RE: Pitkin Mesa Subdivision Annexation - Rezoning to R-15
DATE: February 11,1977
This is a Public Hearing to consider the rezoning of Lots 8, 9, 10, 11,
12, 14, 15 and 16, of the Pitkin Mesa Subdivision to R-15. The property
has been recently annexed to the City of Aspen subject to satisfaction
of terms on annexation agreement. The lots are a minimum size of 15,000
square feet.
The Planning Office recommends rezoning of these lots to R-15.

Dear Hal,
Please consider this letter a formal request from the Home
Owners of lots 8, 9, 10, 11, 12, 14, 15, 16, Pitkin Mesa Subdivision
for the zoning of their land. We would ask that the Planning Office
recommend that said land about to be annexed into the City be zoned
R-15 and pusuant to the Area and Bulk requirements of the Zoning
Code be granted all the benefits that inure to R-15 duplexs sub
divided as of the effective date of the current zoning, (ie.
duplexes permitted on minimum lots of 15,000 ft.)
While I am aware that the Drocedural steps may require a final
approval of annexation before consideration of the zoning anplication
I would nonetheless request the Planning Office to undertake whatever
investigation is necessary to make a recommendation on;our zoning
request.

PUBLIC NOTICE
Notice is hereby given that a Public Hearing will be held before
the Aspen Planning and Zoning Commission on February 15, 1977,
at 5:15 P.M. in the City Council Chambers, City Hall to consider
the request by G. Dittmar, representing Home Owners, for rezoning
of lots 8, 9, 10, 11, 12, 14, 15, and 16 Pitkin Mesa Subdivision
to R-15. These lots are in process of annexation to the City of
Aspen.
A copy of the request may be examined in the of the City/County'
Planning office during normal business hours.

IMPROVEMENTS AGREEMENT

CITY OF ASPEN, COLORADO, a muriicipa1 corporation (hereinafter
referred to as "City"} and THE BOARD OF COUNTY COMMISSIONERS OF
PITKIN COUNTY, (hereinafter referred to as "County") wherein it
is stipulated and agreed as follows:
RECITALS
a. The City has received petitions for annexation
of the following described tracts of land located within Pitkin
County, namely:

Lots 8, 9, 10, 11, 12, 14,15, and 16 of Block 1,
Pitkin Mesa SUbdivision,
and, ,
Lot 2, Block 2, Pitkin Mesa Subdivision.
b. Abutting these properties is a segment of County
road which both the City and County desire be annexed if the
requested petitions for annexation of the above-described properties
are granted.
c. The City is agreeable to annexing the roadway if,
prior to annexation, the County agrees to improve the roadway to
meet standards established by the City Engineer. The County accepts
this condition and the City and County wish to formalize their
.understanding with respect thereto,
THEREFORE, in consideration of the mutual benefits to
be derived herefrom, it is agreed to by the parties as follows:
1. The County, in consideration of the annexation of
the roadway described in Paragraph 2 below, agrees to assume the
cost of, and make arrangements for, all hot asphalt patching
necessary to put the roadway in good condition; and further to
from the barrow ditch
remove/the presently existing talus, slide from the edge of the
pavement. It is anticipated that this work will be undertaken
by County maintenance crews and be completed in the summer of 1977.

In any event, all improvementshe'rein contracted to be under-
taken by the County shall be completed by the. end of the 1977
calendar year.
2. The roadway to be improved ,is located in Section 1,
Township 10 South, Range 85 West o~ the 6th Principal Meridian
and is described as that section of the county road (not already within
the City limits) abutting Lots 10 through 16, Block 1, Pitkin Mesa
Subdivision. A metes and bounds description of the roadway is
contained in Ordinance 76, Series of 1976, of the City of Aspen,
the provisions of which are referred to ~or further elaboration
of the facts recited herein.

3. Subsequent to annexation of the above roadway and
completion of the improvements herein described, the City will
assume all further necessary repairs to and maintenance of, said
roadway; and the roadway shall be deemed a city right of way for
all intents and purposes from that time forward.
IN WITNESS WHEREOF, the parties hereto have executed
this agreement on the day and year above written.
