RESOLUTION NO. 110
(Series of 1999)
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO,
EXTENDING THE RECORDATION PERIOD FOR FILING THE BARBEE FAMILY
FINAL PUD/SUBDIVISION DEVELOPMENT PLAN AND IMPROVEMENT
AGREEMENT, FOR THE BARBEE PROPERTY, LOTS 1 AND 2 OF BLOCK 11, AND
LOTS 1.9 OF BLOCK 5, CITY AND TOWNSITE OF ASPEN
WHEREAS, the Barbee family was granted approval for a PUD/subdivision by the
Aspen City Council, pursuant to Ordinance Number 11, Series of 1999; and,
WHEREAS, said Ordinance required the applicant to record a final PUD/subdivision
development plan and improvement agreement within 180 days of the final approval granted
April 12, 1999; and,
WHEREAS, pursuant to Section 26.480.070.E. of the Land Use Code, failure to record the
plat within a period of 180 days shall render the approval invalid; and,
WHEREAS, despite the recordation deadline, the applicant was not able to record the
appropriate documents by the 180 day deadline, October 9, 1999, due to negotiating the sale of
two free market lots and the project's affordable housing component, and the Aspen City Council
approved Resolution No. 89, Series of 1999, on September 27,1999, extending the deadline to
record the final PUD/Subdivision development plan and improvement agreement for 45 days to
November 24, 1999; and,
WHEREAS, despite the revised recordation deadline, the applicant may not be able to
record the appropriate documents by the 45 daydeadline, November 24, 1999, due to delays in
fulfilling the conditions of approval required by Ordinance 11, Series of 1999; and
WHEREAS, the Aspen City Council, finding that neither the Municipal Code nor
conditions surrounding said approval would change in a way that wou1d require a reevaluation of
that approval, has found good cause.to extend the deadline an additional 60 days to January 23,
2000.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF ASPEN,
COLORADO, THAT:

Section 1:
The Barbee family is hereby granted an additional 60 day extension ofthe period in
which to record the final PUD/subdivision development plan and improvement
agreement, as required by Ordinance Number II, Series of 1999, to January 23, 2000.
Section 2:
A public meeting on this Resolution was held on the 22nd day of November, 1999, at 5:00
in the City Council Chambers, Aspen City Hall, Aspen, Colorado.
