IMPOSING PENALTIES FOR VIOLATION OF THE MUNICIPAL CODE, SECTION
26.415- HISTORIC PRESERVATION, RELATED TO THE PROPERTY LOCATED AT
232 E. BLEEKER STREET, LOTS R AND S, BLOCK 72, CITY AND TOWNSITE OF
ASPEN,COLORADO

WHEREAS, 232 Bleeker LLC, represented by Kim Raymond Architects and Kaegebein Fine
Homes, received land use approvals and a building permit to undertake a historic preservation
project on the property located at 232 E. Bleeker Street, Lots R and S, Block 72, City and Townsite
of Aspen, Colorado; and
WHEREAS, the approvals are represented by HPC Resolution 43, Series of 2015, HPC
Resolution 97, Series of 2015, and Building Permit#0102.2015.ARBK; and
WHEREAS, a site visit by the City of Aspen Historic Preservation Officer on March 15, 2017 led
to the issuance of a Stop Work Order by the City of Aspen Chief Building Official on March 16,
2017, and the allegation that violations of the land use approvals granted by HPC, the permit
granted by the Building Department, and the obligations of the Historic Preservation Specialty
license issued to contractors working on designated properties had occurred; and
WHEREAS, Section 26.415..140 of the Municipal Code establishes penalties which may be
imposed by the Aspen Historic Preservation Commission in response to violations of the historic
preservation ordinance; and
WHEREAS, the Community Development Department scheduled a duly noticed public hearing
before the HPC for May 24, 2017, and provided HPC with a summary of actions leading to the .
issuance of the Stop Work Order, an analysis of the penalties that HPC can assess and the possible
outcomes of those penalties; and
WHEREAS, HPC conducted a site visit and a public hearing on May 24, 2017, and after taking
into consideration the staff memo, information provided by the property owner and
representatives, and public comments, HPC has made a determination, by a 7 to 0 vote, that 232
Bleeker LLC is in violation of its land use approvals and Section 26.415 of.the Municipal Code
pertaining to historic preservation and that the imposition of penalties is warranted.
NOW, THEREFORE, BE IT RESOLVED:
That HPC hereby takes the following action related to 232 E. Sleeker Street, Lots R and S, Block
72, City and Townsite of Aspen, Colorado:
1. HPC Resolution #3, Series of 2015, required the applicant to provide a $30,000 financial
security_to_b_e_held by the Citv to euarantee the safe relocation of the historic structure. This
