i~N ORDINANCE OF THE ASPEN CITY COUNCIL GRANTING A TEMPORARY USE
PERMIT FOR FALL-LINE PRODUCTIONS FOR THE RED ERICK SCHOOL EUILDING,
100 EAST HALLANt LOTS A-I & K-St BLOCK 64 AND LOTS AuC & E-Gt BLOCK
71, CITY AND TOWNSITE OF ASPEN.
WHEREAS, pursuant to Section 24-7-1203 of the Municipal Code the
applicant, Fall-Line Productions has submitted an application for
a Temporary Use Permit to use the Red Brick School building for
offices, set construction, and filming during the production of a
feature film; and
WHEREASt the applicant requests to use the school from February 10,
1992 to June 15, 1992 with the operation hours of 8 am - 8 pm; and
WHEREASt the staff has reviewed the temporary use application and
recommends to the City Council approval of the temporary use from
February 10, 1992 to June 15, 1992 with conditions.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITYiOF
ASPEN, COLORADO:
Section 1
That it does hereby approve the temporary use by Fall-Line
Productions of the Red Brick School building, 100 East Hallam for
the following non-residential uses: set construction, filming and
storage from February 10, 1992 to June 15, 1992 with the following
conditions:
1. The duration of this temporary use shall be from February !0,
1992 to June 15, 1992, however the school will primarily be used
16 days during the life of this temporary use: six days of filming
and 10 days to set-up and break-down from the filming. Some
storage activity will occur at the site.
2. Hours of operation shall be limited to 9 am. to 7 pm. seven
days a week, except during the six days of filming when hoursiof
operation shall be from 8 am. to 12 am.
3. Windows of the school shall be blacked out during filming after
7 pm.
4. On-board truck generators may be allowed to operate at the
school but only during the six days of filming. Power to the
school for filming purposes will be supplied by a power drop from
nearby power sources°
5. All vehicles, including employee, production and catering
vehicles, shall be parked behind the Red Brick School according!to
the submitted parking plan, Exhibit A. No trucks shall be parked
along: Garmisch Street, Hallam Street, or the alley along the east
side of the building unless they are unloading materials into the
gym.
6. No heavy trucks including, semi-trailers, shall be permitted
at or around the site except for the six day period of filmingi in
the school and the day before or after filming. In any event
trucks shall not be parked on-site beyond the 16 days of use at the
school. Trucks shall not start their engines, arrive or depart
prior to 7 am. and after 7 pm. Trucks shall idle for no longer
than 5 minutes pursuant to Ordinance 4, Series of 1992. Uan
shuttle service will be employed during the 6 days of filming.
7. All Fall-Line Production related traffic shall travel the
designated route which is Main Street to Garmisch Street to the
school, Exhibit B.
8. Except as provided for in condition number 5 above, all
deliveries and access to the building shall be through the rear
entrance on the north side of the building.
9. The applicant shall submit a letter, to be reviewed and
approved by the City Council, that outlines the extent to which the
building will be insured and the amount of protection for any
damage to the building.
10. The applicant shall manage and conduct its activities as
allowed under this temporary use permit in such a manner so as to
not create or allow a public nuisance as defined at Section 13!-89
of the Municipal Code and or Section 16-13-304 (1) (a) of the
Colorado Revised Statutes, and applicant shall not create or alilow
noise levels in excess of those permitted levels as set forth at
Section 16-4 of the Municipal Code.
11. All representations that are made within the submitted
application and at the public hearing are incorporated herein and
shall be adhered to.
12. Failure to comply with the above conditions of approval or
representations made within the application and at the pubilic
hearing shall be cause for the suspension of the temporary ~se
permit.
Section 2:
If any section, subsection, sentence, clause, phrase or portion of
this ordinance is for any reason held invalid or unconstitutional
by any court of competent jurisdiction, such provision and such
holding shall not affect the validity of the remaining porti!ons
thereof.
Section 3:
This ordinance shall not effect any existing litigation and shall
not operate as an abatement of any action or proceeding now pending
under or by virtue of the ordinances repealed or amended as herein
provided, and the same shall be conducted and concluded under such
prior ordinances.
Section 4:
A public hearing on the Ordinance shall be held on the 10
day of February at 5:00 P.M. in the city Council Chambers, Aspen
City Hall, Aspen Colorado. Public notice of the same shall be
published once in a newspaper of general circulation within the
City of Aspen.
