AN ORDINANCE ZONING THE MOUNTAIN EDGE ANNEXATION WHICH LAND WAS
ANNEXED TO THE CITY OF ASPEN PURSUANT TO ORDINANCE NO. 76, SERIES
OF 1979, AND THE COLORADO MUNICIPAL ANNEXATION ACT
WHEREAS, the Aspen Planning and Zoning Commission did hold a
public hearing on November 17, 1981, to consider zoning the Moun-
tain Edge Annexation (which is more specifically described in
Exhibit "A" attached hereto and incorporated herein) as R-15, R-6,
R-MF or L-2, and
WHEREAS, the Planning Commission did consider the statement
of intent by City Council at the time of annexation that an
employee housing project to benefit the Music Associates of Aspen
be built on this site, and
WHEREAS, the Planning Commission did find that since this
property was zoned R-i5 when it was a part of Pitkin County, that
zoning' it to R-MF or L-2 would be a substantial upzoning which
would be speculative, in the absence of a' specific application for
multi-family housing to which the zoning designation could be con-
ditioned, and
WHEREAS, the Planning Commission did indicate to the property
owner that should a multi-family housing application be submitted
which provides a substantial public benefit, the Commission would
be willing to sponsor a zoning map change to permit consideration
of such an application, and
WHEREAS, the Planning Commission has concurred with the Plan-
ning Office and reco~m~ended that City Council zone the Mountain
Edge Annexation as R-15, and
WHEREAS, the Aspen City Council does desire to accept the
recommendations of the Planning Office and the Planning Commis-
sion and zone the subject parcel to R-15.

NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:
Section 1
That from and after the effective date of this ordinance, the
property identified as the Mountain Edge Annexation, more particu-
larly described in Exhibit "A" attached hereto and incorporated
herein, shall be zoned R-15, and be subject to those zoning regu-
lations applicable to said zone district and described in Chapter
24 of the Aspen Municipal Code (as now exists or may hereafter be
amended) .
Section 2
If any section, subsection, sentence, clause, phrase or por-
tion of this ordinance is for any reason held invalid or unconsti-
tutional by any court of competent jurisdiction, such portion
shall be deemed a separate, distinct and independent provision and
such holding shall not affect the validity of the remaining por-
tions thereof.
Section 3

days prior to which hearing notice of the same shall be published
once in a newspaper of general circulation within the City of
Aspen.

located within the City of Aspen as of
'October 16, 1979, specifically being all of
Block 62, City and Toxin, site of Aspen, all of
Block 1, Eames Addition to the City and Town-
site of Aspen, that part of the old Color~do
Midland Railroad right of way located South-
westerly of said Block 1, Eames Addition and'
those parts of unplatted portion of Eames Add-
ition to the City and Townsite of Aspen and
Charles H. Jacobs Lot and the alley in Block 1
said Eames Addition lying within the following
described parcel, to-wit:
Beginning at the Northeasterly corner of said
Block 62; thence S 14o50'49'' W, 3i6.33 feet
along the Easterly line of said Blocks 62 and
1 to the Southwesterly line of the railroad.

Projected Southerly from the Westerly line of

Block 1 and 62 to the point of beginning. Said
parcel, including that portion located within
