It was stated that the old City Council had looked favorably upon this annexztion, but that formal annexation had never taken place. Mr. Whitaker suggested that the Planning Comrnissionn go out and look over this property first before taking any action as there might be some difficulty with a density problem here. Mr. Walls also suggested action be delayed in order to check on the 26 foot height of the property. He advised the members to look at the property and then return to this petition for annexation at the May 26th meeting. Excerpts from May 26th meeting: Mr. Walls brought up th e subject of annexation of Block 2, Eames Addition, which had been discussed and tabled at the last meeting, and asked for a motion. Mr. Pabst said the Council was not in favor of annexation but felt that it should go through because of the length of time it had been held up to date. Mr. Whitaker stated that the matter should be held in abeyance until such time as the City Council adopted the proposals regarding annexation set forth in the proposed letter. Mr. Lai seconded this motion. That the City of Aspen annex the following described lands: A tract of land situated in the N. BOX 349 ASPEN, COLORADO 8161 1 March 23, 1964 Honorable Mayor and City Council Aspen, Colorado RE: Petition for Annexation Dorothy Koch Shaw Gentlemen: The City of Aspen planning and Zoning Commission, after consideration and investigation of the above men- tioned petition, recommends that the City annex this area to the City of Aspen. The 'Planning and Zoning Commission felt, during the time of review and investigation of this petition, that the whole block should be annexed instead of just this small parcel. But as the lots remaining in the block, those to the ;7est of the area in question, are under serious litigation as to ownership, the likeli- hood of this area being annexed in the near future is quite dim. Due to the fact that we are attempting to straigh- ten and realign the boundaries of the amity, we feel that this individual parcel should be annexed. This is not meant to set a precedent, but only to alleviate an existing problem. WHEREAS, a petition was filed with the Ciity Clerk for the City of Aspen on November 18, 1963, requesting the annexation of Lots 1, 21 31 41 51 61 7, 8 and 9, Block 2 Eames Addition adjacent to the City and Townsite of Aspen, which petition was signed by owners of more than fifty per cent of the area and who also comprised a majority of the landowners residing in the territory at the time the petition was filed, all pursuant to Section 139-11-3 of Colorado Revised :Statutes, 1953. WHEREAS, the City Council for the City of Aspen did by Resolution accept said petition for annexation of said land at a special meeting on November 19, 1963. WHEREAS, notice of said petition was duly published in the Aspen Times, a newspaper of general circulation on November 22, November 29 and December 6, 1963, and no counter - petitions have been filed within 30 days of the first publi- cation of said notice. WHEREAS, all requirements of Chapter 139, Article 11, Colorado Revised Statutes, 1953, have been complied with in connection with the annexation of said territory. NOW,THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ASPEN: SECTTON 1: That the following described tract of land situate in the County of Pitkin, State of Colorado, adjacent to the City and Townsite of Aspe'q, the boundary thereof so situated that not less than one -sixth of the aggregate external boundaries of said tract of land coincide with existing boundaries of the City of Aspen, is hereby added to, annexed, taken into and made a part of the City of Aspen: Lots 1, 29,39 41 51 69 7, 8 and 9 in Block 2 Eames Addition adjacent to the City and Town - site of Aspen. SECTION 2: That the land described in Section 1 of this Ordinance is hereby assigned to and made a part of Ward No.2 of the 6ity of Aspen. Section 3: That the map of said tract of land des- cribed in Section 1 hereof shall be filed in the office of the Clerk and Recorder for Pitkin County on the ef- fective date of this Ordinance; and that a copy of the map and a certified copy of the petition for annexation and a certificed copy of this Ordinance shall be filed with the Secretary of State of the State of Colorado, SECTION 4: An emergency is declared to exist and the immediate passage of this Ordinance is necessary for the public peace, health and safety of the inhabitants of the City of Aspen, Colorado, and this Ordinance shall be in full force and effect five (5) days after its final publication.
