SI) /979 '.~ PETITION FOR ANNEXATION OF TERRITORY '.-."1' TO THE CITY OF ASPEN The undersigned Petitioner, being the land owner within the exterior boundary of the territory hereinafter described, respectfully request the City Council of the City of Aspen to approve the annexation of the proposed area to be annexed in '" acccordance with the provisions of C.R.S. 1973 31-12-101 et seq. and in support thereof allege as follows: 1. It is necessary and desirable that the territory described in the Land Description below be annexed to the City of Aspen. 2. The requirements of C.R.S. 1973 31-12-104 and 31-12-105 exist or have been met. 3. The Petitioners are the owners of the territory sought to be annexed and therefore are the owners of more than 50% of the territory sought to be annexed. In consideration, thereof, the City of Aspen waives any right or power, pursuant to C.R.S. 1973, Sections 31-12-106(1) and (2), or other authority, to annex, without the prior written consent of the Board of County Commissioners, the land presently owned by the Board and contiguous to the above described parcel; if, at the time of annexation the contiguous land be owned, or under the control of, the Board of County Commissioners or Pitkin County Housing Authority. 5. NOW, THEREFORE, in compliance with Section 3l-l2-l05(1)(a), C.R.S. 1973, City of Aspen hereby consents in writing to the division of said property into separate parts for the purpose of annexing a portion thereof to the City of Aspen as requested in said petition. After the sale of property by the County to the Aspen Valley Hospital District, you retained a strip of land as depicted on the attached diagram. It is the intent of the City of Aspen to develop an employee housing project on land located to the south and east of this property. In connection therewith, it is the desire of the City Council to annex the development site and to construct the project under the codes of the City of Aspen.
