Roger Haneman opened 'the special meeting of the Aspen Planning & Zoning at
12:30pm in Council Chambers. Commissioners present were Jack Johnson, Dylan
Johns, Steve Skadron and Roger Haneman. Jasmine Tygre, John Rowland and
Ruth Kruger were excused. Staff in attendance were David Hoefer, Assistant City
Attorney; Joyce Allgaier, Scott Woodford, Community Development; Kathy
Strickland Chief Deputy City Clerk.

CONTINUED PUBLIC HEARING:
OBERMEYER PUD AMENDMENT
Roger Haneman opened the continued public hearing from February 03, 2003
when the public notice was received. Chris Bendon introduced Dwayne Romero
from the Obermeyer redevelopment Company and Bob Schiller from CGY
Architects. Bend0n gave an overview of the project and the review process
including the council Ordinance 18, series 2003.
Bendon said the portions of buildings #1 and #3 and the elevator enclosure much
in the same vein as other changes that have occurred as the design progressed a
fuhction of knowing more about the building now than prior to advancing through
schematic design, design development and into construction drawings.
Public Comments were from Jim Smith at Concept 600, Gary Moore from
Oklahoma Flats and Dan Shipp regarding the height discrepancy.
MOTION: Dylan Johns moved to approve Resolution g6, 2004 amending the
heights of the buildings within the Obermeyer Place PUD with the following
conditions: Section 1: Permitted Building Heights: The permitted maximum height of buildings
within the Obermeyer Place Planned Unit Development are amended as follows: ,The height
limit for Building #1, also known as The Crescent Building, shall be no more than 36'4" (thirty-
six feet and four inches) along the eastern edge of the building. ,The height limit for Building
#3, also know as the Spring Street Building, shall be no more than 36'6" (thirty-six feet and six
inches) along the southwest portion of the building and no more than 36'4" (thirty-six feet and
four inches) along the north portion of the building. ,The elevator enclosure along the
southwest edge of Building #5 shall be permitted to exceed the height limit, as allowed in
Ordinance 18, Series 2003, except with no facade setback requirement. Note: An additional
potential two-inch adjustment above the applicant's request has been factored into the above
permitted heights. All locations of the height adjustments and building number references shall
be those locations and references depicted on the drawing set submitted to the Planning and
Zoning Commission for the February 4th meeting, incorporated herein by reference. Survev
adjustments to the actual grade shall not affect the absolute building height above mean sea

level. Section 2: PUD Plans Reference: This Resolution shall be referenced and the specific
locations and extent of the height adjustments shall be depicted on the Final PUD Plans.
Seconded by Dylan dohns. All in favor, APPROFED 4-0.
