PETITION FOR ANNEXATION OF TERRITORY TO
THE CITY OF ASPEN
REQUEST:
The undersigned petitioner, being the sole landowner
within the exterior boundary of the territory hereinafter des-
cribed, respectfully requests the City Council of the City of
Aspen to approve the annexation of the proposed area to be
anne~ed in>accordance with the provisions of 1973 CRS Title 31,
Arti~le 8, and in support thereof alleges:
1. It is necessary and desirable that the territory
described below be annexed to the City of Aspen.
2. The requirements of 1973 CRSSection 31-8-104
and 31-8-105 exist or have been met.
3. The petitioner is the sole owner. of the territory
sought to be annexed and therefore the owner of
more than 50% of the territory sought to be
annexed.
LEGAL DESCRIPTION:
The legal description of the land owned by Petitioner for
which annexation is sought is attached hereto as Exhibit A.
ATTACHMENTS:
Accompanying this petition are four prints of an annex-
ation .map containing the information required by 1973 CRS Section
31-8-107.

Colorado and being part of the Mary B. No. 2 Lode Mining
Claim, survey No. 19640. Said tract is more fully described
as follows:

of the following described tract:

,1HEREAS, it is required by said Act that the Council deter-
",ination of compliance of an annexation petition be by Resolution
and therefore of record,

finds, that not less than one-sixth of the perimeter of the area pro-
posed to be annexed is contiguous with the City of Aspen, and that a
community of interest exists between the territory proposed to be
annexed and the City of Aspen; that the territory proposed for annex-
ation is urban; and that the territory to be annexed is integrated
with the City of Aspen; and
3. That the City Attorney present for consideration at the
next regular meeting an ordinance appropriate to effectuate annexation;
and
4. That the City Planning and zoning Commission commence

AVENGE APART!1ENTS, A GENERAL PARTNERSHIP (SAID TRACT CON-
'IAINING 2272 SQUARE FEET, MORE OR LESS) AND ANNEXING SAID
PROPERTY ACCORDING TO 'I'HE COLORADO MUNICIPI,L ANNEXA'l'ION ACT,
WHEREAS ,there has been submitt,ed a petition for
annexation by 7DO Hopkins Avenue Apartments, a general
partnership, of Aspen, Colorado, which petition has been pre-
sented pursuant to the provisions of the Colorado Municipal
Annexation Act of 1965, C.R,S. 1973, Title 31, Article 8
thereof, and
WHEREAS, said petition has been considered by the
City Council of the City of Aspen, and said city Council
having found that:
The signature on the petition represents the
owners of One llundred (lOO%) Percent of the land included in
the tract to be annexed;
2. i-lot less than one-sixth (1/6th) of the perimeter
of the area to be annexed is contiguous to the City of Aspen;
3. There exists a community of interest between the
tract to be annexed and the City of Aspen, the tract to be
annexed is urbanized, and it is presently integrated with the
City of Aspen;
4. The annexation will not affect the constitution of
any existent school districts;
5. The petition satisfies -the statutor~' req;uirements
of the Municipal Annexation Act both as to substance and form;

is signed by the o\'mer(s) of One Hundred (100%) Percent of
the property proposed to be annexed, the City Council may,
by ordinance, annex without notice or hearing, and without
election, and the City Council wishes to so proceed,

Section 1
That the following described tract, situate in pitkin
County, colorado, be and hereby is annexed to the City of Aspen,
