RECORD OF PROCEEDINGS 100 Leaves ORDINANCE NO. ~ (Series of 198~) AN ORDINANCE ADOPTING BY REFERENCE THE UNIFORM BUILDING CODE, 1979 EDITION, TOGETHER WITH THE UNIFORM BUILDING CoDE STANDARDS~ i979~ EDITION; AMENDING CERTAIN SECTIONS OF SAID CODES; PROVIDING PENALTIES FOR THE VIOLATIONS OF SAID CODE; AND REPEALING SECTIONS OF THE MUNICIPAL CODE INCONSISTENT THEREWITH WHEREAS, the City Council desires to adopt for the benefit of the City of Aspen, the 1979 edition of the Uniform Building Code, together with the 1979 edition of the Uniform Building Code Stan- dards, and to repeal existing building code provisions and ordin- ances in conflict therewith, and implement recommended additions and modifications thereto, NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1. Repeal. Sections 7-1, 7-140, 7-141, and 7-142 of Chapter 7 of the Municipal Code of the City of Aspen, Colorado, and all ordinances or parts of ordinances inconsistent with the provisions of this ordinance are hereby repealed, except that this repeal shall not affect or prevent the prosecution or punishment of any person for any act done or committed in violation of any ordinance hereby repealed prior to the taking effect of this ordinance. Section 2. Adoption of the 1979 Editions of the Uniform Building Code and Uniform Building Code Standards. Section 7-140 of the Municipal Code of the City of Aspen, Colorado, shall be reenacted to read as follows: Sec. 7-140. Adoption of the 1979 Editions of the Uniform Building Code and Uniform Building Code Stan- dards. Pursuant to the power .and authority conferred by the laws of the State of Colorado and the Charter of the City of Aspen, Colorado, there is hereby adopted by reference the "Uniform Building Code" (and "uniform BUilding Code Appendix"), 1979 edition, and the "Uniform BUilding Code Standards", 1979 edition, published by the International Conference of Build- ing Officials, 5360 South Workman Mill Road, Whittier, California 90601. Unless otherwise exempted by this code, separate plumb- ing, electrical and mechanical permits will be required for the above exempted items. (c) Exemption from the permit requirements of this code shall not be deemed to grant authorization for any work to be done in any manner in violation of the provisions of this code or any other laws or ordinances of this jurisdiction. Section 302(a) Application is hereby amended by adding sections "8" and "9" which shall read as follows; Be Be accompanied by a recent survey, plat and legal description of the proposed building site or property prepared by a registered land surveyor licensed to practice in the State of Colorado at time of application for a building permit. The surveyor making the plat shall certify on the plat that it is correct and that the perimeter monuments described in it have been placed as described, after which ne shall affix his name and seal. Permanent reference monuments under normal geogra- phic and topographic conditions shall be three- quarter (3/4) inch nominal iron pipe (1.05 inches O.D.) or ~5 steel rebar twenty-four (24) inches long with a metal or plastic cap at least one and three-eighths (1 3/8) inches in diameter set so that no more than four (4) inches protrude from the ground and mounded with stones. Said plat should indicate the following: (a) Type of monuments set on property corners; (b) The location and dimensions of any easements or rights-of-way of record or in evidence on a said property; (c) The location of any existing improvements on said property or on rights-of-way or ease- ments · The above requirements shall not be mandatory for a building permit application to reconstruct or remodel totally within the limits of an existing building or structure. RECORD OF PROCEEDINGS 100 Leaves (d) For improvements to De located on large tracts of land (five (5) acres or over) the provisions of section 302(a)(8) shall not apply; but, evidence satisfactory to the building official must be sub- mitted, which shows the improvement on the property to be in compliance with appropriate laws. When construction is proposed in the special flood hazard areas~ be accompanied by elevations (in relation to mean sea level) of the lowest floor (including basement) of all new or substantially improved structures located in the special flood hazard areas. If the lowest floor is below grade on one or more sides, the elevation of the floor immediately above must also be submitted. Section 303(d) Expiration is hereby amended to read as follows: Every permit issued by the building official under the provisions of this code shall expire by limitation and become null and void if the building or work authorized by such permit is not commenced within one hundred twenty (120) days from the date of issuance of such per- mit. Work equal to ten (10) per cent of the valuation of the entire project must be completed in each sixty- day period thereafter until completion of the project or said pro3ect shall be deemed abandoned and the permit expired. In the event a permit shall expire, the fol- lowing provisions shall apply, namely: Ail below grade excavation done in anticipation of construction shall be filled within thirty (30) days of expiration such as to bring the site to a condition comparable to that before permit issu- ance. Any fences, raii ings, canopies and other protective structures placed in a public right-of-way, and required by Chapter 44 of the Uniform Building Code, shall be removed within ten (10) days of expiration of a permit as well as all hazardous conditions eliminated. Before such work can be recommended a new permit shall be first obtained so to do. Such permit shall issue for a permit fee equal to one-half (1/2) the amount required for a new permit for such work provided no changes have been made or will be made in the plans and specifications for such work, and provided further that the work has not been abandoned for a period exceeding one year. The provisions of subparagraph 3 to the contrary notwithstanding, no permit shall reissue for any construction or activity prohibited by law at the time of the application for reissuance. Outside the City limits of Aspen, a building permit is not required for a fence under six (6) feet high. Chapter 11 is hereby amended by adding thereto the fol- lowing Section 1107: Sec. i107. Fences and Retaining Walls. No barbed wire or sharp fence, and no electroni- cally char~ed fence, shall be erected or maintained within the city limits of Aspen. On corner lots f no fence, retaining wall, shrub, tree or similar obstruction shall be erected or maintained which obstructs the traffic vision, nor on corner lots shall any fencer retaining wall, shrub, tree or similar obstruction be erected or maintained which exceeds a height of forty-two (42) inches~ measured from street grade, within thirty (30) feet from the lot corner. Any dangerous fence or obstruction in viOlation of subsection 2 above, shall be removed when so ordered by the building official. Sections 2003(a)(5) and 2103(a)(5) are hereby amended to read as follows: Sec. 2003(a)(5) and 2103(a)(5). Wood columns and arches conforming to heavy timber sizes may be used externally where exterior walls are permitted to be unprotected, noncombustible construction or where one-hour fire- restive noncombustible exterior walls are permitted. Section 2201 is hereby amended to read as follows: Sec. 220i. Type V building may De of any materials allowed by this code. Type V one-hour buildings shall be of one-hour fire restive construction throughout. Type V heavy timber construction shall conform to sec- tion 2106. Materials of construction and fire-restive requirements shall De as specified in Chapter 17. For requirements due to occupancy, see Chapters 6 to 12 inclusive. Table No. 33-A is hereby amended by the addition of footnote 10 at the end of Table 33-A and 10 inserted after title title in the fourth column, Footnote 10 to read as follows: l0 Not required in one or two-story buiidin~ for the floor above or the floor below the floor closest to grade. Table 43-C is hereby amended by adding subsection (c) to footnote 13 to read as follows~ RECORD OF PROCEEDINGS 100 Leaves (1) (c) Topping of Grade A or B concrete not less' than one and one-half (1 1/2) inch thickness may be substi- tuted for the finish flooring required in subsec- tions (a) and (b) above. The Uniform Building Code, 1979 edition, is hereby amended by the addition of a Chapter 53 to such code, as the Insulation Code of the City of Aspen, which chapter shall read as follows; CHAPTER 53. ENERGY CONSERVATION AND THERMAL INSULATION Sec. 5302 Application and Scope. This section shall apply to all buildings and structures in use Groups A (assembly), E (educational), I (institu- tional), B (business), R-1 (hotels and apartments), R-3 (one and two-family dwelling). Sec. 5303. Definitions. For the purpose of this section the following defini- tions shall apply; "ASHRAE" is the A~terican Society of }~eating, Refrigera- tion and Air Conditioning Engineers. "Degree day" is a unit, based upon temperature differ- ence and time, used in estimating fuel consumption and specifying nominal heating load of a building in winter. For any one day, when the mean temperature is less than sixty-five (65) degrees Fahrenheit, there exists as many degree days as there are Fahrenheit degrees difference in temperature between the mean temperature for the day and sixty-five (65) degrees Fahrenheit. "Glazing" is all transparent or translucent materials in exterior openings. "Exterior wall area" is the gross area of wall surfaces adjacent to heated spaces, including glazing and doors, exposed to ambient climatic temperatures measured for a dwelling unit or group of units served by a heating sys- tem. "Infiltration" is air flowing inward as through a wall, crack, etc. "Special glazing" is glazing which has a minimum U fac- tor of .70 for all glazed surfaces. "Thermal conductivity (K factor)" is the time rate of heat flow through one square foot of homogeneous mater- ial one inch thick when there is a temperature differ- ence of one degree Fahrenheit between the opposite faces of the material expressed in B.t.u./hour, square foot, degree Fahrenheit per inch. "Thermal resistance (R)" is the measure of the resis- tence of a material or building component to the passage of heat. The resistence value (R) of mass-type insula- tions shall not include any value for reflective facing. 7 FORM 50 C.F. HOECKEL B. B. E L. Co. RECORD OF PROCEEDINGS 100 Leaves "Transmissivity" is the capacity of a material to trans- mit radiant energy. "U factor" is the total heat flow through a given con- struction assembly, air to air, expressed in B.t.u./ hour, per square foot, per degree Fahrenheit temperature difference. U=Rt where Rt equals the sum of the resistance (R) for the individual components of the assembly. U factors shall be calculated according the ASHRAE methods. "Unheated spaces" are any spaces exposed to ambient tem- peratures and not provided with a heat supply capable of maintaining a minimum temperature of forty-five (45) degrees Fahrenheit. Sec. 5304. Building Insulation Material Standards. Ail materials used in the insulation of buildings in order to comply with this section shall conform with the following standards: Cork board ................ No lower "R" value is acceptable. de Thermal resistance "R,' values apply to mineral fiber Only. 2.1. Reflective insulation. a. Blanket type. (1) Name of manufacturer or distributor. (2) Insulation type. (3) Thermal resistance "R" value. (R value to include single oor multilayers, foil or kraft backed, one or both sideS.) Identification labeling and marking of ali other acceptable building insulating material shall comply with their appropriate standard listed in this section. Sec. 5305. Thermal Design Standards for Ceilings and Walls. Ceilings; The maximum U value for ceilings shall be 0.05. All occupancies with a floor to ceiling height in excess of twelve (12) feet shall have a maximum U value of 0.04. 2. Walls; Ail buildings and structures in Group R-1 and R-3 shall have a maximum U value for walls above grade of 0.05. Masonry and structural concrete walls have a maximum U value of 0.085 if the insulating materials are placed on the wall's exterior. RECORD OF PROCEEDINGS 100 Leaves Ail buildings and structures in Groups A, E, I, and B shall have a maximum U value above grade of 0.085. Walls of unheated spaces need not be insul- ated. Basement walls below grade shall have a maxi- mum U value of 0.09. This is required if the basement space is provided with a positive heat supply to maintain a minimum temperature of fifty (50) degrees Fahrenheit. Sec. 5306. Floor Section, Foundation Walls and Slabs- on-Grade. 1. Ail buildings and structures in Group R-1 and R-3. Floors over unheated basements v crawl spaces and garages: The maximum U value shall be 0.05 or the walls of the foundation shall be insulated to a depth of the footings with a maximum U value of 0.09. Slabs-on-grade: Perimeter insulation shall be required from the top edge of the slab to a depth of two (2) feet below grade. The maxi- mum U value shall be 0.1. Structural concrete mats on grade shall be required to perimeterly insulate the full depth of the mat. The maximum U value shall be 0.1. Ail buildings and structures in Groups A, E, I and B-2. Floors over unheated basements, crawl spaces; The maximum U value shall be 0.08 or the walls of the foundation shall be insulated to a depth of the footings with a maximum U value of 0.09. Slabs-on-grade: Perimeter insulation shall be required from the top edge of the slab to a depth of two (2) feet below grade. The maxi- mum U value of the insulation shall be 0.2. Structural concrete mats on grade shall be required to perimeterly insulate the full depth of the mat. The maximum U value shall be 0.1. Sec. 5307. Thermal Design Standards for Glazing. Ail windows, skylights, and doors shall be glazed with insulating 91ass as defined in the ASHRAE Guide - double glazing - or shall be equipped with storm windows and storm doors. Closure providing equivalent resistance to heat transmission will be acceptable. 10 FORM 50 C.F. NOECKEL B. B. & L. RECORD OF PROCEEDINGS 100 Leaves Exception: Ail buildings in Gruop B-2 may use single glazing for display areas which are com- pletely sealed from the interior heated spaces. The total glazing area of a building shall not exceed fourteen (14) per cent of the total floor area for all classes of structures. Se Skylights shall be included as glazing areas in these calculations. South facing glazing of a building, i.e., glazing oriented between the true bearings one hundred sixty-five (165) degrees one hundred ninety-five (195) degrees, shall not be restricted as to total glass area upon meeting the following requirements: (1) South glazing shall be clear and untreated. (2) The total combined glazing area on all other exposures (compass coordinates other than one hundred sixty-five (165) degrees one hundred ninety-five (195) degrees) shall not exceed twelve and one- half (12.5) per cent of the total floor area for all classes of structures. Sky- lights shall be included as glazing areas. Sec. 5308. Heat Distribution Equipment. Ail heating distribution ductwork and piping run- ning through unheated spaces shall be insulated. a. Minimum R value of duct insulation R-5.55. b. Minimum R value of piping insulation R-3.7. Sec. 5309. Infiltration. Caulking and sea±ing: Exterior joints around win- dows and door framesr between wall and foundations, between wail and roof, between wall panels, at pen- etrations of utility services through walls, floors and roofs, and all other openings in the exteriors envelope shall be caulked, gasketed or otherwise weather-stripped. All buildings in Groups A, E, I, and B-2 shall be required to institute entrance sealing by using doubled entrance systems. Sec. 5310. Reqiurement for Day-Night Thermostats. Ail structures in Groups A, E, I, and B-2 shall be required to install day-night thermostats to reduce heating demand during periods when building is not occupied. 11 FORm~ so 0. F. Ail R-1 and I group structures shall use an outside design temperature of minus fifteen (15) degrees Fahrenheit. e Ail buildings in Groups A, E, and B-2 shall use an outside design temperature of minus ten (10) degrees Fahren[~e it. Sec. 5312. Design Flexibility. Structures shall be exempt from Sections 5304, 5304, 5306, 5307 and 5309 of Chapter 53, Energy Conservation and Thermal Insulation, upon meeting all the following requirements: The maximum designed load for space heating per square foot of heated floor space shall be as follows ~ Occupancy or Use Maximum Design Load for Space Heating for Square Foot of Heate~ Floor Space Btuh/ft.~ Residential and multi-family Commercial, institutional and office buildings Restaurants, auditoriums, gymnasiums, theaters, churches and all other buidings where outside air is governed by makeup air requirements 18 Btuh/ft.2 24 Btuh/ft. 2 30 Btuh/ft.2 e Ail calculations for determination of the design heating load shall use the following design condi- t ions; so Ail R-1 and I structures shall use an outside design temperature of minus fifteen (15) degrees Fahrenheit. Ail buildings in Groups A, E, and B-2 shall use an outside design temperature of minus ten (10) degrees Fahrenheit, interior design tem- perature of seventy (70) degrees Fahrenheit. 12 RECORD OF PROCEEDINGS 100 Leaves The building department will require calculations by a reg-istered professional engineer or architect in the State of Colorado to justify compliance with the requirements of Chapter 53. Such calculations shall conform to the procedure outlined by the A~]erican Society of Heating, Refrigeration, Air Conditioning Engineers. Sec. 5313. Exemptions to Chapter 53 Requirements. Ail dwelling units approved by the Colorado Division of Housing as meeting the mobile home standard ANSI 119.1, and all R-Division 3 residences~ shall be exempt from the provisions of this Chapter 53. Section 4. Penalties. Section 7-142 of the Municipal Code of the City of Aspen, Colorado, is hereby reenacted to read as follows: Sec. 7-142. Violations and penalties. (a) It shall be unlawful for any person to erect~ construct, enlarge, alter, repair, move, improve, remove, convert or demolish, equip, use, occupy or maintain any building or structure in the City of Aspen or cause the same to be done, contrary to or in violation of any of the pro- visions of this code. (b} A violation of any of the provisions of the code shall constitute a misdemeanor, punishable upon conviction by a fine not exceeding Three Hundred Dollars ($300.00), or by imprisonment not exceeding ninety (90) days, or by both such fine and imprisonment. A separate offense shall be deemed committed on each day or portion thereof that the violation of any of the provisions of this code occurs or continues unabated after the time limit set for abatement of the violation. Section 5. Severability. If any subsection, sentence, clause, phrase or portion of this ordinance is for any reason held invalid or unconstitutional by any court of competent 3urisdiction, such portion shall be deemed a separate, distinct and independent provision and such holding shall not affect the validity of the remaining portions thereof· Section 6. Certification. The City Clerk shall certify to the passage of this ordinance and make not less than three (3) copies of the 1979 editions of the Uniform Building Code and Uniform Building Code standards 13 RECORD OF PROCEEDINGS 100 Leaves available for inspection by the public during regular business hours. The 1979 editions of the Uniform Building Code and the Uni- form Building Code Standards are adopted as if set forth at length, except for the following chapters and/or sections which are declared to be Inapplicable to the City of Aspen and are, therefore, expressly deleted: (a) Chapters ll, 12, 23, 38, 48, 49 and 53 of the Uniform Building Code Appendix. (b) Section 204 of the Uniform Building Code concerning the Board of Appeals. Section 3. Additions or Modifications. Section 7-141 of the Municipal Code of the City of Aspen, Colorado, shall be reenacted to read as follows: Sec. 7-141. Amendments. The Uniform Building Code, 1979 edition, adopted herein is subject to the following additions or modifications and is amended as follows: (a) Sec. 104(f) is hereby amended to read as follows: "Sec. 104(f) Historic Building. Repairs, alterations and additions necessary for the preservation, restoration, rehabilitation or continued use of a building or structure may be made without con- formance to all the requirements of this code when auth- orized by the building official provided: The building or structure has been determined to be of historic, architectural or geographic importance and has received historic designation pursuant to the provisions of Artic%e IX of Chapter 24 of the Aspen Municipal Code; provided, however, that the automatic inclusion of a structure within a larger historic overlay district shall not constitute without more, a designation of historic, architec- tural, or geographic importance sufficient to meet the requirements of this subparagraph. Any unsafe conditions as described in this code are corrected. The restored building or structure will be no more hazardous based on life safety, fire safety and sanitation than the existing building.
