A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ASPEN,
COLORADO, URGING THE ELECTORATE TO VOTE "NO" ON
REFERENDUM 2A, WHICH IF APPROVED WOULD REPEAL THE VISITOR
CENTER COWOP ZONING, NAMELY A PLANNED UNIT DEVELOPMENT
(PUD) OVERLAY ON THE PROPERTY LOCATED AT THE NORTHWEST
CORNER OF GALENA STREET AND MAIN STREET.
WHEREAS, the Aspen City Council approved Ordinance No.4, Series of 2004, which
approved final land use approvals and granted a development order for the Visitor
Center COWOP Project on the northwest comer of Galena and Main Streets, 426 East
Main Street; and
WHEREAS, a referendum petition seeking the repeal of Section 1 of Ordinance No.4,
S eries of 2004 (rezoning the affected parcel) was determined to be sufficient by the City
Clerk; and
WHEREAS, the City Council pursuant to the City Charter did reconsider the adoption
of Ordinance No.4, Series of 2004; and
WHEREAS, the City Council determined to submit the proposed referred ordinance to
the voters, which is now on the ballot as "Referendum 2A," and which reads as follows:
REPEAL VISITOR CENTER COWOP ZONING
Shall Section 1 of Ordinance No.4, Series of 2004, which section seeks to amend the
Official Zone District Map of the City of Aspen by imposing a Planned Unit
Development (PUD) overlay on the property located at the northwest comer of
Galena Street and Main Street (commonly known as the Visitor Center COWOP
Project), be repealed?
WHEREAS, the majority of City Council urges the electorate to vote "no" on
Referendum 2A, which if approved would repeal the Visitor Center COWOP zoning,
namely a Planned Unit Development (PUD) overlay on the property located at the
northwest comer of Galena Street and Main Street, for, but not limited to, the following:
1. The decision to locate the Visitor Center at the northwest comer of Galena Street
and Main Street was arrived at through a COWOP process. The COWOP process
was created and adopted by the City ofAspen to allow the planning of projects of
significant community interest by and through input from neighbors, property
owners, public officials, technical advisors and consultants, members of the
public, and other parties of interest assembled as a formal reviewing and
recommending authority- a COWOP Task Force Team. The Task Force Team
voted 11-1 to approve the project at the Galena and Main Streets location.
2. The project location is highly advantageous due to its proximity to short-term and
long-term public parking, State Highway 82, the attractions of downtown Aspen,
pedestrian connections to and through downtown Aspen, and a regional network
of trails.
3. The project location will help orient tourists as commercial tourist maps typically
depict Aspen Mountain at the top of the map with the city's streets below (a
south-on-top map orientation), the same orientation a tourist will have looking
south from the project location towards Aspen Mountain.
4. The Visitor Center COWOP project minimizes reliance on the automobile with its
proximity to downtown and common destinations including the parking garage,
proximity to transit services, pedestrian connections, and provision of resources
for the car-sharing program.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO, THAT:
Section 1.
That the City Council of the City of Aspen, Colorado, urges the electorate to vote "no"
on Referendum 2A, which if approved would repeal the Visitor Center COWOP zoning,
namely a Planned Unit Development (PUD) overlay on the property located at the
northwest comer of Galena Street and Main Street, Aspen, Colorado.
