PETITION FOR ANNEXATION OF TERRITORY
TO THE CITY OF ASPEN, COLORADO
Date Petition Filed: March 4, 1968
We, the undersigned, being the landowners of one
hundred percent (100%) of the land contained within the exter-
ior boundaries of the territory hereinafter described to here-
by respectfully petition the City Council of the City of Aspen,
Colorado to annex said area to the City of Aspen, Colorado, and
state the following allegations:
1. It is desirable and necessary that said territory
be annexed to the City of Aspen, Colorado.
2. The requirements of Sections 3 and 4 of the Muni-
cipal Annexation Act of 1965 are fully met.
3. The undersigned are the owners of one hundred
percent (100%) of the property proposed to be annexed.
4. The following is a legal description of the boun-
daries of the area proposed to be annexed:
Beginning at a point on the Westerly line of
County Road whence the West 1/4 Corner of Section
12, Township 10 South, Range 85 West of the 6th
P.M. bears South 58°17' West 1614.50 feet; thence
17) South 76°26' West 177.70 feet; thence North 25'
14' West 204.22 feet; thence North 76026' East
219.00 feet; thence South 13034' East 200 feet to
point of beginning.
Containing 0.91 (plus or minus) acres.

WHEREAS, Margaret M. Adkins and Robert W. Adkins
have filed their Petition for annexation of certain property
hereinafter described with the Clerk of the City of Aspen on
the 4th day of March, 1968; and,
WHEREAS, said petitioners are the owners of one
hundred percent (100%) of the land proposed to be annexed; and,
WHEREAS, all of the requirements of the applicable
parts of Sections 3 and 4 of the Municipal Annexation Act of
1965 have been met by said Petition; and,
and,
WHEREAS, no election is required under said Act;
WHEREAS, the City Council determines not to impose
additional terms and conditions upon said land proposed to be
annexed;
NOW THEREFORE, IT IS RESOLVED by the City Council of
the City of Aspen, Colorado that the City Council shall annex
said territory by ordinance.

AN ORDINANCE PROVIDING FOR THE ANNEXATION TO THE
CITY OF ASPEN, COLORADO OF THAT CERTAIN TERRITORY OR REAL
ESTATE PARTICULARLY DESCRIBED IN THIS ORDINANCE, LYING OUT-
SIDE OF BUT ADJACENT TO THE CITY OF ASPEN, COLORADO:
WHEREAS, a Petition for annexation was filed with
the City Clerk of the City of Aspen on March 4, 1968, request-
ing the annexation of the territory hereinafter described,
which Petition meets all of the requirements of the applicable
section of the "Colorado Municipal Annexation Act of 1965", and,
WHEREAS, the City Council of the City of Aspen passed
and adopted a Resolution on March/42, 1968 accepting said Peti-
tion for annexation, and resolving that said property be annexed
by ordinance, and
WHEREAS, the owners of one hundred percent (100%) of
the property proposed to be annexed have signed said Petition,
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF ASPEN:
Section 1: That the following described tract of
land, to wit:
Beginning at a point on the Westerly line of
County Road whence the West 1/4 Corner of Section
12, Township 10 South, Range 85 West of the 6th
P.M. bears South 58017' West 1614.50 feet; thence
South 76126' West 177.70 feet; thence North 251
14' West 204.22 feet; thence North 76126' East
219.00 feet; thence South 13134' East 200 feet to
point of beginning.
Containing 0.91 (plus or minus) acres,
which land is situated in the County of Pitkin, State of Colo-
rado, and adjoining and touching the boundary line of the City
of Aspen and situated that not less that 1/6 of the aggregate
external boundaries of said tract of land coincide with the
existing boundaries of the City of Aspen, Colorado be hereby
added co, annexed, taken into and made a part of the City of
Aspen, Colorado.
Section 2: That the annexation map and certified

copies of the original annexing ordinance be filed with the office
of the Clerk of the City of Aspen, and with the office of the
Secretary of State and with the Clerk and Recorder of Pitkin Coun-
ty, pursuant to the requirements set forth under Section 12 of
said Act.

MEMO RECOMMENDATION
TO: Aspen City Council
FROM: Planning and Zoning Commission
A public hearing relating to zoning of the Adkins Property
was held by the Planning and Zoning Commission on April 23, 1968.
The following motion was made in regards to this property:
"Barnard made a motion to zone the annexed Adkins property R-15
as per the Master Plan. Seconded by Benninghoff. Roll call vote -
Hartmeister aye; Tache aye; Benninghoff aye; Barnard aye; Tharp aye."
Since thise public hearing, Mr. Adkins has phoned me as to the
results of the hearing. He is in agreement with R-15 zoning for his
property.
