Music Festival are requesting a Temporary Use Permit to install a trailer in the rear ,
parking lot adjacent to the Wheeler Opera House from June 29 to August 23, 1999, ) ~ )

The trailer, 24' by 8', will be used as office space for approximately four Aspen Music
Festival employees for the summer season. The Aspen Music Festival will incur the cost,
approximately $3000, for the trailer. There was a temporary use permit granted for seven
(7) days by the Community Development Director which was renewed for another seven
(7) days, good through June 28, 1999.

Staff recommends approval of the trailer with conditions.

Festival.

Zoning: Commercial Core
Code Criteria for Extension Request: Section 26.96.050 allows City Council to grant
a temporary use of up to one hundred eighty (180) days. As provided for in that
subsection, all proposed extensions of a telJlPorary use shall be evaluated under the same
criteria as set forth in Sections 26.96.030 and 26.96.040. This code criteria follows.
Code Criteria: The following criteria must be considered for the review of the trailer:
A. The location, size, design, operating characteristics, and visual impacts of the
proposed use.
Response: The 24' by 8' trailer will be located in the back parking lot of the Wheeler
Opera House and used for the purpose of office space. The trailer will acconuriodate
approximately four people and occupy a portion of the parking lot used primarily for

loading/unloading, renter parking and other staff uses. Staff does not foresee any
problems with the operating characteristics or visual impacts of the trailer.
B. The compatibility of the proposed temporary use with the character, density
and use of structures and uses in the immediate vicinity.
Response: Tl;1e trailer is not expected to create any character or density problems for the
area. The trailer will be accessible and visible from the alley which minimizes the
potential for any negative effects.
C. Impacts of the proposed temporary use on pedestrian and vehicular traffic
and traffic patterns, municipal services, noise levels, and neighborhood
characteristics.
Response: The trailer will occupy the area currently used for loading/unloading, renter
parking and other staff uses. It will not alter pedestrian movements. The use is
compatible with other downtown land uses. A trailer was installed in the same place last
year without impacting parking needs.
D. The duration of the proposed temporary use and whether a temporary use
has previously been approved for the structure, parcel, property or location
as proposed in the application.
Response: The applicant is seeking approval for June 29 to August 23,1999. A
temporary use permit was granted by the Community Development Director on June 15,
1999, but anything beyond fourteen (14) days requires Council approval. Staffhas
indicated to the applicant that installing a trailer for two months of the summer every year
is not a viable long term solution, and has suggested that the applicant begin looking for
other long term alternatives.
E. The purposes and intent of the zone district in which the temporary use is
proposed.
Response: The Commercial Core is the most intensive zone district in the City. The
temporary installation of a trailer for additional office space through the music season
only will not be inconsistent with other commercial uses in the area.
F. The relation ofthe temporary use to conditions and character changes which
may have occurred in the area and zone district in which the use is proposed.
Response: There are no changes in the surrounding land uses that would prohibit this
trailer.

G. How the proposed temporary use will enhance or diminish the general public
health, safety or welfare.
Response: Both the Engineering and Streets Departments have reviewed this application.
Their cominents along with this review will ensure the safety of the community.
Emergency access through the alley and/or to the Wheeler is not compromised by the
trailer.
Recommendation: Staff is recommending approval of the installation of a trailer in the
back parking lot adjacent to the Wheeler Opera House with the following conditions:
1. The temporary use is valid from June 29,1999 to August 23,1999.
2. The trailer will be completely on private property and will not project in to the
alley public right of way
3. Any debris resulting from installing and removing the trailer will be cleaned up
immediately after set-up and removal.
4. The Aspen Music Festival will incur all costs associated with the installation,
rental and any clean up of the trailer.
5. The applicant shall obtain any necessary building permits, including electrical
permits.
6. All material representations made in the application and in the hearing by the
applicant and the applicant's representative shall be considered conditions of
approval, unless amended by other conditions.
Recommended Motion: "I move to approve the request for a temporary use permit for
the purpose of installing and maintaining a trailer at the Wheeler Opera House, 320 East
Hyman Avenue, for the purpose of offices for the Aspen Music Festival, from June 29 to
August 23, 1999 with conditions as noted in Resolution No. 99-~"

NOTICE IS HEREBY GIVEN that a public hearing will be held on Monday, June 28, 1999, at a
meeting to begin at 5:00 p.m. before the Aspen City Council, City Council Chambers, City Hall,
130 S. Galena St., Aspen, to consider an application submitted by the Aspen Music Festival, 2
Music School Road, Aspen, CO, requesting approval for a temporary use permit from June 29 to
August 23, 1999 to use a portion of the back parking lot of the Wheeler Opera house to install a
temporary trailer for Aspen Music Festival offices. The property is located 320 East Hyman. For

Nida Tautvydas of the Wheeler Opera House and Hilary Field of the Aspen Music
Festival are requesting a Temporary Use Permit to install a trailer in the rear parking lot
adjacent to the Wheeler Opera House from June 15 to June 28, 1999, at which point they
will seek approval from City Council to keep the trailer in the same location until August
23, 1999.
The trailer, 24' by 8', will be. used as office space for the Aspen Music Festival staff for
the summer season. The Aspen Music Festival will incur the cost, approximately $3000,
for the cost of the trailer.
The Community Development Director may approve Temporary Use Permits not
exceeding seven days, and may grant an extension for an additional seven days. The
Engineering and Streets Departments have given input as well. Staff recommends
approval of the trailer with the following conditions:
1. The trailer shall be installed for the period of June 15 to June 28 under an administrative
Temporary Use Permit and extension, at which point the City Council will be given the
opportunity to grant a substantial Temporary Use Permit; the trailer will be removed should
City Council not grant approval.
2. The trailer will be completely on private properly and will not project into the alley public
right-of-way.
3. Any debris resulting from activity of installing and removing the trailer will be cleaned up.
4. The Aspen Music Festival will incur all costs associated with the installation, rental and any
clean up associated with the trailer.

26.96.030 Criteria Applicable to all Temporary Uses
When considering a development application for a temporary use, City Council shall
consider, among other pertinent factors, the following criteria as they, or any of them,
relate thereto.
A. The location, size, design, operating characteristics, and visual impacts
of the proposed use,
Staff Finding:
The Temporary trailer, located in the back parking lot of the Wheeler Opera House, will
be 24' by 8' and will be used for the purpose of office space. Staff does not foresee any
problems with the operating characteristics or visual impacts of the trailer.
B. The compatibility of the proposed temporary use with the character,
density and use structures and uses in the immediate vicinity.
Staff Finding:
The trailer is not expected to create any character or density problems for the area.
C. The impacts of the proposed use on pedestrian and vehicular traffic and
traffic patterns, municipal services, noise levels, and neighborhood
character.
