A RESOLUTION OF TttE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO
EXTENDING Tile RECORDATION PERIOD FOR FILING THE ttlSTORIC
LANDMARK LOT SPLIT SUBDIVISION EXEMPTION PLAT AND SUBDMSION
EXEMPTION AGREEMENT FOR NPJ LLC, IN REGARD TO 930 KING STREET, CITY
OF ASPEN, COLORADO
WHEREAS, NPJ LLC (Applicant) was granted approval for a Historic Landmark Lot Split
by the AspenCity Council, pursuant to Ordinance Number 20, Series of 1998; and,
WHEREAS, said Ordinance required the applicant to record a Subdivision Exemption Plat
and Subdivision Exemption Agreement within 180 days of the final approval, granted September
28, 1998; and,
WHEREAS, pursuant to Section 26.80.040, failure to record a final Plat and Subdivision
Exemption Agreement within the 180 filing deadline shall render the approval invalid; and,
WHEREAS, despite the recordation deadline, the applicant has been unable to record the
appropriate documents in a timely manner, due to the discovery of an error in Ordinance 20, Series
of 1998; and,
WHEREAS, the Aspen City Council, finding that neither the Municipal Code nor the
conditiOns surrounding the 930 King Street parcel have changed in a way which would require a
reevaluation of the approval, has found good cause to extend the deadline from March 28, 1999 to
April 28, 1999.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF Tile CITY
OF ASPEN, COLORADO as follows:
NPC LLC is hereby granted an extension of the period in which to record the Subdivision
Exemption Plat and Subdivision Exemption Agreement as required by Ordinance Number 20,
Series of 1998, to April 28, 1999.
RESOLVED AND ADOPTED this 22nd day of March, 1999, by the City Council of the City of
Aspen, Colorado.
