SUMMARY: The applicant wishes to amend the plat to reflect added
limited common elements and a greenbelt general common element.
This qualifies as an insubstantial plat amendment, and shall be
approved' by the Planning Director.
FINDINGS: In August 1986 the duplex was condominiumized, Since
then, both neighbors agreed to separate the common driveway with
a 3 " strip of shrub and tree plantings. This resul ts in
separated parking areas as limited common elements and the
greenbelt as general common element. This is the only change
resulting from the proposal.
section 7-1006 A. reads:
"Insubstantial Amendment. An insubstantial amendment to an
approved plat may be authorized by the Planning Director. An
insubstantial amendment shall be limited to technical or
engineering considerations first discovered during actual
development which coul~ not reasonably be anticipated during the
approval process, or any other minor change to a plat which the
Planning Director finds has not effect on the conditions and
representations limiting the approved plat."
1. The plat must satisfy Engineering's concerns addressed in the
9/20/90 referral memo from Chuck Roth.

approve with conditions the Insubstantial Plat Amendment for the
Beyer Duplex Condominium.

Re: Beyer Duplex Plat Amendment
Having reviewed the above referenced application, the engineering
department has the following comments:
1. The roadway easements shown on the plat are unclear. What is
the basis of the easements? Is there a conveyance from Lot 21 to
Lot 22 for an access easement? What is the Book and Page of the
conveyance? This information must be indicated on the plat.
Also, it is unclear about there being a "roadway easement" within
the public right-of-way of Riverside Drive. What does it mean?
How can there be an easement within a right-of-way?
2. It is not clear that the driveways meet municipal code
(Section 19-101). The plat must indicate the location and nature
(concrete, asphalt, gravel) of the driveways. If there is an
existing non-conforming driveway, it would be grandfathered, but
any new driveway construction must conform to code. This lot is
permitted one 10' driveway cut for a single driveway or one 18'
cut for a double driveway.
3. The plat must contain a 1"=400' scale vicinity map.
4. The plat must be titled "1st Amendment to ......" and must
contain a general note which explains that the plat amends the
plat filed at Book 18, Page 83 at the office of the Pitkin County
Clerk and Il.ecorder and that the amendment is filed in order to
reflect a change from general common element to limited common
element for the driveway.
5. The surveyor's' certificate or a general note must reflect
that all easements as indicated on title policy number _ and
date have been shown. Since this is an insubstantial
amendment, it would not be required but it would be desirable for
the surveyor I s certificate to include the statement that the
survey was performed in accordance with CRS 1973, Title 38 ,
Article 51, and that the survey closes within a limit of 1 in
10,000. '
