A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ASPEN,
COLORADO, APPROVING AN INTERGOVERNMENTAL AGREEMENT
BETWEEN THE CITY OF ASPEN AND THE BOARD OF COUNTY
COMMISSIONERS OF PITKIN COUNTY, AND THE TOWN OF BASALT,
COLORADO, REGARDING THE TOWN OF BASALT TO PARTICIPATE IN
THE ASPEN/PITKIN COUNTY HOUSING BOARD IN AN EX-OFFICIO
STATUS AND AUTHORIZING THE MAYOR TO EXECUTE SAID
AGREEMENT
WHEREAS, there has been submitted to the City Council an
intergovernmental agreement between the City of Aspen, Board of County
Commissioners of Pitkin County, and the Town of Basalt, Colorado, a copy of
which agreement is annexed hereto and made a part thereof.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF ASPEN, COLORADO:

Section 1
That the City Council of the City of Aspen hereby approves that
intergovernmental agreement between the City of Aspen and the Board of County
Commissioners, and Town of Basalt, Colorado, regarding the Town of Basalt
participating in the Aspen/Pitkin County Housing Board in an ex-officio status, a
copy of which is annexed hereto and incorporated herein, and does hereby
. authorize the Mayor of the City of Aspen to execute said intergovernmental
agreement on behalf of the City of Aspen.

Dear Dave:
We ha\(e revised the IGA establishing an ex-officio membership for Basalt on the
Board of the Housing Authority per the motion of the Board at last night's
meeting. Five original copies Of this revised IGA are enclosed.
As we discussed earlier today, I would appreciate it if you would arrange agenda
time with both Aspen and Pitkin County to obtain their official considerations of
the proposed IGA. This would include your sending copies in advance for any
processing and comment by staff and appearing as necessary to convey the
recommendation of your Board to the City and to the County. If the IGA is
approved, please obtain original signatures on four copies from Aspen and Pitkin
County. You can then send them to Basalt for our signature. After signature by
our Mayor, we will forward original signed copies to Aspen, to Pitkin County and
to the Housing Authority, keeping one copy. Thanks for your help with this.

INTERGOVERNMENTAL AGREEMENT BETWEEN AND AMONG
THE CITY OF ASPEN, THE BOARD OF COUNTY COMMISSIONERS .).~.
OF PITKIN COUNTY AND THE TOWN OF BASALT
PARTIES
THIS INTERGOVERNMENTAL AGREEMENT (the "Agreement") is made this
day of , 1998 by, between and among the CITY OF
ASPEN (hereinafter referred to as the "City", the BOARD OF COUNTY
COMMISSIONERS OF PITKIN COUNTY (hereinafter referred to as the
"County"), and the TOWN OF BASALT (hereinafter referred to as the "Town").
The City, County and Town are hereinafter collectively referred to as the
"Governments" .
AUTHORITY
This Agreement is entered into, inter alia, pursuant to Section 29-1-203, C.R.S.
and Article XIV, Section 18 of the Colorado Constitution.
RECITALS

WHEREAS, the City and County entered into an Intergovernmental Agreement
(the "Initial Agreement") on January 9,1984, establishing a multijurisdictional
housing authority under the provisions of C.R.S. 29-1-203 et sea. for the purpose
of providing a program and a system to assure the existence of a supply of
desirable and affordable housing for permanent residents, persons employed in
the City or the County, senior citizens, disabled persons and other population
segments residing in or needing to reside in the Roaring Fork Valley which are
necessary for a balanced community; and
WHEREAS, on November 14,1988 and November 15,1988, and on September
26, 1989 the City Council of the City and the Board of County Commissioners of
the County authorized amendments to the Initial Agreement; and
WHEREAS, the Board of Trustees of the Town of Basalt wishes to become more
knowledgeable and experienced regarding the programs, systems and benefits
of a multijurisdictional housing authority and the City and County agree that such
increase in knowledge and experience is in the public interest; and
WHEREAS, such knowledge and experience is gained through actual
participation in the deliberations of the Board of a multijurisdictional housing
authority; and

r. WHEREAS, the City, the County and the Town wish, by this Intergovernmental
Agreement, to provide for the inclusion of an official representative of the Town of
Basalt as an ex-officio, non-voting member of the Aspen/Pitkin County Housing
Authority Board of Directors.
AGREEMENT
NOW, THEREFORE, for and in consideration of the mutual covenants and
agreements of the Governments and other good and valuable consideration, the
adequacy and sufficiency of which is hereby acknowledged, the Governments
agree as follows:
1. The Town of Basalt shall appoint a representative to serve on the
Aspen/Pitkin County Housing Authority Board of Directors (hereinafter
referred to as the "Board").
2. The Basalt representative shall be an ex-officio member of the Board,
shall participate fully in the discussions and deliberations of the Board but
shall have no vote.
3.
If, at some point in the future, the Governments wish to consider
expanding the Aspen/Pitkin County Housing Authority to include the Town,
such expansion shall be the subject of a separate Intergovernmental
Agreement among the Governments.

4. This Intergovernmental Agreement may be modified by written
amendment approved by both the City Council, the Board of County
Commissioners and the Board of Trustees of the Town, acting separately.
5. The term of this Intergovernmental Agreement shall be January 1, 1998,
through December 31, 1998, and shall automatically be renewed for
successive one-year periods thereafter. Any of the Governments may
terminate this Intergovernmental Agreement for any reason upon ninety
(90) days' written notice.
6. Any formal notice, demand or request provided for in this
Intergovernmental Agreement shall be in writing and shall be deemed
properly given if deposited in the United States Mail, postage prepaid to:
