A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO,
GRANTING TEMPORARY APPROVAL TO THE ASPEN SKIIING COMPANY TO PLACE
THREE INFORMATIONAL KIOSK ON CITY OF ASPEN PROPERTY
WHEREAS, a request was received by the Community Development Department from the
Aspen Skiing Company to allow informational kiosks, advertising Aspen Skiing Company and other
local events, to be located on the mall at Mill Street and Hyman Avenue and Galena Street and
Cooper Avenue as well as Rubey Park; and
WHEREAS, the Aspen City Council may approve signs on public right-of-way per Section
26.510.110 which states:
It shall be unlawful to erect or maintain any sign in, on, over or above any land
or right-of-way or on any property, including lightposts, belonging to the City of Aspen
without the permission of the City Council. However, this section shall not be deemed to
apply to signs posted by any duly constituted public authorities in the performance of
their public duties, or to specific circumstances otherwise provided for in this Chapter.
WHEREAS, during a public meeting on December 8, 2003, the City Council granted
approval for the kiosk with conditions; and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ASPEN, COLORADO, THAT:
SECTION 1:
The Aspen City Council does hereby approve of the request for Aspen Skiing Company to
place informational kiosks located at 1) Mill Street and Hyman Avenue, 2) Galena Street and Cooper
Avenue and 3) Rubey Park with the following conditions:
1. The kiosk locations shall be as agreed upon and represented in the attached
photographs.
2. The kiosk at the Mill Street/Hyman Avenue intersection will need to be moved to
another nearby location, as determined necessary by Parks Department staff and the
Aspen Skiing Company, during Winterskol to accommodate the snow sculptures.
3. The applicant must attain an encroachment license from the Engineering Department.
4. The kiosk installations are approved for one year from the date of approval and upon
the request of the application will be re-evaluated in December 2004 by the City of
Aspen.

RE: Informational Kiosks —Aspen Skiing Company
SUMMARY:
The Aspen Skiing Company represented by Justin Erickson of the Aspen Skiing
Company and Nancy Scheinkman of Telos Productions are requesting permission to
place three informational kiosks at locations in town. The applicant has included a.
photograph of kiosks similar to their proposed kiosks as part of Exhibit A, the
application. The applicant is proposing that three sides of each kiosk be used to
advertise Aspen Skiing Company events and that one side be managed by the City of
Aspen to advertise other events going on in town. The panels are replaceable and can
be updated, although with some fabrication and installation costs.
The code states:
26.510.110 Signs on public right-of-way
It shall be unlawful to erect or maintain any sign in, on, over or above any land
or right-of-way or on any property, including lightposts, belonging to the City of
Aspen without the permission of the City Council. However, this section shall
not be deemed to apply to signs posted by any duly constituted public authorities
in the performance of their public duties, or to specific circumstances otherwise
provided for in this Chapter.
The Community Development and Parks Departments have worked with the
applicant to place the kiosks in locations which will not interfere with snow removal.
The proposed locations are: 1) near the fountain on Mill and Hyman, 2) on the mall at
the corner of Galena and Cooper and 3) at Rubey Park near the Highlands bus stop.
Staff has included photographs of the exact proposed locations as Exhibit B. The kiosk
at Mill and Hyman will need to be moved during Winterskol to accommodate the snow
sculptures at that location.

PROCEDURE:
City Council may grant permission to place signs on public right-of-way as
outlined in Section 26.510.110.
RECOMMENDATION:
Staff recommends approval of the proposed request finding that said request is
consistent with recommendations made by our retail consultants. Staff feels the
proposed kiosks are a step in the right direction in terms of way -finding and providing
information to visitors. At the same time, as this is something new for the City, staff
believes the kiosk should be approved for one (1) year as a trial basis recognizing that a
more integrated proposed may be forthcoming when the retail consultants
recommendations are implemented.
RECOMMENDED MOTION:
"I move to approve Resolution #LIJ 2003 granting approval for Aspen Skiing
Company to place informational kiosks located at 1) Mill Street and Hyman Avenue, 2)
Galena Street and Cooper Avenue and 3) Rubey Park with the following conditions:
1. The kiosk locations shall be as agreed upon and represented in the
attached photographs.
2. The kiosk at the Mill Street/Hyman Avenue intersection will need to be

Proposal
Aspen Skiing Company is requesting permission from the City of Aspen to place informational
kiosks at strategic points throughout the downtown core in order to educate the public about our
winter event schedule and ski areas. Historically, we have promoted our events/mountains
locally through Channel 16, poster distribution and print/radio advertising. While these are
successful vehicles to get the word out about what is happening, it is troubling that many visitors
and residents are still not aware of the great events we are hosting. Guests who are in Aspen to
relax and play may not pick up a paper or turn on a radio/television during their visit, but all of
our visitors take time to stroll through town to shop, dine and experience Aspen's unique
ambiance. Kiosks are used successfully in many other resorts such as Whistler because they are
unobtrusive and easy to maintain. It is vital to the economic prosperity of our community and
ASC events that we reach our full audience potential, so we hope you will consider placing
kiosks in the city of Aspen.
Kiosk Description
• Four sided
• Width of each side is approximately = 36 in.
• Height is approximately = 80 in.
• Permanent structure for all seasons
• Interchangeable signs using static decals
• No corporate names or logos (besides A/S logo and event sponsor's name and logo)
will be included on the Kiosks

CITY OF ASPEN (hereinafter CITY) and

2. APPLICANT understands and agrees that City of Aspen Ordinance No. 57 (Series of 2000)
establishes a fee structure for Land Use applications and the payment of all processing fees is a condition precedent
to a determination of application completeness.
3. APPLICANT and CITY agree that because of the size, nature or scope of the proposed project, it
is not possible at this time to ascertain the full extent of the costs involved in processing the application.
APPLICANT and CITY further agree that it is in the interest of the parties that APPLICANT make payment of an
initial deposit and to thereafter permit additional costs to be billed to APPLICANT on a monthly basis.
APPLICANT agrees additional costs may accrue following their hearings and/or approvals. APPLICANT agrees he
will be benefited by retaining greater cash liquidity and will make additional payments upon notification by the
CITY when they are necessary as costs are incurred. CITY agrees it will be benefited through the greater certainty
of recovering its full costs to process APPLICANT'S application.
4. CITY and APPLICANT further agree that it is impracticable for CITY staff to complete
processing or present sufficient information to the Planning Commission and/or City Council to enable the Planning
Commission and/or City Council to make legally required findings for project consideration, unless current billings
are paid in full prior to decision.
5. Therefore, APPLICANT agrees that in consideration of the CITY's waiver of its right to collect
full fees prior to a determination of application completeness, APPLICANT shall pay an initial deposit in the
amount of $ W, 00 which is for hours of Community Development staff time, and if actual
recorded costs exceed the initial deposit, APPLICANT shall pay additional monthly billings to CITY to reimburse
the CITY for the processing of the application mentioned above, including post approval review at a rate of $205.00
per planner hour over the initial deposit. Such periodic payments shall be made within 30 days of the billing date.
APPLICANT further agrees that failure to pay such accrued costs shall be grounds for suspension of processing, and
in no case will building permits be issued until all costs associated with case processing have been paid.

• Interchangeable signs using static decals
• Aspen/Snowmass Logo to be included
• The only time the name/logo of a corporate partner is displayed on the kiosk is when that partner's
name/logo is incorporated into the title of the event (e.g. Bud Light Spring Jam). Partner's name
to be in direct size/proportion to event name, the guidelines used will be similar to the guides used
for the Main Street Banner.
