Parcel ID No. 2735-182-501-01 APPLICANT: Aspen Skiing Company, represented by Gen Van Moorsel, Project Manger SUBJECT & SITE OF APPROVAL: The applicant is requesting administrative approvals for an Exemption from Mountain View Plane Review and Exceptions to Calculations and Measurements (Height Limitations and Code Compliance) for the replacement and upgrade of existing, rooftop mechanical equipment at 675 Durant Avenue, commonly known as The Little Nell Hotel. SUMMARY: The Little Nell Hotel is entirely or partially within the view plane review areas of six of the City's seven identified view planes (Wheeler Opera House, Wagner Park, Main Street, Cooper Avenue, and Courthouse 1 and 2). Based on the evaluation of City of Aspen GIS data, portions of the Little Nell roof line structure infringe on the Wheeler Opera LIouse view plane. The Mountain View Plane Exemption allows the exemption from review of additional mechanical equipment that protrudes into a view plane, if it has insignificant effect upon the designated view plane. The Exception to Calculations and Measurements for Height Limitations allows for the placement of mechanical equipment on a rooftop as long as the equipment is less than six (6) feet in height from the point of attachment. The Exception for Building Code Compliance allows for exception to dimensional requirements to achieve compliance. There are two distinct components of the work proposed by the applicant - although all work is contained on the rooftop of the Little Nell Hotel (and attached Ajax Tavern) and is subject to the need for the Exemption and Exception approvals. First, the application requests approval for the replacement of three (3) existing make-up air units (MUAs), also labeled in the application as roof top units (RTUs). These are dispersed in separate locations on the flat portions ofthe roof surface (see Exhibit Al. Vos Caudill, Pitkin County, CO units are approximately five feet, four inches (5'43 in height from the point of attachment to the roof surface (this includes a base structure) and are each located approximately 25 feet from the closest building fagade. The existing units are being replaced by new units that have identical exterior dimensions. The units will remain in their existing locations. This aspect of the application requires Mountain View Plane Exemption and Exception to Calculations and Measurements (Height Limitations) approvals. Second, in response to a notice of violation (Section 13.08.100) from the City of Aspen' s Environmental Health Department, the applicant is proposing significant upgrades to the kitchen exhaust equipment for the Aj ax Tavern. The proposed changes to the rooftop components of the exhaust system involve the removal of existing equipment and the reconfiguration and installation of new features. The overall height of the features on the roo f is being reduced, but the reconfiguration does involve the addition o f a new section of horizontal ductwork that links the existing mechanical towers. It is important to note that the existing rooftop features and related structures for maintenance access are visually prominent as they sit near the top of a sharply pitched roof structure. (See Exhibit B). This aspect of the application requires Mountain View Plane Exemption and Exception to Calculations and Measurements (Code Compliance) approvals. STAFF EVALUATION: First, in response to the proposed replacement of the three (3) like for like MUAs, staff finds that the replacement units are Exempt from Mountain View Plane review. The new equipment will create no new impacts to view planes and as is the case with the identical existing equipment, will have an insignificant effect on the designated view plane - in this case the Wheeler Opera House view plane. These units are lower in height than other adjacent mechanical equipment on the Little Nell roof. Additionally, as the equipment is less than six (6) feet in height from its attachment to the rooftop and sits more than 15 feet from all street-facing building facades. the three replacement units also qualify for an Exception to Height Limitation. Secondly, in regards to the kitchen exhaust equipment on the roof of the Ajax Tavern, it is important to note that the proposed change to existing roof top equipment is necessary to bring the malfunctioning and out of date system into compliance with City of Aspen Environmental Health Code. In regards to the Mountain View Plane Exemption, staff finds that the proposed reconfiguration will have an insignificant effect on the designated view plane. While a prominent feature on the pitched roof, the equipment is being reduced in height by this change and remains within the footprint for the existing facilities. The proposed changes (and much of the existing equipment), however, exceed the dimensions allowed for Exceptions to Height Limitations used above for the MUAs. Staff finds that improvements do qualify as an Exception for Code Compliance. The improvements are necessary to bring the system in compliance with current code, has minimal visual impact, and due to the nature of the existing equipment. requirements of the new equipment, and building configuration; no other reasonable solution exists. 2 DECISION: Staff finds the application for the replacement and reconfiguration of existing roof top mechanical equipment at 675 E. Durant Avenue meets the requirements for an Exemption to Mountain View Plane Review and Exceptions to Calculations and Measurements and hereby APPROVES the applicant's request as related to standards 26.435.050, Mountain View Plane Review; 26.575.020.F.4.d, Allowed Exceptions to Height Limitations - Mechanical Equipment; and 26.575.020.K, Exceptions for Building Code Compliance. Exemption. The Community Development Director may exempt the addition of mechanical equipment to an existing development which protrudes into the view plane only if such development has an insignificant effect upon the designated view plane. The addition of a satellite dish, elevator shaft or any other piece of equipment whose height and mass have a significant effect upon the designated view plane shall be reviewed pursuant to the standards of Subsection 26.435.050.C. Staff Response According to evaluation of City of Aspen GIS data, portions of the Little Nell Hotel's roof structure infringe on the Wheeler Opera House view plane. The proposed replacement and reconfiguration of the roof top mechanical equipment (three roof top air units and the kitchen exhaust upgrades for the Ajax Tavern) are either replacing like for like equipment (the roof top air units) or are reducing the height (Ajax equipment) of existing equipment. Based on the context of the existing equipment; staff finds that the proposed changes will have an insignificant effect upon the Wheeler Opera LIouse view plane. 26.575.020.F.4.d Mechanical Equipment. Heating, ventilation, and air conditioning systems, and similar mechanical equipment or utility apparatus located on top of a building may extend up to six (6) feet above height of the building at the point the equipment is attached. This allowance is inclusive ofany pad the equipment is placed on, as well as any screening. Mechanical equipment shall be screened, combined, and co-located to the greatest extent practicable. On structures other than a single-family or duplex residential building or an accessory building, all mechanical equipment shall be set back from any Street facing fa~a(le of the building a minimum of fifteen (15) feet. Staff Response The three replacement roof top air units are retaining their existing locations on the roof plan. These units are being attached to existing bases. The new units are identical in dimension to the existing units. The total height of the three units to the point of attachment is approximately 64 inches (5'4"). The units are all located at least 25' from a street facing fagade. Staff finds that the mechanical equipment is Exempt from Height Limitation. 26.575.020.K Exceptions for Building Code Compliance. The Community Development Director may approve exceptions to the dimensional restrictions of this Section to accommodate improvements required to achieve compliance with building, fire, or accessibility codes in or on existing buildings when no other practical solution exists. The Community Development Director must first determine that the visual impact ofthe exemption is minimal and that no other reasonable way to implement code compliance exists. The Director may require notice be provided to adjacent landowners. Approval shall be ill the form of a recordable administrative decision. Staff Response The proposed reconfiguration of the rooftop equipment for the Ajax Tavern kitchen exhaust system is in response to a notice of violation from the City of Aspen's Environmental Health Department. Jannette Witcomb of the Environmental Health Department issued the violation and approved the mechanical upgrades in bringing the system to compliance. The existing rooftop equipment is significantly non-conforming, and even with the reduction of height proposed by the reconfiguration, the new equipment cannot qualify for the mechanical equipment Exception as describe above. Because the new equipment is in direct response to a requirement in City of Aspen's Municipal Code, staff finds that the new equipment is Exempt from the dimensional requirements established by the Calculations and Measurements code language. The existing HVAC equipment is supported by an existing frame structure and catwalk over a sloped gable roof structure, which from the base of the support structure, is well above the six foot exception for height of mechanical equipment (26.575.020. F 4)resulting in an existing non-conforming condition. Background information Last fall, the Ajax Tavern kitchen exhaust system was tested by the City Environmental Health Department. Unfortunately the existing system was found to be in non-compliance with the Municipal Code standards for PM10 emissions (18.08.100). Consequently, a compliance plan was submitted and approved by the Environmental Health Department in February of this year. Please refer to the attached Environmental Health violation notice (dated 12-6-16) and Compliance Plan (dated 02-07-17) submitted by The Little Nell hotel. In addition to new kitchen exhaust hoods with grease extractor filters, the approved compliance plan proposes to utilize a state of the art packaged roof top pollution control unit with an in-line, high efficiency fan. This new unit will replace the existing percipitator unit in the same location. The precipitator is located on the courtyard side of the building roof line and cannot be seen from any public street or view plane. The replacement unit is also much lower than the existing grease duct chimneys and fan housing, even though it sits about 11" higher than the existing unit. Furthermore, the existing roof top hood fan and bell housing will be removed and capped, thus lowering the overall height of the equipment system by approximately 36". On September 8, 2016, Jannette Whitcomb with the Aspen Environmental Health and Sustainability Department visited your food service establishment and performed a compliance inspection in regards to the City of Aspen's Restaurant Grill Ordinance 13.08.100. This inspection was to determine ifthe required control device was being properly maintained and in use for the Aja Tavern's charbroiler. During the inspection, she observed that the control device (Molitron) was not functioning properly and you indicated that it had been malfunctioning and producing smoke for quite a while.
