Attached please find copies of a Lease Agreement and Encroachment Agreement for the Rowars
Lot. I am also enclosing a copy of the first lease payment which I have deposited in the Parks Fund.
Hal DishIer will be sending me a recording fee and certificate of insurance so we can have the
encroachment agreement recorded, The original is now with Nick for processing once the recording
fee and certificate are received,

LEASE AGREEMENT
TillS LEASE AGREEMENT is made and entered into as of the 14th day of December,
1999, by and between the City of Aspen, hereinafterreferred to as "Aspen," and Charles M, Rowars,
hereinafter referred to 'as "Rowars."
WITNESSETH:
I. Lease Covenant, In consideration of the payment of rents and the keeping and
perfonning of the covenants and agreements hereinafter set forth by Rowars, Aspen hereby leases
to Rowars the License Area [as set out in that Revocable License Agreement of even date herewith
("License Agreement")], situate in the County of Pitkin, State of Colorado and as described as
follows: see attached Exhibit "A", hereinafter referred to as the "Leased Premises,"
2, Lease Term, The period of this Lease is from 12:00 a.m, December 14th, 1999,
through 1 I :00 p.m December 13th, 2000, hereinafter referred to as the "Lease Tenn." This lease
can be tenninated sooner upon Aspen giving Rowars thirty (30) days written notice oftenninatlon
pursuant to tennination under the License Agreement.
3, Rental Pavments, Rowars shall pay to Aspen total rent of One Hundred and 00/100
Dollars ($ I 00.00) for the tenn of this Lease. Rowars shall maintain the following payment schedule:
A single advance payment of One Hundred Dollars ($100.00),
4, Option to Extend, Rowars will have the option to extend this Lease Agreement
for additional one (1) year tenns, if Rowars gives written notice to Aspen of Rowars' request to
extend two (2) months prior to the expiration of this Lease Agreement. The rental rate, for each
extended tenn will be One Hundred Dollars ($100.00) per year,
5, Use of Leased Premises, Rowars shall use the Leased Premises for the purposes set
out in the License Agreement.

6, Upkeen and Damalfe, Rowars will comply with the provisions in the License
Agreement.
7. Default. The occurrence of any of the following shall constitute an event of default:
(a) Delinquency by Rowars in payment of the rent under the Lease for a period
offive (5) days from the date such rent became due and payable, which delinquency is not cured
within ten (10) days of the giving of written notice to Rowars.
(b) Delinquency by Rowars in the perfonnance of or compliance with any other
obligations ofRowars contained in the License Agreement for a period of five (5) days from the date

of such non-performance ornon-compliance, which delinquency is not cured within twenty (20) days
of the giving of written notice to Rowars,
Upon the' occurrence of any event of default by Rowars, and after such notice as may
be required by law, Landlord may re-enter said Leased Premises and again possess anderljoy the
same as if this Lease had not been made. It is specifically agreed that no additional written notice
shall be required ifRowars has been given that notice required in subparagraphs (a) or (b) above.
Rowars shall peacefully surrender the Leased Premises to Aspen and Aspen may repossess it by
force, summary proceedings, ejectment or otherwise, which shall be equivalent in every respect to
actual entry by Aspen, irrespective of its election, and said proceedings may be maintained for such
purpose.
8. Notice. In the event notice is required by the terms of this Lease, it shall be deemed
sufficient to place the notice in the United States mail addressed to the party being notified; and, for
the purpose of counting days for the notice period, the period shall commence on the date of the
postmark when the letter was mailed, The addresses of Aspen and Rowars for notices are as folJows:

9. Bindinl: Effect. The terms and conditions of this Lease shall extend to and be
binding on the heirs, successors, legal representatives and the assigns of the parties hereto'-
10, Severabilitv. If any provision of this Lease Agreement shall be held invalid or
unenforceable, the remaining provisions shall, nevertheless, remain unaffected and continue in full
force and effect as valid and enforceable.
II. Lel:al Fees. Court Costs and Jurisdiction. In the event this Lease Agreement shall
become the subject of litigation arising from unpaid rent, unlawful entry and detainer and/or damages
to the Leased Premises, the parties agree that the court shall award the prevailing party reasonable
attorney fees as part of the costs to which the party becomes entitled to recover under the court's

judgment. Jurisdiction for any dispute hereunder shall be in the Colorado State Courts in and for the

REVOCABLE ENCROACHMENT' LICENSE
This Agreement made under this license and entered into this 14th day of
December, 1999, by and between the CITY OF ASPEN, Pitkin County, Colorado,
hereinafter referred to as "Aspen" and CHARLES M. ROWARS, at do Pelican Bays 4990
SW 52"d St., #201, hereinafter referred to as "Licensee".
WHEREAS, Licensee is the owner of the following described properties located in
the City of Aspen, Pitkin County, Colorado:
Lot 7, Sunny Park North Subdivision, according to the Sunny Park North
Adjustment and Annexation Map thereof recorded in Plat Book 20 at Page 2 as Reception
Number 292269 and Lot Line Adjustment Plat of Lots 5 and 7, Sunny Park North
Subdivion recorded in Plat Book _ at Page _ as Reception No.
Street and Legal address: 01 31 Smuggler Mountain Road, Aspen, Colorado
WHEREAS, Licensee desires to continue to use Aspen City Land for the following
purposes:
Access to and from dwelling; snow removal; access by emergency vehicles; and
shown in Exhibit "A", attached to this License (" License Area").
WHEREAS, Section 21.04.050 delegates the authority to the City Engineer to
grant encroachment licenses;
WHEREAS, Aspen agrees to the grant of a private license of encroachment as built
subject to certain conditions.
THEREFORE, in consideration of the mutual agreement hereinafter contained,
Aspen and Licensee covenant and agree as follows:
1. A private revocable license is hereby granted to Licensee to occupy, maintain
and utilize the above described Aspen City Property for the purposes described.
2. This license is granted for a perpetual term subject to being terminated with
thirty (30) days notice by the City Engineer of the City of Aspen.
3. The Licensee agrees that during the effective period of this License, he consents
to the use of lands adjacent to the License Area for open space use pursuant to the
guidelines of the Parks Department of the City of Aspen, including pedestrian trails.
4. Simultaneous with the execution of this Revocable License Agreement, Licensee '

will execute a Lease Agreement to pay rental for the use of the License Areas, as set out
therein.
5. Licensee is responsible for the maintenance and repair of the License Area,
together with improvements constructed therein, which Aspen, in the exercise of its
discretion, shall determine to be necessary to keep the same in a safe and clean condition.
Licensee agrees to join any improvement district formed for the purpose of constructing
improvements in and to the public right-of-way.
6. Licensee shall at all times during the term hereof, carry public liability insurance
for the benefit of the City with limits of not less than those specified by Section 24-10-
114 C.R.S., (currently $150,000 per person and $600,000 per occurrence) as may be
amended from time to time, naming the City as co-insured. Licensee shall maintain said
coverage in full force and effect during the term of this License and shall furnish the City
with a copy of such coverage or a certificate evidencing such coverage. All insurance
policies maintained pursuant to this agreement shall contain the following endorsement: "It '
is herby understood and agreed that this insurance policy may not be canceled by
the surety until thirty (30) days after receipt by the City, by registered mail, of a
written notice of such intention to cancel or not to renew." The Licensee shall show
proof of this insurance to the City before this agreement is tiled.
7. Licensee shall save, defend and hold Aspen harmless against any and all claims
for damages, costs and expenses, to persons or property that may arise out of, or be
occasioned by the use, occupancy and maintenance of said property by Licensee, or from
any act or omission of any representative, agent, customer and/or employee of Licensee.
8. This license may be terminated by Licensee on thirty (30) days written notice of
Licensee's intent to cancel. This license may be terminated by Aspen on thirty (30) days
written notice of Aspen's intent to cancel. Upon termination Licensee shall, at Licensee's
expense, remove any improvements or encroachments from said property. The property ,
shall be restored to a condition reasonably satisfactory to Aspen.
9. This license is subject to all state laws, the provisions of the Charter of the City
of Aspen as it now exists or may hereafter be amended, and the ordinances of the City of
Aspen now in effect or those which may hereafter be adopted.
10. Nothing herein shall be construed so as to prevent Aspen from granting such
additional licenses or property interests in or affecting said property as it deems necessary.
11. The conditions hereof imposed on the granted license of encroachment shall
constitute covenants running with the land, and binding upon Licensee, their heirs,
successors and assigns.

12. In any legal action to enforce the provisions of this Agreement, the prevailing
party shall be entitled to its reasonable attorney's fees.
13. If the structUre(s) for which this license was issued is/are removed for any
reason, Licensee may not rebuild in the same location without obtaining another
encroachment license prior to building. It is City policy to preserve public rights-of-way for
the general public benefit, and it is not anticipated that reconstruction of encroachments
would be permitted. No existing encroachment shall be enlarged without obtaining an
additional license prior to construction.
14. The licensee waives any a!ld all claims against the City of Aspen for loss or
damage to the improvements constructed within the encroachment area.

Dear Chuck:
Pursuant to our conversation of yesterday, this letter Is to summarize my understanding of the
situation with the paved driveway, that extends outside of the 30 foot easement, shown on the plat.
It Is our contention that PItkin County had a cooperative arrangement with the prior owner of the
property (the Goldensons) to plow the easement access (across a part of Lot 7) to acoomp!lsh the
plowing. Our clIent believes that the configuration (and paving) of the turnaround was to allow for
easier snow plowing activities. Pitkin County presently provides snow plowing for that same access.
I cannot determine who paved the area. We believe an encroachment license for the area will facilitate
the continued snow plowing act/vltles and would be beneDclal to all concerned.
Attached is a memorandum and agreement reprdlng the owner lI'antlng pennJsslon for such
snow plowIng activities.

the County concerning the use of a portion of the lot for ingress
and egress of County vehicles. This agreement. Which is at-
tached, will enable the County to plON Smuffler Mountain Road and
the Goldenson driveway.
The Goldensons have requested that the County initiate plowing as

The Development Review Committee has reviewed the above referenced application at their May
26, 1999 meeting, and we have the following comments:
General- (1) These comments are based on the fact that we believe that the submitted site plan is
accurate, that it shows all site features, and that it is feasible, The wording must be carried forward
exactly as written unless prior consent is received from the Engineering Department. This is to halt
complaints related to approvals tied to "issuance of building permit." (2) If there are any
encroachments into the public right-of-way, the encroachment must either be removed or be subject
to current encroachment license requirements,
1, Since the plat amends an existing subdivision plat, the plat title should be the next amendment
of the original platting of that lot and subdivision, Change the plat title in the surveyor's statement,
and City Engineer, Community Development and Owner's certificates. The Surveyor's Certificate
must be completed with title commitment information provided within the past 12 months,
2, Provide a note that states the nature and pwpose of the amendment and that in all other regards,
the original plattings remain in full force and effect.
3, There is a gazebo, a parking lot, and reportedly a basketball court on City property, These
improvements must be removed and the area restored to Parks Department approval prior to
submitting the final plat. Show and label the access to Lot 5, Show and label any retaining walls,
4, Both parcels must be fully monumented prior to signing the final plat.

5, The Park Circle right-of-way needs to be revised to show the right-of-way and edge of pavement
of the through-street that altered the original cul-de-sac that was platted. Show improvements in
public right-of-way adjacent to the parcels and to the centerline of the right-of-way.
6, Work in the Public Ri2ht-of-way - Given the continuous problems of unapproved work and
development in public rights-of-way adjacent to private property, we advise the applicant as
follows:
The applicant must receive approval from city engineering (920-5080) for design of
improvements, including landscaping, within public rights-of-way, parks
department (920-5120) for vegetation species and for public trail disturbance, and
streets department (920-5130) for mailboxes, street and alley cuts, and shall obtain
permits for any work or development, including landscaping, within public rights-
of-way from the city community development department.

Application originally flied with your office on April 12, 1999 to allow for a P & Z and City
Council hearings pursuant to the Department's recent interpretation that such is required to
approve the Application. Therefore, this Application is an amended version of the previous
Application modified under the Code to allow for such review. It is my understanding that

Paragraph 10 - Pre-Application Conference Summary Sheet - Response:
Attached to this application (in the foregoing response #8) is an improvement survey
plat that shows the proposed boundary adjustment to Lots 5 & 7 as shown as the crossed
hatched area on such plat. The plat shows the significant surface features on the affected lots;
and visually and accurately represents the impact of the boundary adjustment which is asserted
to be insubstantial.
Consequently, the applicants believe that their request for approval of the Subdivision
Application is in accordance with Land Use Code Section 26.88 in that the Subdivision is
between contiguous lots that: a) results in an insubstantial boundary change between adjacent
parcels (as shown on the plat submitted herewith); b) has been consented to between all the
landowners whose (or predecessors in title) boundaries are being adjusted; (c) will be shown
in a plat with the adjustment, pursuant to the requirements of 26.88.050; (e) the plat will
be recorded in the office of the Pitkin County Clerk & Recorder within 180 days following
the approval of such Subdivision Amendment and (0 will not affect the developments rights
or permitted density of the affected lots.
The Sunny Park North Subdivision that includes the subject lots was created by the
recording of a Plat on November 2, 1965, in Plat Book 3 at Page 52 (3 copy of which plat
is included in this application). Pursuant to the examination of the records of Stewart Title
Company, by their personnel, no other approvals, and/or covenants appear of record. Lot
7 was created by the annexation of a parcel of land located in Pitkin County outside of the
City of Aspen ( which was a portion of the Molly Gibson Park Parcel) and the combination
of such parcel with a parcel located in the Sunny Park North Subdivision, all in accordance
with the Sunny Park North Boundary Adjustment and Annexation Map recorded in Plat Book
20 at page 2 and the Resolution of the Board of County Commissioners of Pitkin County
granting subdivision exemption approval for Sunny Park North Lot 7 and the Molly Gibson
Park Parcel (Resolution 85-83) recorded in Book 492 at page 114; and the Statement of
Exception from Subdivision Process for the purpose of creating the subdivision exception map
of Sunny Park North Lot Seven Boundary Adjustment and Annexation, recorded in Book 594
at Page 523. Based on the foregoing no Amendment of PUD development order is sought
and the approval sought is in compliance with an insubstantial amendment to an approved
Plat as provided for thereunder, as described above in this application.
