RE: Smuggler Annexation
Under the provJ.sJ.Ons of the Colorado Municipal Annexation Act the
Council may annex the above territo~ by ordinance if you fim the
following during the public hearing to te held Monday, April 16,
1979:
1. 'Ihat proper notice has teen given. Proof of notice
is simply the introduction of Affidavit(s) of
Publication from the Aspen Times.
2. 'Ihat no contiguous property of identical ownership
is divided such that a p3.rt is annexed and p3.rt
remains outside of the City of Aspen. Engineering
can testify to this fact.
3. That no parcel comprising twenty (20) acres or IllOre
is included within the annexation without the
consent of the property owner. This element is met
for the the entire annexation is less than twenty
(20) acres.
4. That no annexation proceedings have teen commenced
to annex all or part of this territo~ to another
municipality. This element is met since no other
municipality exists which has a one-sixth contiguity
to this territory.
5. That annexation will not affect the constitution of
any school district. Since this area am the City
are each p3.rt of the same school district, no change
will result as a consequence of this annexation.

Smuggler Trailer Park Annexation
It will cost approximately $12,480,00 per year to provide enforce-
ment of applicable codes equal to what is currently provided in
the City as it exists now. This figure is based on two days per
week. The actual time involved includes, but is not limited to,
issuing permits, code interpretation, inspections for code com-
pliance, handling complaints, zoning enforcement, etc.

Smuggler Enclave Annexation -
Public Works Costs
In making an estimate of the public works costs associated with
the Smuggler Enclave Annexation, it must be noted initially that
no policy statement has been adopted which establishes the levels
of service and capital improvements that can be expected after
annexation. As a result, the assumptions which are made as to these
levels of service introduce a far greater degree of potential error
than the variation in the cost of labor and materials for the serv-
ices or improvements. Considering the City's financial status over
the last few years, it seems reasonable to assume that there will
be no drastic changes in the status quo of the street and utility
systems. The City will probably assume additional street mainten-
ance and snow removal responsibilities together with some waterline
improvements and maybe even some minor items such as improved street
lighting.
At present, over 50% of the street system being annexed is split
50/50 between the City and the County both in terms of legal bound-
aries and the physical maintenance. It is reasonable to assume that
the City would pick up a larger share, possibly even the entire
length of Gibson Avenue between Park Avenue and Mill Street, but it ~oP
is unlikely that the City would spend more than two man-days and" ,,<> eI"',y
two or three hundred dollars during the course of the winter to ~ 9'.
maintain and sand this additional roadway. Current road conditions ~
in the area range from fair to poor with some of the poor areas
already being 50/50 City/County responsibility. An asphalt overlay
to correct the worst areas near Smuggler Trailer Court (which is
50/50 City/County at present) would probably run on the order of
$2,500. The intersection of Neale Avenue and King Street is extremely
narrow and a traffic hazard. This situation can be corrected most
economically by use of in-house crews together with the relocation
of some overhead utilities and $500 for materials. Another area of
cost would be signage and handling of traffic complaints. The area
has repeatedly been plagued by poor traffic circulation and numer-
ous citizen complaints, and this would require additional engineer-
ing staff time. In addition to roadways and traffic there is the
matter of the Neale Avenue bridge. The bridge is presently 75% City
and 25% County, but by default the City has assumed primary respon-
sibility for the bridge. As a result, it is probably wishful thinking
at this point to assume that the County would contribute to the

two factions:
1) Increase in patrol time and investigation time requiring the addition of
one patrol officer at the cost of $1,190 monthly
2) Possibly significant time enforcing parking regulations and towing. This
would necessitate the addition of one TCO at the cost of $700 monthly

future costs of repair or replacement; hence, this becomes a very
questionable cost of annexation. However, annexation may change the
priorities for implementing improvement, and in fact, the bridge
is in very poor condition.
In regard to the water utility system, the area of King Street and
Queen Street being annexed does not have water service. Although
the City can legally enforce a policy whereby the property owners
are required to pay for any extension of water service, it is my
feeling that the City water utility will inevitably bear this cost
directly. The cost for extending water service including fire pro-
tection and in-house engineering on both King and Queen Streets
would be in the range of $17,500.
Rights-of-way and easements are the last major category where the
City will undoubtedly incur future costs. There are numerous pri-
vate property boundary conflicts similar to the Barrailer, Kappeli,
and Hasty situations. Each right-of-way and property boundary con-
flict is unique but each will involve considerable staff time. If
they were to be tackled on an integrated basis, the minimum effort
would probably be on the order of 25-30% of one person's time which
represents approximately $6,500 in salary and fringe benefit costs.
We are already dealing with these problems on a case by case basis,
and the real cost to the City is in terms of a lost opportunity to
use annexation as a tool to implement these corrections.
In conclusion, there is no doubt that engineering costs and other
public works costs will increase; however, most of these costs are
too uncertain to itemize either because there is no clear policy
as to what will take place or the event is too uncertain as to
timing. The figure of $17,500 for water improvements seems to be a
fairly predictable certainty. Road maintenance will undoubtedly
increase somewhat. As stated earlier, we have probably already
assumed financial responsibility for the Neale Avenue bridge despite
the fact that it is partially in the County. Although the City will
be losing certain leverage for acquiring rights-of-way and utility
improvements as a condition of annexation, it will be acquiring an
asset in terms of subdivision control as these properties ultimately
develop to the highest and best use.
Finally, I feel that the greatest daily operating cost will be
incurred in terms of engineering department's staff time to handle
the routine complaints from citizens concerning roads, traffic,
survey and similar problems in the area together with the time
needed to administer subdivision and development review and the
public works planning effort. Although this work will not justify
a full time position by itself, it is my sincere feeling that the
engineering department is at that critical point where any additional

work load of this nature will necessitate increased staffing in
order that the level of service to the community does not diminish.
In terms of cost this would probably be an upper level engineering
technician which represents a total salary cost of approximately
$15,000 per year.
