PETITION FOR ANNEXATION OF TERRITORY
TO THE CITY OF ASPEN, COLORADO
"
We, the undersigned, being land ,owners within the ~xterior boundaries
of the territory hereinafter described, do hereby respectfully petition the
City Council of the City of Aspen, Colorado, to annex said territory to said
City under the provisions of C.R.S. 1963, 139-10-1 to 139-10-9, both inclusive,
the exterior perimeter of the land desired to be an~exed, being described as

FINDINGS OF FACT
The above entitled case came on for trial on the 2nd day of August,
A. D. 1966, before The Honorable J. Robert Miller, as presiding Judge. The
plaintiffs appeared in person and by Frank Delaney their attorney and the
defendant appeared by Janet K. Gaylord its attorney, and ,thereupon evidence
was submitted on behalf of the plaintiffs as well as the defendant and ,now
on this the 3rd day of August, 1966, the Court having considered the testi-
mony and evidence submitted herein and the argument of counsel and being now
.
fully advised in the premises, makes the following findings of fact, to-wit:
1. That the plaintiffs are aggreived persons as the term is used
in C.R.S. 1963 139-10-6 and as such are entitled to institute and prosecute
this proceeding.
2. That the petition for annexation filed in the office of the
City Clerk of Aspen on or about the 18th day of August, A. D. 1965, the same
being the petition upon which the annexation proceedings mentioned in the
complaint were predicated, was not signed by as, many as fifty per cent (50%)

of the landowners residing in the territory sought to be annexed at the time
said petition was filed.
3. The said petition did not contain a description of the property
included within the area proposed to be annexed with any degree of certainty
and said description was-insufficient in that respect"
4. That said petition for annexation, at the time it was filed in
the office of the City Clerk of the City of Aspen, was not accompanied by
four (4) copies of a map or plat of the territory proposed to be annexed show-
ing, with reasonable certainty, the territory to be annexed or the boundaries
thereof or its relationship to the established corporate limits of the City
of Aspen.
5. That less than one-sixth of the aggregate external boundaries
of the territory proposed to be annexed coincided with existing boundaries of
the City of Aspen, the annexing municipality and in that respect, the annex-
ation proceedings did not meet the requirements specified in C. R. S. 139-10-2
(c) .
6. That territory owned by various landowners within said area
proposed to be annexed and, particularly, the lands owned by the plaintiff
Samuel W. Howell and another tract owned by one William L. Lane, were divided
into separate parts or parcels, The consent of the owners to such division
into separate parcels was not shown by the evidence and the Court finds that
in that respect the proceedings herein did not comply with the requirements
of C. R. S. 1963 139-10-2 (f) (2).
7. That, as will appear from the foregoing findings, the defendant
City of Aspen failed to comply with various mandatory statutes in the proceedings

for the annexation to the City of Aspen of the area, or territory, referred
to in the complaint and answer herein.
CONCLUSIONS OF LAW
A. Because of the failure of the City of Aspen to comply with man-
datory statute requirements, as set forth in the foregoing findings of fact,
the said annexation proceedings are null and void.
B. That the plaintiffs should have judgment for costs herein.
JUDGMENT
WHEREFORE, IT IS ORDERED, ADJUDGED AND DECREED that the annexation
proceedings referred to in the complaint and answer herein are null and void
and of no force or effect.
IT IS FURTHER ORDERED that the plaintiffs do have and recover judg-
ment against the defendant for their costs incurred in this proceeding.
Defendant is allowed 20 days from the 3rd day of August, 1966, in
which to file a motion for new trial.

Defendant, The City of Aspen, answers the Com-
plaint of the Plaintiffs as follows:
1. Defendant admits the ~llegations of Para-
graphs 1, 2, 7 and 10 of the first claim of the Complaint,
and the second paragraph of the second claim for relief.
2. Defendant is without knowledge or infor-
mation suf,ficient to form a belief as to the truth of the
averments in Paragraphs 3, 4, 5 and 6 of the first claim
for relief, and therefore denies same.
3. Defendant denies the allegations of Para-
graphs ~ 8 and 9 of the first claim for relief, and Para-
graphs 1 and 3 of the second claim for relief.
WHEREFORE, Defendant prays that the Court dismiss

defendant be enjoined and restrained from attempting to impose
any municipal taxes in the area sought to be annexed and which

1. That the territory to he annexed, herein described
in Exhibit "A", remain as presently zoned under the existing
Pitkin County Zoning resolutions, pending public hearing and
adoption of an amendment to the zoning ordinance by the City
Council of Aspen, Colorado, making the appropriate additions and
.
changes in the zoning map of the City of Aspen, Colorado to effect
the zOning of the new territory to be annexed under Ordinance No.
16.
2. That the City Clerk is hereby directed to publish
a Notice of Zoning Hearing to be held by the City Council of
Aspen, Colorado on the matter of zoning the territory to be
annexed under Ordinance No. 16, and the consideration of the
suggested changes in the present zoning Ordinance.
3. That said hearing shall be held on the 6th day of
December, 1965, at 5:00 o'clock P.M. in the Aspen City Council
chambers in the City Hall at Aspen, Colorado.
4. That the City Clerk shall send a written Notice
of said hearing by first class mail at least fifteen (15) days
prior to the hearing date to property owners in the City of
Aspen, Colorado, within the newly annexed area to be zoned,
and within three hundred feet (300) of said area.

AN ORDINANCE PROVIDING FOR THE ANNEXATION TO THE CITY OF ASPEN,
COLORADO, OF THAT CERTAIN TERRITORY OR REAL ESTATE PARTICULARLY
DESCRIBED IN THIS ORDINANCE, LYING OUTSIDE BUT ADJACENT TO SAID
CITY OF ASPEN, COLORADO:
BE IT ORDAINED by the City Council of the City of Aspen,
Colorado:
Section 1: That pursuant to written petition presented
to the City Council of Aspen, Colorado, signed by over fifty
percent (50%) of the landowners and by the owners of more than
fifty percent (50%) of the area included within said petition
for the annexation of certain territory herinafter particularly
described lying outside but adjacent to said City in Pitkin
county, Colorado, in opposition to which, a counter petition
not in ,formal compliance with C.R.S.(l963) 139..10-3 and 139-10-4
has been filed within the time prescribed by law, after notice
given by publication in The Aspen Times, a weekly newspaper of
general circulation in the City of Aspen, Colorado, August 20th,
and 27th and September 3, 1965, in compliance with the statutes of t
the State of Colorado, and after acceptance of the said Resolu- , .
tion of said City Council at their meeting held August 16,1965, i
the following described territory or real estate as outlined
in Exhibit A, attached hereto, is hereby annexed ~v and,made a
part of the City of Aspen, Colorado, a municipal corporation.

WHEREAS, a Petition for annexation of territory
described hereinafter was filed with the City Clerk on August
