nearing completion and the owner proposes
to condominiumize the two separate free-market residential units and the commercial unit.
Condominiumization is a form of subdivision and requires an administrative approval pursuant to the
requirements of Aspen Land Use Code Section 26.480.050 (A), Condominiumization. This is an
administrative process that will require the creation and filing of a plat with the Pitkin County Clerk and Recorder.

effect a change in use of the property, and shall not operate as an abatement of other applicable
regulations affecting the property. The Condominium Plat is in a style and format as prescribed in
Title 29 — Engineering Design Standards, Plats. The proposed subdivision should not require a
subdivision agreement between the applicant and the City because it involves no development and

The policy or policies to be issued will contain exceptions to the following unless the same are disposed of to
the satisfaction of the Company:
1. Rights or claims of parties in possession not shown by the public records.
2. Easements, or claims of easements, not shown by the public records.
3. Discrepancies, conflicts in boundary lines, shortage in area, encroachments, any facts which a correct
survey and inspection of the premises would disclose and which are not shown by the public records.
4. Any lien, or right to a lien, for services, labor, or material heretofore or hereafter furnished, imposed by law
and not shown by the public records.
5. Defects, liens, encumbrances, adverse claims or other matters, if any, created, first appearing in the public
records or attaching subsequent to the effective date hereof but prior to the date the proposed insured
acquires of record for value the estate or interest or mortgage thereon covered by this Commitment.
6. Taxes due and payable; and any tax, special assessment, charge or lien imposed for water or sewer
service or for any other special taxing district.
