A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO,
CALLING FOR AND ESTABLISHING A DATE FOR A SPECIAL MUNICIPAL ELECTION
TO BE CONDUCTED ON JUNE 30. 1998.
WHEREAS, Section 2.2 of the Home Rule Charter of the City of Aspen provides that any
special municipal election may be called by resolution or ordinance of the City Council at least
sixty (60) days in advance of such election; and
WHEREAS, the City Council desires to call and establish the date for a special election so
as m allow the electorate the opportunity to vote to authorize the City Council (a) to grant a
franchise to Holy Cross Electric Association pursuant to Section 11.4 of the Home Rule Charter.
and (b) the sale of a portion of City owned property commonly referred to as the Burlingame Ranch
pursuant to Section 13.4 of the Home Rule Charter; and
WHEREAS, the City Council may add such additional questions to the ballot as it may
hereafter deem appropriate,
NOW, THEREFORE, BE 1T RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ASPEN, COLORADO, THAT:
Section 1.
A special municipal election shall be and is hereby called and established for Tuesday, June
30, 1998, for the purpose of submitting to the electorate an ordinance granting .a franchise to the
Holy Cross Electric Association and a ballot question seeking authorization from the electorate to
sell a portion of City owned property commonly known as the Buflingame Ranch.
Section 2.
The city Clerk shall give wntten or printed notice of the special election called forth here~n
at least ten (10) days prior to said election and shall include in said notice the date of said election
and the hours during which the polls will be open, designating the polling place of each precinct.
stating the qualifications of persons to vote in the election and the question or questions to be voted
upon. A copy of such notice shall be published in at least one newspaper having general circulation
within the City of Aspen. If the Clerk finds it impractical to make the publication on the tenth day
before the election day, she shall make the same on the earliest possible day before the tenth day.
Publication in any weekly newspaper shall be in the next to last issue thereof before the day of the
election. A copy of such notice shall also be posted until after the election in a conspicuous place in
the office of the City Clerk·
