SUMMARY: The following documents are attached:
1. petitions for Annexation.
2. City Clerk memo dated May 30, 1986, verifying signatures.
3. Planning Office memo dated May 21, 1986 verifying that
more than 50% of area is covered by the petition.
4. Map of Williams Addition.
The Williams Addition landowners have submitted a "petition for
annexation" signed by the landowners of more than 50% of the
territory to be annexed. Based on the petition, the city
attorney's office has prepared a memorandum and a Resolution No.
I~ for City Council adoption.
PREVIOUS COUNCIL ACTIOOO: City Council directed staff to pursue
the Williams Addition Annexation at the October 28, 1986, council
meeting.
BACKGROUND: The City Council has identified annexation as a high
priority. The Williams Addition was identified as one of the
first sub-areas for annexation in the Smuggler Area.
PROBLEM DISCUSSION: Resolutio~ No. J:J- sets the public
hearing. During the public hearing the City Council would
determine if the annexation meets the following requirements:
1. The existence of 1/6 contiguity.
2. A community of interest between the territory proposed to
be annexed and the annexing municipality.
3. That the territory proposed to be annexed is urban or will
be urban the near future.
4. That the territory proposed to be annexed is integrated or
capable of being integrated with the annexing municipality.

Attached for your files is a copy of Karen's legal opinion
concerning the question of whether or not public right-of-way
should be included in the calculation of the net size of annexation
areas. Karen's opinion confirms our idea that right-of-ways are
excluded when calculating the new size of annexation areas.
Based upon Clude Bennis's signature of the annexation petition
it looks like ,we have enough land to proceed with the Williams
Addition annexation. According to my estimates the owners of
approximately 139,100 square feet of land have signed the peti Hon
as compared to 127,500 square feet of land which is not part of
the annexation petition.

the process.

I have reviewed the state statutes, the Colorado Constitution, and

Article II, Section 30 of the Colorado Constitution provides that

PETITION FOR ANNEXATION OF TERRITORY TO THE CITY OF ASPEN
(WILLIAMS ADDITION ANNEXATION)
We, the undersigned, being the landowners of more than 50% of
the area, excluding public streets and alleys, meeting the
requirements of Sections 31-12-104 and 31-12-105, C.R.S., allege
as follows:
1. It is desirable and necessary that the area hereinafter
described be annexed to the City of Aspen.
2. The requirements of Sections 31-12-104 and 31-12-105,
C.R.S., exist or have been met.
3. The signers of the petition comprise the landowners of
more than 50% of the territory included in the area proposed to be
annexed, exclusive of streets and alleys.
4. The legal description of the area to be annexed is as
follows:
Beg inning at the point NA 89 of the North Annexation to the
City of Aspen, Pitkin County, Colorado; thence southeasterly
along said North Annexation boundary the following courses,
South 48049' East, 185,.0. feet to corner NA 90;
South 24039' East, 91.2 feet to corner NA 91;
South 18031' East, 89.3 feet to corner NA 92;
South 10.041' East, 32.63 feet more or less to an intersection
with the Smuggler Enclave Annexation to said City of Aspen;
thence northeasterly as the Smuggler enclave Annexation may
bear the following courses,
North 2400.5 '24" East" 108.65 feet;
North 37011'41" East, 20..25 feet;
South 44035'50." East, 12.15 feet;
North 29003'0.5" East, 10.2.32 feet;
South, 4.0.8 feet;
North 37011'41" East, 154.57 feet;

5. A proposed annexation map is attached as Exhibit "A".
6. As an inducement to the ~ity of' Aspen to approve the
annexation, the undersigned hereby declare their intent to
dedicate to the City any and all interest the undersigned, may have
in the water rights appearing on Exhibit "13-'" annexed hereto and
incorporated herein; and the undersigned hereby agree that as a
condition to the adoption of the applicable annexation ordinance,
the undersigned will deliver any an? all documents requested by
