AN ORDINANCE RECOGNIZING A TRANSFER FROM THE ICE GARDEN F~qn
IN THE AM~UN~ OF $9~,469.00~ AND A REDUCTION IN BUDGETED DEBT
,562.00; AND AN INCREASE IN OTHER EXPENDITURES IN THE ICE
GARDEN FUND IN THE AMOUNT OF $93.00; AND A TRANSFER TO THE
LAND FUND IN THE AMOUNT OF $9i,469.00; AND A SUPPLEMENTAL
APPROPRIATION IN THE LAND F~D FOR PROPERTY NOTE DEBT SERVICE
IN THE AMOUNT OF $91,562.00; AND AN APPROPRIATION FROM CURRENT
YEAR REVENUES IN THE LAND ..... FUND IN THE AMOUNT OF $93.00
WHEREAS, by virtue of Section 9.12 of the Home Rule Charter,
the City Council may make supplemental appropriations; and
WHEREAS, the City Council is advised that certain transfers
and expenditures must be recognized and approved,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO;
Section 1
Upon the City Manager's certification that the Ice Garden
property note debt service is an obligation of the Land Fund and
should properly be budgeted for as an expenditure within the Land
Fund, the City Council hereby makes a supplemental appropriation
of a transfer in the amount of $91,469.00 from the Ice Garden Fund
to the Land Fund;and recognizes supplemental appropriations for
debt service expenditure in the Land Fund in the amount of
$91,562.00, and an appropriation of unappropriated current year
revenues in the amount of $93.00; and
Section 2
The City Council recognizes a reduction in budgeted debt
service expenditures in the Ice Garden Fund in the amount of
$9i,562.00 and a supplemental appropriation for other expenditUres
in the Ice Garden Fund in the amount of $93.00.

Section 3 --~
If any section, subsection, sentence, clause, phrase or por-
tion of this ordinance is for any reason held invalid or unconsti-
tutional by any Court of competent jurisdiction, such portion
shall be deemed a separate, distinct and independent provision and
such holding shall not affect the validity of the remaining por-
tions thereof.

That a public hearing be held on this ordinance on the
day of
