Main Street Aspen, CO 81611 SUBJECT & SITE OF APPROVAL: The applicant is requesting a Residential Design Standard Variance related to the requirement for Secondary Mass at 100 & 108 E. Francis Street. (Legal description attached as Exhibit A) SUMMARY: The Applicant has requested a Residential Design Standard (RDS) variance to remove the secondary mass, currently identified as the tea house, at 108 E. Francis Street. The subject parcel is within the R-6 zone district and is subject to the Hallam Lake Bluff review. The property is working on a valid building permit from 2011 and has been reviewed under the old RDS code. Therefore, the parcel is subject to Section 26.410.040.B.1; which states that all new single family and duplex structures shall locate at least ten (10%) percent of their total square footage above grade in a mass which is completely detached from the principal building, or linked to it by a subordinate connecting element. There is a request to remove the proposed tea house without replacement of a secondary mass elsewhere because of site specific constraints. REVIEW PROCEDURE: RDS Variance, per Section 26.410.020.D of the Land Use Code. The Community Development Director may approve, approve with conditions, or deny an administrative request for an RDS variance based on the review criteria found in Exhibit B; attached. BACKGROUND: In November, 2012 the applicant received administrative approval for two variances from Subsection 26.410.040.D.3.a, allowing designated windows to span the 9'-12' zone. One variance from this standard was approved for the primary residence (100 E. Francis) to allow a single window on a one-story element facing E. Francis St. One Variance from this standard was also applied to the secondary residence (108 E. Francis) for a single window on a one-story element facing E. Francis St. This approval is recorded at Reception No. 594345. In 2014 the applicant received an approval for an amendment to the 2012 approval to allow additional windows on each residence to span between the 9'-12' "no window zone." This approval is recorded at reception number 610833. CURRENT PROPOSAL: The Applicant has proposed removing the approved secondary mass (See Figure 1)., at the secondary residence (108 E. With the purpose of this standard in mind, Staff has reviewed the request against the old (2007) RDS variance review criteria that apply to the property as part of their active building permit. The Code states that the request for an RDS variance must meet one of the following criteria. 1) Provide an appropriate design or pattern of development considering the context in which the development is proposed and the purpose of the particular standard. In evaluating the context as it is used in the criteria, the director may consider the relationship of the proposed development with adjacent structures, the immediate neighborhood setting, or broader vicinity as the director feels is necessary to determine if the exception is warranted; or 2) Be clearly necessary for reasons of fairness related to unusual site-specific constraints. Staff supports the variance request for removal of the secondary mass at 108 E. Francis St., and find this request meets the criterion for Residential Design Variance, as per Section 410.020 (D)(2) of the Land Use Code. The subject site contains some unique, site-specific constraints. The previously approved secondary mass at the secondary residence (108 E. Francis) prevents access to a necessary utility corridor. Placement of the utility corridor is restricted to its approved location due to requirements to retain important trees on site, as required by the City of Aspen Parks Department. There is no alternative location for a secondary structure on site due to these same site-specific constraints as well as restrictions brought upon by the Hallam Lake Bluff review. Given the challenges of utility access associated with the protected vegetation on site, Staff finds the request to meet the second criterion for a Residential Design Standard variance. No other aspects of the site plan are approved. DECISION: The Community Development Director finds the request for Administrative Approval for a Residential Design Standard Variance, as noted above, to be consistent with the review criteria and thereby, APPROVES the request. Administrative Variances. The applicant may seek an administrative variance for not more than three (3) of the individual requirements. An applicant who desires a variance from the residential design standards shall demonstrate, and the Community Development Director shall find that the variances, if granted, would: a) Provide an appropriate design or pattern of development considering the context in which the development is proposed and the purpose of the particular standard. In evaluating the context as it is used in the criteria, the director may consider the relationship ofthe proposed development with adjacent structures, the immediate neighborhood setting or a broader vicinity as the director feels is necessary to determine if the exception is warranted; or Staff Response: Removing the secondary mass of the building is not a condition found to be consistent with adjacent structures or neighborhood context. Staff finds this criterion to not be met. b) Be clearly necessary for reasons of fairness related to any unusual site-specific constraints. Staff Response: The subject site has some unique, site-spectfic constraints. There are several protected trees scattered across the property, compromising alternative placement of the utility corridor. Inclusion of the approved secondary mass at 108 E. Francis would compromise access to the required utility corridor. Similarly, the protected vegetation inhibits an alternative of the secondary mass to another location on the property.
