REQUEST:
PETITION FOR ANNEXATION OF TERRITORY TO
THE CITY OF ASPEN
The undersigned petitioner, being the sole landowner
within the exterior boundary of the territory hereinafter des-
cribed, respectfully requests the City Council of the City of
Aspen to approve the annexation of the proposed area to be
annexed in'accordance with the provisions of 1973 CRS Title 31,

Article 8, and in support thereof alleges:
1. It is necessary and desirable that the territory
described below be annexed to the City of. Aspen.
2. The requirements of 1973 CRS Section 31-8-104
and 31-8-105 exist or have been met.
3. The petitioner is the sole owner of the territory
sought to be annexed and therefore the owner of
more than 50% of the territory sought to be
annexed.
LEGAL DESCRIPTION:
The legal description of the land owned by Petitioner for
which annexation is sought is attached hereto as Exhibit A.
ATTACHMENTS:
Accompanying this petition are four prints of an annex-
ation map containing the information required by 1973 CRS Section
31-8-107.

A tract of land situated in the SE 1/4 of
Section 12, T10 S, R 85 W. of the 6th P.M. Pitkin County,
Colorado and being part of the Mary B. No. 2 Lode Mining
Claim, survey No. 19640. Said tract is more fully described
as follows:
Beginning at a point on Line 7-8 Aspen Townsite,
being also on the Westerly line of Sixth Street whence
the Northeast corner of Lot S, Block 19, City of Aspen
bears N 140 50' 49" E 91.00 feet;
Thence N 550 18' 18" W 95.68 feet along said
line 7-8 to a point on the Westerly line of Lot Q, said
block 19;
Thence S 140 50' 49" W. 41.49 feet along the
Southerly extension of the Westerly line of said I.ot Q,
to a point on the extension of the Northerly line of West
Hopkins Avenue;
Thence S 75' 09' 11" E 90.00 feet along said

WHEREAS, there has been filed on behalf of 700 Hopkins
Avenue Apartments, a general partnership, a Petition for Annexation
of the following described tract:
A tract of land situated in the SE; of Sec.. 12,
T10S, R85W of the 6th P.M., itkin County, Colorado,
and being part of the Mary B. No. 2 lode mining
claim, survey no. 19640, said tract is more fully
described as follows:
Beginning at a point on line 7-3 Aspen Townsite,
being also on the Westerly line of Sixth Street
whence the Northeast corner of Lot S, Block 19,
City of Aspen bears N.14150'49" E. 91.00 feet;
thence N.35°18'18" W. 95.68 feet along said line
7-8 to a point on the Westerly line of Lot Q said
Block 19; thence S.14°50149" '7. 41.49 feet along
the Southerly extension of the Westerly line of
said Lot Q to.a point on the extension of the
Northerly line of West Hopkins Avenue; thence
S.75009'11" E. 90.00 feet along said extension of

General Partner, dated May 7, 1975, has been considered by the Aspen
City Council, and has been found to be in substantial compliance with
the reauirements of Section 31-3-107(1) C.:.t.`'. 1973, the Colorado
Municipal Annexation Act, and
WHEREAS, it is required by said Act that the Council deter-
i:-:ination of compliance of an annexation petition be by Resolution
and therefore of record,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF ASPEN, COLORADO:

1. That the Petition for Annexation dated May 7, 1975,
,signed by George Madsen on behalf pf 700 Hopkins Avenue Apartments,
a General Partnership, be, and hereby is, determined to be in
compliance with the requirements of Section 31-8-107(1) C.R.S. 1973,
the Colorado Municipal Annexation Act; and
2. That it further be determined, and the City Council so
finds, that not less than one -sixth of the perimeter of the area pro-
posed to be annexed is contiguous with the City of Aspen, and that a
community of interest exists between the territory proposed to be
annexed and the City of Aspen; that the territory proposed for annex-
ation is urban; and that the territory to be annexed is integrated
with the City of Aspen; and
3. That the City Attorney present for consideration at the
next regular meeting an ordinance appropriate to effectuate annexation;
and
4. That the City Planning and zoning Commission commence
proceedings to rezone this tract at i�.earliest a2_14enience.

AN ORDINANCE ANNEXING A•TRACT OF LAND OWNED BY 700 IiOPKINS
AVENUE APARTMENTS, A GENERAL PARTNERSHIP (SAID TRACT CON-
TAINING 2272 SQUARE FEET, MORE OR LESS) AND ANNEXING SAID
PROPERTY ACCOPDING TO THE COLORADO MUNICIPAL ANNEXATION ACT -
WHEREAS, there has been submitted a petition for
annexation by 7.00 Hopkins Avenue Apartments, a general
partnership, of Aspen, Colorado, which petition has been pre-
sented pursuant to the provisions of the Colorado Municipal
Annexation Act of 1965, C..R.S. 1973, Title 31, Article 8
thereof, and
WHEREAS, :aid petition has been considered by the
City Council of the City of Aspen, and said City council
having found that:
1. The signature on the petition represents the
owners of One Hundred (1000) Percent of the land included in
the tract to be annexed;
2. I1ot less than one --sixth (1./6th) of the perimeter
of the area to be annexed is contiguous to the City of Aspen;
3. r'here exists a community of interest between the
tract to be annexed and the City of Aspen, the tract to he
annexed is urbanized, and it is presently integrated with the
City of Aspen;
4. The annexation will not affect the constitution of
any existent school districts;
5. The petition satisfies the statutory requirements
of the municipal Annexation Act bothas to substance and form;

WHEREAS, 'ection 31-3-107(1)(g) of the Municipal
Annexation Act provides that where a petition for annexation
is signed by the owner(s) of One Hundred (100%) Percent of

election, and the City Council wishes to so proceed,
