A RESOLUTION OF THE PLANNING AND ZONING COMMISSION OF THE
CITY OF ASPEN, COLORADO, RECOMMENDING AMENDMENTS TO
CHAPTER 26.580 OF THE CITY LAND USE CODE - ENGINEERING
DEPARTMENT REGULATIONS.
WHEREAS, the City Council of the City of Aspen directed the applicant to
submit an amendment to the Land Use Code, pursuant to Chapter 26.208; and,
WHEREAS, the applicant is Nick Adeh PE, City Engineer and John Niewoehner,
Community Development Engineer; and,
WHEREAS, the requested amendment is to Chapter 26.580 of the Land Use
Code. The amendment deletes engineering standards from Chapter 26.580 that will be in
the City's Book of Standards; and,
WHEREAS, pursuant to Chapter 26.310, applications to amend the text of Title
26 of the Mtmicipal Code shall be reviewed and recommended for approval, approval
with conditions, or denial by the Community Development Director and then by the
Planning and Zoning Commission at a public hearing. Final action shall be by City
Council after reviewing and considering these recommendations; and,
WHEREAS, the Community Development Director recommended approval of
amendments to the Land Use Code as described herein; and,
WHEREAS, the Planning and Zoning Commission opened the public hearing to
consider the proposed amendments, as described herein, on January 18, 2005, took and
considered public testimony and tl~ recommendation of the Community Development
Director and recommended, by a~'otttt to~-~ vote, that City Council adopt the
proposed amendments to the Land Use Code, as described herein.
NOW, THEREFORE, BE IT RESOLVED BY THE PLANNING AND ZONING
COMMISSION OF THE CITY OF ASPEN, COLORADO, THAT:
Section 1:
Pursuant to Chapter 26.310 of the Municipal Code, the Aspen Planning and Zoning
Commission hereby recommends City Council amend Chapter 26.580 to include the
following text:

26.580.020 Site and Infrastructure Improvements
26.580.010 Purpose.
The purpose of this Chapter is to ensure uniform and consistent site and
infrastructure improvements relating to development.
26.580.020 Site and Infrastructure Improvements
The following regulations, and the standards adopted in Title 21 of the Municipal
Code, shall apply to all developments.
A. Improvements.
1. Required improvements shall include the following:

Permanent survey monuments, range points, and lot pins.
Paved streets and alleys.
Curbs, gutters, and sidewalks.
Traffic-control signs, signals, or devices and pavement markings.
Street lights.
Street name signs.
Street trees or landscaping.
Water lines and fire hydrants.
Sanitary sewer lines.
Erosion control, storm drainage improvements and storm sewers.
Bridges or culverts.
Electrical lines.
Telephone lines.
Natural gas lines.
Cable television lines.
2. Approved plans. Construction shall not commence on any of the
improvements until a complete design set of plans and specifications have been received
and approved by the city engineer and, when appropriate, the relevant utility company.
B. Design standards. The Book of Standards, as established and published under
Title 21, shall govern all site and infrastructure design. In addition, the following
provisions shall complement the requirements set forth in the Book of Standards.
1. Street ends at subdivision. When a street is dedicated which ends on the
subdivision or is on the perimeter of the subdivision, the last foot of the street on the
terminal end or outside perimeter of the subdivision shall be dedicated to the City of
Aspen in fee simple and shall be designated by using outlot(s). The city shall use the
dedicated land for public road and access purposes.

2. Dead-end streets. Dead-end streets, except for cul-de-sacs, shall be
prohibited unless they are designed to connect with future streets on adjacent lands that
have not been platted. In cases where these types of dead end streets are allowed, a
temporary circular turnaround with a one hundred (100) diameter feet shall be
constructed.
3. Street names and numbers. When streets are in alignment with existing
streets, any new streets shall be named according to the streets with which they
correspond. Streets which do not fit into an established street-naming pattern shall be
named in a manner which will not duplicate or be confused with existing street names
within the City or its environs. Street numbers shall be assigned by the Community
Development Department in accordance with the city numbering system.
4. New City Monuments. In conjunction with paving, permanent survey
monuments meeting the City standards shall be installed to approximately finished grade.
City monuments shall be set on the centerline of the street right-of-way unless designated
otherwise.
5. Street name signs. Street name signs shall conform to the type currently in
use by the city.
6. Easements.
a. Utility easements. At the time of Subdivision, the City Engineer shall
require that easements be platted and recorded to accommodate existing and future
improvements including but limited to: utilities, drainage channels and structures, public
trails and sidewalks, and access driveways to adjacent parcels.
b. "T" intersections and cul-de-sacs. Easements twenty (20) feet in width
shall be provided in "T" intersections and cul-de-sacs for the continuation of utilities or
drainage improvements, if necessary.
c. Potable water and sewer easements. Water and sewer easements shall be a
minimum of twenty (20) feet in width.
Planned utility or drainage system. Whenever a subdivision embraces any
part of a planned utility or drainage system designated on an adopted plan, an easement
shall be provided to accommodate the plan within the subdivision.
e. Irrigation ditch, channel natural creek. Where an irrigation ditch or
channel, natural creek or stream traverses a subdivision, an easement sufficient for
drainage and to allow for maintenance of the ditch shall be provided.

f. Fire lanes and emergency access easements. Fire lanes and emergency
access easements twenty (20) feet in width shall be provided where required by thc city
fire marshal.
g. Planned street or transit alignment. Whenever a subdivision embraces any
part of an existing or planned street or transit alignment designated on an adopted plan, a
right of way shall be provided to accommodate the plan within the subdivision.
7. Lots and blocks.
a. General. Lots shall meet all applicable regulations of this title.
b. Side lot lines. Side lot lines shall be at right angles or radial to street lines.
c. Front on street. All lots shall front on a public or private street.
d. State Highway 82. No private driveway shall directly access State
Highway 82.
f. Block lengths. New block lengths shall normally be at least four hundred
(400) feet in length and not more than one thousand four hundred (1,400) feet in length
between street intersections.
8. Survey monuments.
a. Location. The external boundaries of all subdivisions, blocks and lots shall
be monumented on the ground by reasonably permanent monuments solidly embedded in
the ground. These monuments shall be set not more than fourteen hundred (1,400) feet
apart along any straight boundary line, at all angle points, and at the beginning, end and
points of change of direction or change of radius of any curved boundaries.
b. State of Colorado Land Surveying Laws. All monuments shall be set in
accordance with the provisions of C.R.S. Title 38, Article 51, as amended from time to
time, unless otherwise provided for in this title.
9. Utilities.
a. Underground utilities. All utilities and their appurtenances shall be placed
underground, except when they are located on private property.

a. Drainage plan. The drainage plan for proposed development shall comply
with the Book of Standards.
b. Maintain historical drainage flow. In cases where storm runoff from an
upstream basin passes through the subdivision, the drainage plan shall provide adequate
means for maintaining the historical drainage system.
11. Flood hazard areas. The following standards shall apply to special flood
hazard areas.
a. The design of proposed developments shall be consistent with the need to
minimize flood damage to public utilities and facilities such as sewer, gas, electricity, and
potable water systems;
b. Base flood elevation data shall be provided for any proposed development
adjacent to a 100-year flood plain.
C. Appeals to Chapter 26.580.
Criteria for Granting Variations. Variations to the requirements set forth in
Chapter 26.580 may be granted by the City Engineer, the Planning and Zoning
Commission, or the City Council if the following criteria have been met:
· A unique situation exists for the development where strict compliance to the
standards would result in incompatibility with the Aspen Area Comprehensive
Plan; the existing, neighboring development areas; and/or the goals of the
community.
· In writing, the applicant shall specify each design standard variation requested
and provide justification for each variation request, providing design
recommendations by a professional engineer as necessary.
Insubstantial Variations: Insubstantial variations maybe approved, approved
with conditions, or denied by the City Engineer based on the criteria set forth
above.
Substantial Variations: Variations that cannot be approved by the City
Engineer may be approved, approved with conditions, or denied by the
Planning and Zoning Commission at a public hearing based on the criteha set
forth above.
Appeals. An applicant aggrieved by a determination made by the City
Engineer, pursuant to this Chapter, may appeal the decision to the Planning
and Zoning Commission pursuant to the procedures and standards of Chapter
26.316. An applicant aggrieved by a determination made by the Planning and

the procedures and standards of Chapter 26.316.
