ORDINANCE NO.40 (SERIES OF 1992) AN ORDINANCE OF THE CITY COUNCIL OF ASPEN, COLORADO, GRANTING SUBDIVISION APPROVAL CREATING TWO LOTS FROM LOT 1 OF THE ASPEN MEADOWS SUBDIVISION (NE 1/4 SECTION 12, TOWNSHIP 10 SOUTH, RANGE 85 WEST) WHEREAS, the Aspen Meadows Subdivision, including Lot 1, was approved by the adoption of Ordinance 14, Series 1991; and WHEREAS, the Final Plat of the Aspen Meadows Subdivision was recorded with the Pitkin County Clerk and Recorder on January 4, 1992; and WHEREAS, section 24-7-1006 B. of the Aspen Municipal Code provides for city Council approval for an amendment to a Subdivision provided that the proposed amendment is consistent with the approved plat; and WHEREAS, the Aspen Institute submitted an application for a Subdivision dividing Lot 1 into two parcels; and WHEREAS, the Planning Office recommends approval of the Subdivision of Lot 1 with conditions; and WHEREAS, the Aspen city council having considered the Planning Commission's recommendations for Subdivision approval does wishjto grant the Subdivision of Lot 1 of the Aspen Meadows Subdivision. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: section 1: That it does hereby grant Subdivision Approval for Lot 1 of the Aspen Meadows Subdivision in to Lot 1 and Lot 1A pursuant to 1 ~'''''"'';~;.i~~~;,,~,::i ~'-"" e. \. , ~ .... e, ~. '\\;'1 ~ ~- section 24-7-1006 B. of the Aspen Municipal Code. section 2: The conditions of approval of this Subdivision are: 1) The Amended Plat, Subdivision Agreement, and subdivision covenants shall contain language requiring the new Lot 1 and Lot 1A to be held in common ownership. 2) The use of the two Institute lots shall be as originally approved under the Aspen Meadows Final SPA Development Plan. 3) All material representations made by the applicant in the application and during public meetings with the city council shall be adhered to and considered conditions of approval, unless otherwise amended in the conditions. 4) The amended Subdivision Plat and Subdivision Agreement must be recorded with the pitkin County Clerk and Recorder within 180 days of approval by City Council. Failure to do so will render the approvals invalid. section 3: That the City Clerk be and hereby is directed, upon the adoption of this ordinance, to record a copy of this ordinance in the office of the Pitkin county Clerk and Recorder. section 4: A public hearing on the Ordinance shall be held on the ;?~ day of ~, 1992 at 5:00 P.M. in the City Council Chambers, Aspen 6ity Hall, Aspen Colorado, fifteen (15) days prior to which a hearing of public notice of the same shall be published in a 2 -"\':;;';;':;"::..,,..,1It'.Ji,~,- ,,',~:::lr';"'~ (,. ., .~, '\'" .' :1) . \~')\, newspaper of general circulation within the City of Aspen.
