AS A REVIEWING ENTITY FOR THE STATE INCOME TAX CREDIT
PROGRAM FOR QUALIFYING HISTORIC REHABILITATION PROJECTS
UNDER C.R.S. SECTION 39-22-514

WHEREAS, the Aspen Historic Preservation Commission and City Council support the
creation of benefits to assist in the preservation and protection of historically significant
resources; and
WHEREAS, Colorado House Bill 90-1033 (C.R.S. § 39-22-514, as amended) was
signed unto law April 20,1990, establishing tax credits for historic structures throughout
the state; and
WHEREAS, the City of Aspen, as a Certified Local Government (CLG) pursuant to the
provisions of 16 U.S.C. Section 470a(c)(1), as amended, is eligible to review
rehabilitation tax credit projects as defined by C.R.S. Section 39-22-514(12)(i); and
WHEREAS, the provisions of C.R.S Section 39-22-514(10)(a) require that each
Certified Local Government annually adopt a resolution stating whether it will act as a
reviewing entity during the following twelve (12) months; and
WHEREAS, participating in this program provides an increased level of preservation
service and benefits to our community.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ASPEN,
COLORADO RESOLVES:
The City of Aspen hereby agrees to act as a reviewing entity for the purposes of C.R.S.
Section 39-22-514(3) and (6) for calendar year 2005, to maintain a "preservation fund"
with any fees collected, as required by C.R.S. Section 39-22-514(11)(b)(i), and to utilize
those fees as provided for in C.R.S. Section 39-22-514(11)(a) to administer the program
and to provide information and education to the community within the context of historic
preservation.
