Agreement made this day of , 1980, by
and between HANS B. CANTRUP and THE CITY OF ASPEN:
WHEREAS, on September 8, 1980 representatives of Hans B.
Cantrup appeared before the City Council to request Council to
sponsor an amendment to the Aspen City Code allowing exemption
from Floor Area Ratio calculations for conference space~ and
WHEREAS~ Council decided not to sponsor that amendment
but rather instructed %he planning office to study a more
general solution to the problem~ and
WHEREAS, Council did recognize a need for the immediate
provision_ of such conference space; and
~fHEREAS, Council agreed, because of that need~ as a
temporary solution, that pursuant to ~24-12.3(a) of the Aspen
City Code a 3,000 sq. ft. conference center could be constructed
at the Continental Inn provided that 3,001 sq. ft on adjoining
parcel were deed restricted;
NOW, THEREFORE~ the parties hereto make the following
agreement:
1. Restriction. 3,001 square feet on an ~djoining parcel
of land shall be deed restricted.
2. Term of Restriction. The deed restriction shall be
effective until such time as the above referenced conference
center is removed. Said removal shall be accomplished no later
than three years~ six months from the effective date of this
Agreement, unless such time is extended, in writing, by agree-
ment of the parties hereto.
3. Construction of Conference Center. Upon the signing
of this Agreement, Cantrup shall be allowed to apply for a
building permit for the construction of a 3,000 sq. ft. confer-
ence center to be located above the lobby at the Continental Inn
515 S. Galena St., Aspen, Colorado 81611. Provided all other
building code requirements are met other than Floor Area Ratio
calculations said permit shall be issued forthwith.
IN WITNESS WHEP~OF, the parties hereto have signed this
Agreement the date first above written.
