AN ORDINANCE ENTITLED "WATER SERVICE RATES FOR THE WHOLESALE
SUPPLY OF MUNICIPAL WATER TO WATER DISTRICTS", AMENDING ARTICLE
III OF CHAPTER 23 OF THE MUNICIPAL CODE OF THE CITY OF ASPEN,
COLORADO BY ADDING A NEW DIVISION 6 THEREOF.
WHEREAS, water districts in the Aspen metropolitan area
provide services to citizens ultimately inuring to the ~benefit
of the City of Aspen; and
WHEREAS, the Charter for the City of Aspen, Colorado authorizes
the extension of municipal water utility transmission lines beyond
City boundaries; and
WHEREAS, the Charter for the City of Aspen, Colorado requires
that the City Council establish rates, by Ordinance, for services
provided by municipally-owned utilities; and
WHEREAS, the City of Aspen, Colorado wants to provide an
assured supply of municipal water service to other area utilities
to improve the qual:ity of their water service without being subjected
to jurisdiction as a public utility; and
WHEREAS, the municipal code of the City of Aspen, Colorado
presently fails to establish appropriate rates for the wholesale
supply of municipal wa~er to water districts;
NOW, THEREFORE, be it ordained by the City Council of the
City of Aspen, Colorado:
Section 1.
That a new Division 6 to Article III of Chapter 23 of the
Municipal Code of the City of Aspen, Colorado, be enacted to
read as follows:

DIVISION 6: WHOLESAEE SUPPLY OF MUNiCiPAL WATER T0"~ATER "
DISTRICTS:
Sec. 23-170. Definitions
A. Water District: As used in this Article III a water
district shall be defined as any district including water and
sanitation districts properly organized under the statutes of
Colorado for the purpose of supplying water for domestic purposes
by any available means.
B. Wholesale Supply of Water: As used in this Article
III, "wholesale supply of water" shall mean supply of treated
or untreated water to a master meter wherein the City has no
responsibility for operation and maintenance of the district
distribution system of any kind on the district, private or customer
side of the master meter.
Sec. 25-171. Authorization of Contracts for the Wholesale Supply
of Municip~al Water to Water Districts.
Municipal water may only be supplied on a wholesale basis
to water districts pursuant to contract approved by the City
Council, the terms of which shall include at a minimum the fees,
charges, and rates established in Sec. 25-172. Any such contract
may include any additional terms or considerations which the
City Council deems appropriate, and shall provide for payment
of the fees, charges and rates established in Sec. 25-175 in
cash or in kind.
Sec. 25-172. Water Service Rates for the Wholesale Supply of
Municipal Water to Water Districts.
A. Plant Investment Fee (PIF) and Tap Service Charge.
All contracts for the wholesale supply of municipal water to
water districts shall provide that such districts shall charge
to all new customers and rebate to the City of Aspen a plant
investment fee, system development charge, utility connection
charge, 'tap service charge or equal consideration equivalent
to charges that would be imposed upon similar customers pursuant
to Sec. 25-57 and Sec. 23-59 of this code.
B. Treated Water Rates and Charges. The water rates and
charges imposed by Sec. 25-101 and Sec. 25-102 shall not apply

to the wholesale supply of municipal treased water to water districts.
The rate per 1,000 gallons of municipal treated water supplied
on a wholesale basis to water Districss shall be One Dollar and
Ten Cents ($1.10).
C. Raw Water Rates and Charges. The water rates and charges
imposed by Sec., 25-101 and Sec. 25-102 shall not apply to the
wholesale supply of municipal raw or untreated water to water
districts. The rate per 1,000 gallons of municipal raw water
supplied on a wholesale basis to water districts shall be Fifty
Cents ($0.50).
Section 25-175. Municipal water supply contracts with water dis-
tricts, minimum requirements: _.
Municipal water supply contracts with water districts shall
provide at a minimum as follows:
A. Limitation of supply upon the same terms and conditions
as supply to customers of the Aspen system.
B. Limitation of supply based upon public utility regulations
being imposed upon Aspen by virtue of any service to a water
district.
C. Limitation upon the ability of the water district supplied
with city water to expand its service area or serve water beyond
its service area without City agreement.
D. Provide for partial and total water service at a future
date.
Secti'on 2.
If any section, subsection, sentence, clause, phrase or
portion of this Ordinance is for any reason held invalid or uncon-
stitutional by any court of competent jurisdiction, such portion
shall be deemed separate, distinct, and independent provision,
and such holding shall not affect the validity of any portions
thereof.
Section 5.
