AN ORDINANCE AMENDING SECTION 2i-79(b) OF THE MUNICIPAL CODE OF
THE CITY OF ASPEN TO PROVIDE FOR AN INCREASE OF THE ANNUAL
FOOD TAX REFUND FROM $21.00 TO $39-00
WHEREAS, the City Council desires to amend Section 21-79(b)
of the Aspen Municipal Code to provide for an increase In the
annual food tax refund,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
That Section 21-79(b) of the Aspen Municipal Code is hereby
repealed and reenacted to read as foilows~
(b) Any resident, as herein defined~ may, not later than
April 15, 1981, and not later than each April 15 of
every year thereafter and so long as this Code shall be
in force, apply, on such forms as provided by the direc-
tor of finance, for an annual food tax refund from the
city in the amount of thirty-nine dollars ($39.00) for
himself, and, in addition, for every person who is a
member of his household, and for whom he is entitled to
claim a personal exemption under and pursuant to the
federal income tax laws. Any resident who is over the
age of sixty-five (65) years shall be entitled to
receive an additional food tax refund in the amount of
thirty-nine dollars ($39.00) , and any resident who is
blind shall be entitled to receive an additional food
tax refund in the amount of thirty-nine dollars
($39.00).
For the purposes of Section 21-79(b) only, the costs of
the annual food tax refund paid by the City shall be
charged one-third to the Land and Open Space Fund (6th
Penny Sales Tax) and two-thirds to the Transportation
Fund (7th Penny Sales Tax), conforming to the ratios
provided for in Ord. 16-1970, Sec. 9 and Ord. No.
15A-1972, Sec. 9.
Section 2
If any subsection, sentence, clause, phrase or portion of
this ordinance is for any reason held invalid or unconstitutional
by any court of competent jurisdiction, such portion shall be
deemed a separate, distinct and independent provision and such
holding shall not affect the validity of the remaining portions
thereof ·
