Dear Mr. Wurl:
Thank you for your letter of May 2, 1972 and preliminary
plat of the Woerndle Subdivision.
As an adjoining landowner, I object to this subdivision
as pertains to our common boundry lines on the northwest side of
the subdivision.
The plat fails to disclose existing fence lines and
structures on this northwest side, such structures and fences having
been in existence more than thirty years I am informed.
The plat also subdivides an existing public road which I
presently use to gain access to my property.
The plat is also at variance with a survey by Mr. G. E.
Buchanan that was made for me October 29, 1964.
The -plat also surveys from a marker that requires a 75 foot
drop line to a plotted curve being an obscure point in the public
roadbed.
I suggest the northwest section of this plat be redrawn
to disclose the public thoroughfare, the existing fences and structures
prior to its being approved.
Mr. Walter F. Hampel, Jr. in Aspen is familar with my property
and assists me in its management. I would appreciate your feeling free
to discuss any problems with him or questions he may have.

Dear Mr. Pesma_n.:
At its meeting on Tuesday, May 2nd the Aspen City Planning
ad Zoning Cor ission reviewed the preliminary plat of Woerndle
Subdiv:_sicn for compliance with the City's Subdivision Regula-
tion. As a result of the discussion several concerns regarding
the present plat were. raised and are listed below:
1. Only one of the seven lots meets the minimum lot area
requirement for the city's R-15 residential zone.
2. The Commission felt that a private road serving as
access to three lots should not connect directly with
a state highway and that this particular ingress/egress
point is potentially unsafe.
3. Salvation Ditch presents problems with regard to
preservation, access and maintenance or the ditch and
establishment of a permanent easement for the ditch.
Ditch seepage and toptgranhy raise questions regarding
the develoDment feasibility of the area not platted as
lots 5, 6 & 7.

4. McSkimming Road, as shown on the plat,creates align-
ment and safety problems where it enters the highway,
however it is probably the responsibility of the public
sector to correct these.
5. The 30' radius indicated in both -cut -de -sacs is inade-
quate for service vehicle turnaround.
The Commission indicated that it felt a PU 3 treatment of the
property to allow flexibility in building site placement and
building height would be the most practical method of allowing
maximum density while creating s more suitable residential
development 'or this particular tract.
PUD treatment would require R-15 (PLID) zoning after annexation
to the city. The city xoning code should be consulted for details
of the application procedure.

SUBJECT: Woerndle Annexation
DATE: April 8, 1974
Woerndle property consists of approximately 2.4 acres on
the north side of Highway 82 at McSkimming Rd., east of
town.
When a development proposal was presented to the County, the
County P & Z suggested to the developer that the site might
properly be annexed to the city. It was decided that the
city P & Z should review a proposal for the site prior to
annexation. A preliminary subdivision plat and a PUD outline
development plan was approved in concept by the P & Z last
summer. Approval was given, conditional on 1)annexation;
2) resolving a problem of water supply; 3) correcting minor
subdivision problems. The city engineer, on the basis of
the recent water service study, states that at least some
of the project can be served by autumn, 1974. At this time
the developer is requesting City Council consideration of
an annexation petition.
Summary
The P & Z Commission has given conceptual approval of the
proposed use of the land.
The Economist finds no significant costs to the city would
result from annexation, and that the PIF is sufficient to
cover an extension of water service to the project.

pertaining to the Woerndle Subdivision which has been
presented to the City for possible annexation.
I do believe the City will require that any con-
flicts in property lines relating to property under con -
Di sideration for annexation be settled prior to annexation.
I am also sending a copy of your letter to the
City Engineer for his examination and review. I am
certain that your comments relating to the narrowing of
streets within the Subdivision will weigh heavily on the
recommendations of the Planning & Zoning Commission.

Dear Mr. Kern:
I am writing to you about the Woerndle Subdivision,
a copy of the 4th preliminary plat which I have before me. I am
an adjoining property owner to the north and west and I am deeply
concerned aboiit-this subdivision.
(1) Encroaching upon my property and,:
(2) Changing a 50' dedicated street into a 30'
subdivision turnaround.
In 1964 I had my property surveyed as well as the
Alpine Inn and a portion of the present subject subdivision. I
am enclosing a copy of that survey.. This survey was made in two
parts by G. E. Buchanan and for ready reference I4iave pieced the

two parts together.
With respect to the 50' street'othat-the subdivision
proposes to reduce to 30' and .incorporate•in its plats, this is
to advise that I am opposed to any such change. I have'a gate on my property abutting - this thoroughfare and it is used by me _
or the family that lives -on my property periodically.
Z am also,ponce'rned that -the proposed subdivision plat
lines appear to be at vaxiange with the survey executed by Mr.
Buchanan in 1964' . You -`kay be further aware th re are discrepancies
in surveys of this area and I;�feel.Survey Engiers, Inc. have`
compounded 'the problem. Nby trying.to draw a plat using d 75' drop
line to a curve. This Woe)'rn.a .e Subddivision plat is al -so noticeably
negligent in f�.iliig to define the.exact location of -the Alpine
Lodge, its buildings arid, fences either direcfiy within, the plat
or adjoining thereto:. 'It is.. also a- concer°.n to.--me:that upon recent
inspection of my, property which adjoins the north 'eorner of this,
subdivision that --survey markers placed in the -ground by Mr. Buchanan
have been -removed since last Augfist =when' I made 'an inspection of that
particular area in locating those -markers for myfpartner in Aspen.

There'are other items in the Woerndle Subdivision plat
that indicate possible 5e.rious discrepancies in the plat with
respect as to how it -may -lie upon the ground. The north line of
Lot 6 discloses 135 :teet plus or minus running between the
turnaround circle €end the corner of salvation ditch. I seriously
doubt this line would measure on the ground more than 120 feet.
Of course, I am,also concerned that only one of the lots
meet the area requirement for R-15 and I seriously doubt that Lot 5
will meet this requirement when the 50' public access road is
plotted.
I chatted briefly with Mr. Bartell about my anxiety and
requested that approval, -of any subdivision of this property
recognize existing fence lines and public thoroughfares.
I further indicated to Mr. Barte-11 that should any
change or abandonment of public thoroughfares in this.area be
required,in Mr.. Woerndle'.s behalf I would be happy to cooperate
but that I must be protected from encroachment by erroneous
surveys.
