That it is desirable and necessary that such territory be annexed to the Municipality. 2. That the requirements of Sections 139-21-3, CRS. 163, as amended, and 139-21-4, CRS. 1963, as amended, exist or are met. 3. That the signers of the Petition comprise the land owners of more than 50% of the territory included in the area proposed to be annexed, exclusive of streets and alleys. 4. That the legal description of the boundaries of the area to be annexed is as follows: E. 2 of Lot 17, Blk. 17 Riverside Addition. All of Lots 18, 19, 20, 21, 22, Blk. 17 Riverside Addition., and also An irregular tract of land located in the Riverside Placer U.S.M.S. 3905 AM in the NE 4 of Section 18, Tp. 10 S., R. 84 W. of the 6th P.M. more fully described as follows: Beginning at a point whence Corner No. 14 of Tract No. 2 of the Riverside Placer (as shown upon plat in Pitkin County Clerk and Recorder's Office bearing Document No. 101425) bears N. 30°47' W. 30 feet; thence S. 34' E. 180 feet; thence N. 65' 45' W. 105 feet; thence N. 2°0' W. 125 feet to the point of beginning, containing 0.18 acres, more or less. 0 • 5. The following is a legal description of the boun- daries of the area proposed to be annexed: A rectangular tract of land located in the Riverside Placer U.S.M.S. 3905 A.M. in the NE 1/4 of Section 18, T. 10 S., R. 84 W. of the 6th P.M. more fully described as follows: Beginning at a point whence Corner No. 14 of Tract No. 2 of the Riverside Placer (as shown upon plat in Pitkin County Clerk and Recorder's Office bearing Document No. 101425) bears N. 30°47' W. 30 feet, thence S. 34' E. 180 feet; thence N. 65*45' W. 105 feet; thence N. 200'W. 125 feet to the point of beginning, containing 0.18 acres, more or less. RECORD OF PROCEEDINGS 100 Leaves ORDINANCE NO, 3_ Series of 1969 AN ORDINANCE PROVIDING FOR THE ANNEXATION TO THE CITY OF ASPEN, COLORADO OF THAT CERTAIN TERRITORY OR REAL ESTATE PARTICULARLY DESCRIBED IN THIS ORDINANCE, LYING OUTSIDE OF BUT ADJACENT TO THE CITY OF ASPEN, COLORADO: WHEREAS, the petition for annexation has been signed by the owner of 100% of the property proposed to be annexed, exclusive of streets and alleys, and said petition has been filed with the City Clerk; and, WHEREAS, the City Council of the City of Aspen finds that the area seeking annexation is eligible to be annexed because there is at least 1/6th contiguity between the municipality and the area seeking annexation, and that the conditions set forth in Sections 3 and 4 of the Colorado Municipal Annexation Act of 1965 have been met; and that there are no additional terms and. conditions to be imposed. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN, COLORADO: Section 1: The parcel of land described as follows is hereby annexed to the City of Aspen. East one-half of Lot 17, Block 17, Riverside Addition. All of Lots 18, 19, 20, 21, 22, of Block 17, Riverside Addition and also An irregular tract of land located in the Riverside Placer U.S.M.S. 3905 AM in the NEB of Section 18, Township 10 South, Range 84 West of the 6th Prime Meridian, more fully described as follows: Beginning at a point whence Corner No. 14 of Tract No. 2 of the Riverside Placer (as shown upon plat in Pitkin County Clerk and Recorder's Office bearing Document No. 101425) bears North 300 47' West 30 feet; thence South 340 East 180 feet; thence North 650 45' West 105 feet; thence North 020 0' West 125 feet to the point of beginning, containing 0.18.acres, more or less.
