SI (Series of 1981) 100 Leaves AN ORDINANCE OF THE CITY OF ASPEN CORRECTING THE ,iNTRODUCTORY pARAGRAPH oF SECTION 9-3 OF THE' MUNIC'%PAL CODE OF THE CITY OF ASPEN TO REFLECT THE ADOPTION OF THE 1976 EDITION OF THE UNIFO~ FIRE CODE AND REPEALING AND REENACTING SECTION 9-3(w) WHICH pROVIDES ADDITIONS TO SECTION 15.1104 OF THE UNIFORM FIRE CODE, 1976 EDITION, SO AS TO PERMIT A SINGLE ~ S TRANSFER OF FUEL AT n DESTINATION WITH VAPOR HOSE CONNECTION RATHER THAN USING A DoUBnE HANDLING OF ALL TRAILER LOADS WHEREAS, the introductory language of Section 9-3 of the Municipal Code of the City of Aspen erroneously recites the adop- tion of the "1973 edition" of the Uniform Fire Code and the City Council desires to correct said introductory language so as to reflect the adoption of the 1976 edition, and WHEREAS, the City Council desires to repeal and reenact Sec- tion 9-3(w) of the Aspen Municipal Code which amends by the addi- tion of various subsections Section 15.1104 of the Uniform Fire Code, 1976 edition, so as to permit a single transfer of fuel at a destination with vapor hose connections rather than using at least a double handling of all trailer loads, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1 The introductory language of Section 9-3 of the Municipal Code of the City of Aspen, Colorado, is hereby corrected to re- flect the adoption of the 1976 edition of the Uniform Fire Code and shall read as follows: "The Uniform Fire Code, 1976 edition, herein adopted shall be amended as follows:" Section 2 Section 9-3(w) of the Municipal Code of the City of Aspen, Colorado, is hereby repealed and reenacted to read as follows: (w) Section 15.1104 is hereby amended by the addition of the follOwing subsections: RECORD OF PROCEEDINGS 100 Leaves FOR~ ~ C. CO, : "(n) When tank vehicles are engaged in making3 deliveries of class I flammable liquids, there shall be main- tained a liquid and vapor-tight screwtight connec- tion between the tank vehicle and the tank being filled. Other equally effective means of maintain- ing a tight connection may be employed upon appro- val of the fire marshal. (o) The maximum length of the delivery hose used to connect the tank vehicle to the tank being filled shall not exceed twenty (20) feet. Tne following limitations upon capacities of motor vehicles used in transport shall be enforced: (1) It shall be unlawful for any motor vehicle having a tank capacity in excess of Two Thou- sand Five Hundred (2,500) gallons liquid capa- city to deliver LP gas to any place of storage within the corporate limits of the city. (2) It shall be unlawful for any motor vehicle having a tank capacity in excess of Ten Thou- sand (10,000) gallons aggregate, or with any one compartment thereof in excess of Five Thousand (5,000) gallons individual capacity, to deliver flammable liquids to any place of storage within the corporate limits of the city · (3) It shall be unlawful for any motor vehicle transporting flammable liquids in excess of Five Thousand (5,000) gallons, or any motor vehicle transporting LP gas in excess of Two Thousand Five Hundred (2,500) gallons liquid, or any vehicle transporting explosives and other dangerous articles, to remain within the city for a period exceeding one hour, unless as provided herein. (4) It shall be unlawful for any motor vehicle other than a 'tank delivery vehicle' as de- fined herein to deliver flammable liquids, LP gas ~ or other dangerous aritcles to any place of storage within the corporate limits. (p) Section 3 If any subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional by any court of competent 3urisdicti°n, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions thereof.
