ASPEN PLANNING & ZONING COMMISSION Minutes JULY 20, 2004
Ruth Kruger acting as Chair called the regular Aspen Planning & Zoning
Commission Meeting to order at 4:30 pm in the Sister Cities Meeting Room.
Members Jack Johnson, Dylan Johns, Steve Skadron, John Rowland and Ruth
Kruger were present. Jasmine Tygre, Roger Haneman and Brandon Marion were
excused. Staff present: James Lindt, Community Development and Jackie Lothian,
Deputy City Clerk.
COMMENTS
Dylan Johns spoke about last night's city council work session discussion on some
recommendations to change the design review guidelines from a committee of
design professionals and some city staff. P&Z would be part of the public hearing
process. Infill and open space were also discussed. James Lindt will provide the
memo on the design standards and it won't come before P&Z until October.
MINUTES
MOTION: Dylan Johns moved to approve the minutes of July 06, 2004; seconded
by Jack Johnson. APPROVED 5-0.

CONTINUED PUBLIC HEARING:
BEAUMONT INN AFFORDABLE HOUSING PUD
Ruth Kruger opened the continued public hearing on the Beaumont Inn. James
Lindt stated that the applicant requested the hearing be closed due to the direction
of internal policy changes for Aspen Valley Hospital.
MOTION: Jack Johnson moved to close the hearing for the Beaumont Inn
Affordable Housing PUD; seconded by Dylan Johns. APPROVED 5-0.
PUBLIC HEARING:
54 SHADY LANE - STREAM MARGIN REVIEW
Ruth Kruger opened the public hearing for the stream margin review for 54 Shady
Lane; notice was provided for publication, posting and mailing.
James Lindt stated an application was submitted by Marc Friedberg requesting a
stream margin review approval for a 470 square foot addition to the existing
residence at 54 Shady Lane. The property was located within 100 feet of Hunter
Creek. The proposed addition contained a kitchen on the second floor and an
additional bedroom on the first floor. The construction was cinder block as was

the remainder of the house. Three cottonwood trees would be removed and
mitigated for. The addition would be set back 30 feet from the Top of Slope,
which met the standard that required only 15 feet. Staff recommended approval
with conditions in the resolution.
Marc Friedberg said that they have lived with a galley kitchen for 20 years and this
would be a 18 feet by 13 feet additional cube; the house currently consisted of 2
other cubes at 2,540 square feet. Lindt noted the allowable square footage was.
5300 square feet. Friedberg said a tree was leaning toward the houSe and need~o
be removed for safety; he appealed to the city manager and agreed the tree was a
safety issue so it has been resolved.
No public comments.
Jack Johnson inquired about the fisherman's easement. James Lindt explained that
there was not one in place and because of recent legislation they were not able to
require fisherman's easements. Johnson complimented the applicant on the
sensitive addition to a beautiful house.
MOTION: Steve Skadron move to approve Resolution (426 and a stream margin
review request to construct a 470 square foot addition to the single-family
residence located at 54 Shady Lane, with the following conditions: 1. The Applicant
shall place vegetation protection fencing and silt fencing directly adjacent to and on the north side of the
pedestrian path (adjacent to'sculpture) that runs from the corner of the carport steps to the north side of
the existing deck. The Applicant shall provide a detailed tree protection fencing plan at the time of
building permit submittal and have the City of Aspen Parks Department inspect and approve of the
erected silt and tree protection fencing prior to commencing construction. 2. The Applicant shall store
construction materials adjacent to the carport along Red Mountain Road to ensure protection of native
vegetation on the site. The location of the material storage shall be shown on the construction
management plan that shall be submitted by the Contractor at the time of building permit submittal. 3.
There shall be no excavation, storage of materials, storage of construction backfill, storage of equipment,
foot or vehicle traffic allowed within the drip line of any tree on the site. 4. All outdoor lighting shall be
downcast and meet the requirements of the City of Aspen Lighting Code pursuant to Land Use Code
Section 26.575.150, Outdoor Lighting. 5. The primary contractor shall submit a letter with the building
permit application stating that they have read and understand the conditions of approval contained
herein. And The Applicant shall provide a drainage plan prepared by a licensed engineer prior to
building permit issuance that demonstrates that the property's historic runoff will not be increased as a
result of the addition approved herein.
