HomeMy WebLinkAboutresolution.apz.035-04Resolution No. 35 Series of 2004 A RESOLUTION OF THE CITY OF ASPEN PLANNING AND ZONING COMMISSION SCORING A REQUEST TO CONSTRUCT AN ELEVEN (11) UNIT TIMESHARE LODGE ON THE CHART HOUSE PROPERTY DESCRIBED AS LOTS 6-9, BLOCK 3, OF THE EAMES ADDITION TO THE CITY AND TOWNSITE OF ASPEN, PITKIN COUNTY, COLORADO. Parcel ID No. 2735-131-06-002 WHEREAS, the Community Development Department received an application from LCH, LLC, represented by Stan Clauson Associates, LLC, requesting approval of Growth Management Scoring for eleven (11) tourist accommodation allotments to construct an eleven (11) unit timeshare lodge on the property commonly known as the "Chart House", located at 219 E. Durant Avenue; and, WHEREAS, pursuant to Sections 26.304 and 26.470.080 of the City of Aspen Land Use Code, land use applications requesting growth management allotments are reviewed and scored by the Planning and Zoning Commission at a duly noticed public hearing after considering a recommendation by the Community Development Director, and after considering comments from members of the general public. The scoring is then forwarded to the Aspen City Council and development allotments may then be allocated by Ordinance of the City Council at a duly noticed public hearing after considering recommendations by the Community Development Director, and comments from members of the general public; and, WHEREAS, the Aspen/Pitkin County Housing Authority Board reviewed the proposed employee housing mitigation on January 7, 2004 and recommended that City Council approve the proposed method of mitigation; and, WHEREAS, during a duly noticed public hearing on October 19, 2004, the Aspen Planning and Zoning Commission considered the recommendation of the Community Development Director, the recommendation of the Aspen/Pitkin County Housing Authority Board, and testimony offered by the general public, considered the project for initial and final scoring (score summary attached), and found the proposal to meet or exceed the necessary minimum scoring to pass, and recommended, by a seven to zero (7-0) vote, that City Council allocate eleven (11) tourist accommodation allotments for the construction of an eleven (11) unit timeshare lodge on the Chart House property at 219 E. Durant Avenue. NOW, THEREFORE BE IT RESOLVED that the Aspen Planning and Zoning Commission recommends that the Aspen City Council allocate eleven (11) tourist accommodation allotments to construct an eleven (11) unit timeshare lodge on the Chart House property described as Lots 6-9, Block 3, of the Eames Addition to the City and Townsite of Aspen, subject to the following conditions of approval: Allocation of the requested tourist accommodation allotments shall be contingent upon receiving Final PUD approval. An amendment to the GMQS scoring granted herein shall only be required to be reviewed by the Planning and Zoning Commission if said amendment is found by the Community Development Director to increase the dimensional requirements, increase the growth impacts associated with the development, increase the number of allotments required for this proposal, or reduce the ratio of proposed employee housing mitigation as compared to the calculated employee housing mitigation required by using the calculation methodology included in Staff's Memorandum to the Aspen Planning and Zoning Commission dated October 19, 2004. APPROVED by the Aspen Planning and Zoning Commission at its regular meeting on October 19, 2004.
