ORDINANCE NO. 19

AN ORDINANCE REPEALING AND RE-ENACTING SECTION 24-10.4
OF THE ASPEN MUNICIPAL CODE SO AS TO ALLOW SKI AREA
DORMITORIES AS A PERMITTED USE IN THE RESIDENTIAL BONUS
OVERLAY DISTRICT WHEN THE DISTRICT IS SUPERIMPOSED OVER
A SITE WITHIN THE R-6 ZONE DISTRICT, PROVIDING THE SKI AREA
DORMITORY IS DEED RESTRICTED IN COMPLIANCE WITH RENTAL PRICE
GUIDELINES AND LOCATED ON THE PREMISES OF THE SKI AREA TO BE
SERVED; AND AMENDING SECTION 24-10.5(6)(1) TO PROVIDE FOR THE
DETERMINATION OF PERMITTED DENSITY FOR A DORMITORY USE
WHEREAS, the City Council desires to repeal and re-enact
Section 24-10.4 of the Aspen Municipal Code so as to allow ski
area dormitories as a permitted use in the Residential Bonus Over-
lay District when the district is superimposed over a site within
the R-6 zone, providing the ski area dormitory is deed restricted
in compliance with the rental price guidelines established by the
City of Aspen for restricted employee housing and located on the
prentises of the ski area which it serves, and
WHEREAS, the City Council desires to amend Section 24-10.5
(b)(1) in order to determine the permitted density for a dormitory
use,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
That Section 24-10.4 of the Aspen Municipal Code is hereby
repealed and re-enacted to read as follows:
(a) The following uses are permitted in the Residential
Bonus Overlay District when the district is superimposed
over a site within the R-6 zone district:
(1) Single-family dwelling,
(2) Duplex,
(3) Multi-family,
(4) Townhouses, and

Ski area dormitory which is located on or contigu-
ous to the base area premises of the ski area to be
served and under the same ownershiP,
provided that in the case of single-family, duplex, multi-
family and townhouse use one-half or more of the dwelling
units constructed on the site are deed restricted within the
terms of Section 24-11.4(b)(3), and in the case of ski area
dormitory use all of the dormitory units are deed restricted
to comply with rental price guidelines established by the
City of Aspen for restricted employee housing.
(b) The following uses are permitted in the Residential
Bonus Overlay District when the district is superimposed
over a site within the R-15, R-15A, R-30 and R-40 zone
districts;
(i) Single-family dwelling,
(2) Duplex,
(3) Multi-family, and
(4) Townhouses,
provided that one-half or more of the dwelling units con-
structed on the site are deed reStricted within the terms of
Section 24-11.4(b)(3).
(c)
The following uses are permitted in the Residential
Bonus Overlay District when the district is superimposed
over a site within the RMF, CC, SCI, NC, C-l, L-l, L-2,
CL, Public or O zone districtS:
(i) Single-family dwelling,
(2) Duplex,
(3) Multi-family,
(4) Townhous es, and
(5) Dormitory,
provided that one-half or more of the dwelling units con-
structed on the site are deed restricted within the terms of
Section 24-11.4(b) (3) .
Section 2
That Section 24-10.5(b)(1) is hereby amended by the addition
of the following language:

Section 3
If any section, subsection, c~ause, phrase or portion of this
ordinance is for any reason held invalid or unconstitutional by
any court of competent jurisdiction, such portion shall be deemed
a separate~ distinct and i~dependent provision and such holding
shall not affect the validity of the remaining portions thereof.

A public hearing on the ordinance shall be held on the

prior to which hearing notice of the same shall be published once
in a newspaper of general circulation within the City of Aspen.
