E. i Sec.13, T-10-S R-85-W, of the 6th P.M., beginning at a point whence the southerly boundary line of the City of Aspen intersects the southerly line of Durant Ave., said point being on thenortherl~ property line of Block 3, Eame~ Addition, thenceN. 75 09'11" W. along the southerly l~ne of Dur- ant Ave. 616.3 feet to the point of intersection with the westerly boundary line of Center Street, said point being coincident with the northeast Corner of Lot 1, Block 5 Eames Addition,thence N. 14050'49" E. 220.13 feet along the westerly line of Center Street to the boundary line of the City of Aspen, thence S. 55033' E. 654.18 feet along said boundary to the point of beginning, containing 1.56 acres, more or less. It was stated that the old City Council had looked favorably upon this annexztion, but that formal annexation had never taken place. Mr. Whitaker suggested that the Planning Commissionn go out and look over this property first before taking any action as there might be some difficulty with a density problem here. Mr. Walls also suggested action be delayed in order to check on the 26 foot height of the property. He advised the members to look at the' property and then return to this petition for annexation at the May 26th meeting. \ I ! Excerpts from May 26th meeting: Mr. Walls brought up th e subject of annexation of Block 2, Eames Addition, which had been discussed and tabled at the last meeting, and asked for a motion. Mr. Pabst said the Council was not in favor of annexation but felt that it should go through because of the length of time it had been held up to date. Mr. Whitaker stated that the matter should be held in abeyance until such time as the City Council adopted the proposals regarding annexation set forth in the proposed letter. Mr . BOX 3 4 9 ASPEN, COLORADO S 1 611 March 23, 1964 Honorable Mayor and City Council Aspen, Colorado RE: Petition for Annexation Dorothy Koch Shaw Gentlemen: The City of Aspen Planning and Zoning Commission, after consideration and investigation of the above men- tiqned petition, recommends that the City annex this area to the City of Aspen. The Planning and Zoning Commission felt, during the time of review and investigation of this petition, that the whole block should be annexed instead of just this small parcel. But as the lots remaining in the block, those to the West of the area in question, are under serious litigation as to o,mership, the likeli- hood of this area being annexed in the near future is quite dim. Due to the fact that we are attempting to straigh- ten and realign the boundaries of the City, we feel that this individual parcel should be annexed. This is not meant to set a precedent, but only to alleviate an existing problem. BE IT FURTHER RESOLVED that the City Clerk of the City of Aspen shall cause the requisite notice to be published in the Aspen Times in compliance with the provisions of 139-11-4, C.R.S. 1953, as amended. ~ r-- RESOLUTION WHEREAS, Petition for annexation of territory described hereinafter was filed with the city Clerk on January 24, 1964, and amended by petition for annexation filed February 24, 1964, requesting annexation of the following described territory to the City of Aspen, Colorado: A portion of Lot 11, Section 12, Township 10 South, Range 85 West of the 6th Principal Meridian, described as follows: Beginning at the intersection of Line 7 to 8 of ..the Aspen Townsite and the Southerly line of Block 19 in said Aspen Townsite, whence the Southeast corner of said Block 19 bears S. 75009'11- E., 5.66 feet; thence N. 550l5'44Q W. 153.52 feet; thence 8. 14050'49- W., 15.49 feet; thence S. 9037' E. 122.76 feet; thence S. 75009'11- E., 300.79 feet; thence N. 55015'44- W. 220.43 feet, containing 19,528.6 square feet in all. AND, WHEREAS, the petition has been examined and has been reported by the City attorney to be prepared in conformity to the law, and has been approved by the city Planning Commission. NOW, THEREFORE, BE IT RESOLVED that the said Petition for Annexation, as amended, shall be, and the same is hereby accepted and ordered filed, and that notice over the signature of the Clerk of the City of Aspen shall ;:'promptly be published for hearing thereon to be cqnducted on May 18, 1964, at 3:30 o'clock P.M., according to law.
